USET Endorses Legislation to Revoke Trademarks of Washington NFL Team’s Racist Name

The prominent inter-tribal organization is supporting a bill that was introduced in the House of Representatives this week by Congressman Mike Honda

The United South and Eastern Tribes (USET) today strongly endorsed a bill that would remove all trademark protections of the Washington NFL team as long as the franchise retains the R-word racial slur as its team name.

Congressman Mike Honda introduced the legislation, entitled The Non-Disparagement of Native American Persons or Peoples in Trademark Registration Act, this week in the U.S. House of Representative. The bill, which already has 26 co-sponsors, seeks to prevent any sports team from using a derogatory slur for Native Americans as its mascot and nickname.

“Congressman Honda has taken a bold stand against racism, discrimination and the continued denigration of Native Americans by introducing this legislation, which USET strongly supports,” said USET President Brian Patterson.  “If the NFL’s Washington’s franchise is unwilling to change the offensive mascot then steps should be taken, wherever possible, to eliminate public funding and trademark protections for a league that persists in offending and insulting Native peoples.”

The new House bill would retroactively cancel any existing federal trademarks and prohibit the U.S. Patent and Trademark Office (USPTO) from issuing new trademarks that use the term “r-dskins” in reference to Native Americans. It will also formally declare the word “r-dskins” a disparaging term when used in reference to Native Americans and therefore cannot be trademarked.

USET will hold its Welcome Reception Monday night, February 9th at 6PM.  The reception will feature Congressman Honda and USET leadership, who will reaffirm USET’s strong opposition to the continued use of the R-word and other negative imagery and stereotypes.  USET wishes to express support to Rep. Honda’s legislation that would remove the Washington football team of its name trademark protections. He will be provided podium time to make remarks.  The reception will be held in Salon four at the Marriott Crystal Gateway in Arlington, Virginia.

USET is a nationally recognized, non-profit, inter-tribal organization that collectively represents 26 member Tribes at the regional and national level. As a top organization addressing the issues facing Native Americans, USET has for years taken a leading role in demanding an end to the use of the racist R-word. Over the past two NFL seasons, USET and the national grassroots Change the Mascot campaign have garnered support from a diverse cross section of Americans including civil rights leaders, religious and human rights organizations, sports icons, political leaders from both parties and the President of the United States.

This week