Coal Export Developer Challenges Tribal Claims To Fishing Sites On The Columbia

An Oregon coal export developer is challenging claims that its proposed dock on the Columbia River would interfere with tribal fishing sites.

The Confederated Tribes of The Umatilla Indian Reservation and the Confederated Tribes and Bands of the Yakama Nation have submitted letters and affidavits to the Oregon Department of State Lands indicating they have tribal fishing sites in the area where Morrow Pacific has proposed to build a dock in Boardman, Oregon for coal barges.

The Morrow Pacific project would transport around 9 million tons of coal per year from Wyoming and Montana to Asia. The coal would be delivered by train to the dock site in Boardman, where it would be transferred to barges on the Columbia River. The barges would carry the coal to another dock site downstream near Clatskanie, Oregon where the coal would be transferred onto ocean-going ships.

Morrow Pacific needs a permit from the DSL to build a dock at the Port of Morrow in Boardman. DSL rules say the state can issue the permit as long as the action would not “unreasonably interfere” with preservation of water for navigation, fishing and public recreation.

The company submitted a letter to the state Thursday arguing that its dock will not “unreasonably interfere” with fishing. It also argues that considering fishing impacts from the dock is outside the DSL’s authority for this permit.

Brian Gard, a spokesman for Morrow Pacific, says the company disagrees that tribes have proven their members fish at the dock site. He says the affidavits submitted to the state either misidentify the site geographically or they fail to show that tribal fishing has taken place in the dock location.

“We do not believe they establish tribal fishing or tribal fishing sites at the Port of Morrow industrial Dock 7 site,” Gard said. “Understanding the site context is important here. The proposed dock site is in a heavily industrial area. It’s on port of Morrow property. It’s situated between two other docks. It’s an area designated by the state as an area where docks are to go.”

The company submitted declarations from local community members, the port director and tugboat operators who say they haven’t seen tribal fishing taking place at the dock site. It also consulted a fishery biologist who says the dock area does not support a healthy fishery.

“Not only have we been fishing there since time immemorial, but we continue to fish there at the present time,” said Chuck Sams, communications director for the Umatilla tribes. “We have provided affidavits to the Corps of Engineers and Oregon Department of State Lands, and we’ve spoken directly with Ambre Energy and Morrow Pacific explaining that we have fishing sites, usual and accustomed, at their proposed facility.”

In a recent speech, Gov. John Kitzhaber noted the conflicts flagged by the tribes shortly after declaring his opposition to coal exports in the Northwest. The governor said he will do all that he can “under existing Oregon law to ensure that we do not commit ourselves to a coal-dependent future.”

YAKIMA, Wash. —

Despite banning the sale, growing and processing of legal marijuana, the Yakima City Council is seeking tax money from the upcoming pot industry.

The Yakima Herald-Republic reports the city council voted unanimously Friday to seek state tax revenue raised by businesses in cities that do allow legalized marijuana. Yakima joined a letter by the Association of Washington Cities asking the state to share recreational marijuana taxes with cities.

City staff and police argued that legalized marijuana from other parts of the state will strain public resources in the city.

Councilman Dave Ettl says the city’s position is not hypocritical.

Alison Holcomb, who led the initiative that legalized marijuana, says cities like Yakima contribute to public-safety problems by banning marijuana and pushing it into illegal activity.

OLYMPIA, Wash. — In what tribal leaders call a historic development, Gov. Jay Inslee on Friday signed a proclamation that returns almost all civil and criminal authority over tribal members on the reservation back to the Yakama Nation.

Tribal Council Chairman Harry Smiskin said the signing is not only “historic” but the first of its kind in the country.

“The biggest benefit is that we have the right to determine our own destiny and our own laws,” Smiskin said earlier this week.

But the deal is not done yet. The proclamation needs federal approval, which Smiskin said will probably take another year or so working with the government on final details, including financial support for both law enforcement and civil authority over social issues like school truancy and child and family services.

The Yakama Nation is a sovereign nation that has the authority to govern itself under the treaty signed in 1855 with the federal government. The Nation already has its own police department and jail and has always had some criminal authority over tribal members.

In 1953, under Public Law 280, Congress gave states the authority to take more civil and criminal control over Indian lands. In 1963, Washington’s state government asserted jurisdiction over school attendance, domestic relations, mental illness, juvenile delinquency, adoption, public assistance, and motor vehicle operation on tribal lands.

In 2012, the Legislature created a process for tribes to apply to get that lost authority returned. The proclamation is the result of the Yakama Nation’s petition. A busload of tribal members travelled to Olympia for the ceremony.

The Yakama petition, which was filed in 2012, asked the state to retain authority over mental illness as it arises in the courts and civil commitment of sexually violent predators, but return the rest of the authority taken in 1963.

The state retains jurisdiction over criminal or civil cases that involve non-Indians, even if a tribal member is also involved.

Yakima County Commissioner Kevin Bouchey said that was the county’s main concern, and he was pleased that to see the state retained that authority.

Smiskin said he encouraged the tribe to pursue the move — known as retrocession — because he’d seen the benefits when he worked with the Colville Tribe on the issue in the 1980s.

Criminal jurisdiction was returned by the Legislature for the Colvilles and several other tribes then, but Smiskin said that he used what he learned from that process to improve the Yakamas’ move to regain authority, including civil jurisdiction.

Now that Inslee has signed the proclamation, it goes to the federal Bureau of Indian Affairs for review before it will take full effect.

In preparation, the Yakamas already signed memorandums of understanding with the cities and counties that overlap the reservation.

For example, if a tribal member is pulled over on the reservation for speeding by a sheriff’s deputy, the officer will transfer the driver over to a tribal officer, Bouchey said.

Yakima County Sheriff Ken Irwin called the retrocession a “work in progress” and said that he still doesn’t know the final details about how the BIA and the Yakama Nation are going to handle some issues, including major crimes, but he respects the process.

“They have some steps left,” Irwin said. “In the meantime, it’s business as usual and we are working together very well.”

A spokeswoman for the Department of Social and Health Services referred questions about the retrocession process to the governor’s office.

A governor’s office spokeswoman said the state doesn’t intend to start planning for the transition in jurisdiction until after the retrocession secures federal approval.

YAKIMA, Wash. — The Yakama Nation is considering an unprecedented move in its fight against legalized marijuana that could have implications for 10 Central Washington counties.

With a marijuana ban already in place on the Yakama reservation, tribal representatives now say they’ll fight the state to keep marijuana businesses from opening anywhere on ceded lands, which constitute one-fifth of the state’s land mass.

The tribe’s options include suing the state in federal court if no compromise can be reached, Yakama Nation Tribal Council Chairman Harry Smiskin said.

“We’re merely exercising what the treaty allows us to do, and that is prevent marijuana grows (and sales) on those lands,” Smiskin said.

Under the Yakama Treaty of 1855 with the federal government, the Yakama Nation was to have exclusive use of the 1.2 million-acre reservation and maintain fishing, hunting and food-gathering rights on more than 12 million acres of ceded land. The tribe has successfully taken court action against federal and state entities as well as private interests in the past to defend those rights, but most of those cases have been directly tied to the tribe’s access to natural and cultural resources.

“To my knowledge, this would be the first time” the tribe has sought to prevent the implementation of a state law on all ceded land, said George Colby, an attorney for the Yakama Nation.

“The tribe’s stance is if you don’t fight, you don’t get to win,” Colby said.

The tribe expects to file more than 600 objections with the state and federal governments against license applicants located in the 12 million-acre area that includes land in 10 Central Washington counties, Colby said. About 300 of those complaints have already been filed, he added.

The ceded area spans from the Columbia River on the Oregon border to all of Chelan County in the north and from the eastern slopes of the Cascades across the Columbia River to as far west as parts of Whitman County. The area encompasses the cities of the Upper and Lower Yakima Valleys, Wenatchee, Ellensburg, Goldendale and Pasco, although not Richland or Kennewick.

Colby and Smiskin draw comparisons to the tribe’s long fight to keep alcohol off the reservation. They say the tribe has had an equally unpleasant history with marijuana use, and that the plant, which was effectively banned by the federal government through a series of campaigns and legislation in the 1930s, never played a traditional role in Yakama culture.

“Aside from the taxation of marijuana, I don’t see any benefits from it,” Smiskin said.

Moves by the tribal government a decade ago to enforce a 150-year-old alcohol ban on the reservation have been complicated by the fact that most of the property in the cities of Toppenish and Wapato are deeded land owned by nontribal members, including proprietors of bars and stores.

In that case, a 2001 opinion issued by U.S. Attorney Jim Shively in Spokane said that the Yakamas’ ban would probably not be enforceable in cities on the reservation.

In addition to the ban on marijuana businesses, it also remains illegal to possess marijuana for personal use on the Yakama reservation. Colby said the fact that marijuana remains illegal under federal law also entitles them to challenge it on ceded lands.

But the author of the 2012 voter-approved initiative that legalized marijuana, Alison Holcomb, said she doesn’t see a legal basis for the tribe’s opposition to marijuana businesses on ceded lands.

“I think they run into the issue of not having standing to, in essence, bring suit on behalf of the federal government,” said Holcomb, the criminal justice director of the American Civil Liberties Union Washington chapter. “The federal government at this time has shown it has no intention of trying to stop the law.”

In August, the U.S. Justice Department sent a memo to Washington and Colorado saying it would not stop the implementation of laws legalizing the recreational use of marijuana. The federal government’s use of prosecutorial discretion could be rescinded if the states fail to implement a robust system of enforcement to prevent interstate trafficking and access to minors, according to the memo.

In October the state Liquor Control Board established a rule that it would not issue a license to any business located on federal lands, such as a tribal reservation, a federal park or military installation. The rule does not address ceded lands, and on Friday a spokesman said the agency wasn’t ready to comment on that issue.

“The reality is we haven’t seen a lawsuit,” Liquor Control Board spokesman Mikhail Carpenter said. “Until we do, it would be premature for us to comment.”

A spokeswoman for the state Attorney General’s Office was also unable to comment on the issue Friday.

In the coming weeks, the Attorney General’s Office will issue an opinion on whether cities and counties have a right to ban marijuana growing, processing and retail businesses from their jurisdictions. Because the opinion is a response to a Liquor Control Board inquiry specifically related to counties and municipalities, it is not expected to address tribal rights issues.

“Within the reserved area, it’s not even a contest as to whether marijuana is illegal,” Colby said. “Next is the ceded area.”

Holcomb said she supports the tribe’s right to ban marijuana businesses on the reservation. However, she said it’s unfortunate tribal leaders don’t recognize the disproportionate effects national marijuana prohibition has had on minorities in terms of criminal convictions.

Illegal marijuana grows by cartels on reservation lands and federal forest lands are also the result of prohibition, she said.

“U.S. marijuana prohibition is directly responsible for the fact that there are multinational criminal organizations setting up marijuana grows on reservation lands and ceded lands,” Holcomb said. “They pose a danger to members exercising their hunting, gathering and fishing rights in those lands.”

Smiskin said the tribe will continue to put license applicants, the state and federal governments on notice that marijuana businesses aren’t welcome on the ceded lands. He said no entities have approached the Yakama Nation to discuss their stance and potential legal challenge.

“If we can’t come to an agreement, then there is always that potential it’s going to get litigated,” Smiskin said.

Yakama Nation demands clean up of Columbia River following release of fish consumption advisories

TOPPENISH, Wash.—Yakama Nation Chairman Harry Smiskin today said state and federal governments must act to clean up polluted sections of the Columbia River that are contaminating fish. The call for action followed the release of fish consumption advisories by the Oregon Health Authority and Washington Department of Health.

“The fish advisories confirm what the Yakama Nation has known for decades,” he said. “State and federal governments can no longer ignore the inadequacy of their regulatory efforts and the failure to clean up the Columbia River.”

In the Treaty of 1855, the Yakama Nation retained fishing rights throughout the river. The Yakama Nation repeatedly identified contaminated sites along the Columbia, expressing concerns for the health and culture of the Yakama people and calling upon the state and federal agencies for cleanup actions that would protect the tribe’s resources.

“The new advisories once again pass the burden of responsibility from industry and government to Tribes and people in the region,” Chairman Smiskin said. “Rather then addressing the contamination, we are being told to reduce our reliance on the Columbia River’s fish,” “This is unacceptable. The focus should not be ‘Do not eat’—it should be ‘Clean up’ the Columbia River.”

AUGUST 26, 2013 – Toppenish, WA – The Confederated Tribes and Bands of the Yakama Nation have reached an unprecedented, out-of-court settlement with the United States Department of Justice (DOJ), principally the Federal Bureau of Investigation (FBI).

The settlement fully and finally resolves Yakama’s lawsuit against the FBI and several of its sister law enforcement agencies, as well as various county and municipal police agencies from Washington State, Mississippi and Virginia. That suit arose from a federal task force raid of Yakama Reservation trust lands that commenced at dawn on February 16, 2011. Upon word of the settlement on August 15, 2013, U.S. District Court Judge Rosanna Peterson closed the case.

“Today is historic. The United States has agreed to honor the law enforcement protocols set forth in the Yakama Treaty of 1855. That is unprecedented.” said Yakama Nation Tribal Council Chairman and former police chief Harry Smiskin. “From today forward the FBI will communicate with Tribal Police before they enter Yakama Indian Country. I am confident that the resulting cooperation between federal and tribal cops will greatly improve public safety throughout our territories.”

Through Article II of the Yakama Treaty of 1855, the Yakama Reservation was set apart for the exclusive use and benefit of the Yakama Nation. To that end, the Yakama Treaty makes clear that no “white man” shall be permitted to reside upon Yakama Indian Country without permission from the Yakama Nation. Federal Treaty negotiators explained to the Yakama that Article II meant that no one – not even United States agents, with the lone exception of today’s Bureau of Indian Affairs agents – would be permitted to step onto Yakama Reservation lands without the Yakamas’ consent.

Also, in Article VIII of the Yakama Treaty, the United States and Yakama Nation set forth a process for delivering Yakama criminals or suspects who are in Yakama Indian Country to federal authorities. Federal Treaty negotiators explained to the Yakama that Article VIII meant there would be a consultation process between the Head Chief or all of the Yakama Chiefs, and the United States, relative to any Yakama alleged to have committed a wrong, before they might be delivered up to federal authorities.

The settlement agreement between Yakama and DOJ is called, “Recitals of Joint Law Enforcement Goals.” It recites that:

• “The Parties have a common interest in preventing violence, fighting crime in, and ensuring the safety and security of Yakama Indian Country…”

• “The United States embraces the federal government’s special trust responsibility to and relationship with the Yakama Nation, consistent with the Treaty of 1855, federal law, Executive Orders, and judicial decisions.”

• “The United States acknowledges that the Yakama Nation has no interest in promoting, condoning, or protecting criminal activities by its members; as such, the Yakama Nation will not intentionally harbor fugitives and desires to partner with the United States in law enforcement matters.”

• “The United States recognizes that maintaining a close and cooperative relationship with the Yakama Nation is essential to preventing and combating crime and assisting crime victims.”

• “The United States recognizes that in an age of increasingly complex criminal and national security threats, the common interests of the Yakama Nation and the federal government are best served by appropriate coordination, communication and information-sharing between the Parties.”

• “The Parties agree that it is in the best interests of both governments to identify practical ways to coordinate and communicate effectively with respect to law enforcement matters.”

• “Both Parties commit to acting in good faith to advance and act consistently with these goals.”

The operative provision of agreement provides:

In keeping with its law enforcement duties, DOJ law enforcement remains committed to communicating with Yakama Tribal Police concerning its law enforcement activities in Yakama Indian Country, as operational integrity concerns, including officer and public safety, permit, and will communicate with tribal police at the earliest prudent and practicable opportunity about enforcement operations undertaken in Yakama Indian Country (emphasis added).

In March 2011, the Yakama Nation sued federal law enforcement agencies and several local governments for violating these federal Treaty provisions when raiding a Yakama member-owned business on Yakama trust lands without providing any advance notice to Yakama authorities, and in turn barring Yakama Nation cops who arrived at the scene of the raid to help keep the peace.

Since the summer of 2012, the parties engaged in settlement discussions and negotiations. In June 2013, Yakama reached out-of court settlements with Yakima County, Benton County, and the local governments from Virginia and Mississippi (Yakima Herald Republic).

Yakama Nation celebrate sockeye return to Cle Elum Lake for the first time in 100 years

Yakama Nation biologists have released thousands of sockeye salmon into a Central Washington lake over the past four summers. The work, according to The Associated Press, is to restore fish runs that were decimated with the damming of area rivers and streams. Each fall, the just-released fish swam up the Cle Elum River to spawn and die. Their babies, meanwhile, spent a year in the lake before swimming to the ocean to grow into adulthood. Now, four years after the first release in 2009, those adult fish are returning to their birthplace to spawn, and tribal members are celebrating what they hope is the resurrection of a revered species to its native habitat. “You are part of a sacred ceremony to celebrate the return of an important ingredient to our body, our hearts, our life,” Yakama elder Russell Jim told the crowd gathered on the shore of Cle Elum Lake.

Yakamas urge feds to consider horse slaughter

YAKIMA — A Northwest Indian tribe urged federal officials to explain their position against slaughtering horses in the United States, calling it “absurd” to prohibit the practice.

The question of equine slaughter has been a hot-button issue in the West, where horses hold an iconic role as loyal companions. Animal welfare groups have expressed outrage at the idea of resuming domestic slaughter, which Congress effectively banned in 2006 by cutting funding for federal inspection programs. Others, including some animal welfare groups, contend the ban has resulted in increased horse abuse and abandonment and booming wild horse populations on state, federal and tribal lands.

No group is perhaps more affected by the matter than the Yakama Nation, a Washington tribe with an estimated 12,000 wild horses roaming across its sprawling reservation in the arid, south-central part of the state, Yakama Nation Chairman Harry Smiskin said in a March 29 letter to President Barack Obama and Agriculture Secretary Tom Vilsack.

“We don’t understand why it is OK to slaughter many animals in this country — certainly the White House and the USDA have meat on their cafeteria menus every day — but for some reason horses are considered sacrosanct,” Smiskin wrote. “We should not manage these horses based on purely emotional arguments, story books or movies we all saw as children.”

Smiskin argued the market for horse meat in other parts of the world, as well as the United States before World War II, could create jobs, humanely reduce overpopulated herds and feeds others, adding “it is absurd to prohibit it.”

Smiskin declined to talk about the letter in a telephone interview Monday.

Congress lifted the slaughter ban in a spending bill the president signed into law in November. Now the USDA is preparing to inspect a southern New Mexico meat company that has been fighting for more than a year for approval to convert its former cattle slaughter operation into a horse slaughterhouse.

Valley Meat Co. sued the USDA last year to resume the inspections, and the agency said last month it had no choice legally but to move forward with the application, as well as several others. However, the Obama administration threw a new twist into the more than yearlong debate with a statement urging Congress to reinstate the ban.

Several Northwest tribes have joined together in support of opening a horse slaughterhouse in the region to address booming wild horse populations on their reservations. The Yakama and Colville tribes in Washington, the Umatilla and Warm Springs tribes in Oregon, and Shoshone Bannock in Idaho say the horses destroy medicinal plants and damage habitat for other species.

Northwest Tribes Maximize Steelhead Populations

Steelhead in the Columbia River Basin are threatened. Current populations have dwindled to a fraction of the historic numbers a century ago. That has led two Northwest Indian Tribes to try something new to help this struggling fish survive.  Both tribes are learning from each other along the way.

The snow is almost gone in north Idaho. But it’s still cold, almost freezing on this early morning at the Dworshak National Fish Hatchery near Orofino.

That’s Andrew Pierce with the Columbia River Inter-Tribal Fish Commission or “CRITFC.” He and several dozen Nez Perce tribal members pull large fish from tanks of water. The fish are weighed and measured. Then the eggs and what’s called milt – or semen – are removed. This is all part of an artificial spawning program. The eggs and milt will be combined later in plastic tubes. It’s a process that has a higher success than if the fish were to spawn naturally in the river.

Salmon and Steelhead die in the traditional artificial spawning process which involves killing the fish then surgically removing the eggs and milt.

While salmon die naturally after spawning, Steelhead don’t. They return to the ocean and back to Northwest rivers year after year. Scott Everett is a Nez Perce project manager who says his tribe decided that to maximize the natural process, they needed a method of artificial spawning that didn’t kill the fish. That’s what they are doing here.

“Instead of killing the fish, you’re filling the body cavity with air and that essentially forces the eggs out,” Everett says.

The steelhead are then placed in large tanks for a few weeks to recover. Females that spawn repeatedly are known as kelts. That’s how this program got it’s name – Kelt Reconditioning Program. Everett says the goal is to rebuild the once abundant populations of steelhead that northwest tribes have traditionally relied on along with salmon. Overfishing, water quality and hundreds of dams that make passage difficult for the fish have impacted steelhead numbers over the years.

“We’re hopefully getting enough fish alive that we can actually put them in our reconditioning project here and keep them alive for three to six month or longer and get them back out in the river,” Everett says.

Thats where the Yakama Nation tribe comes in. The central Washington tribe has been using the Kelt Reconditioning Program for 14-years.
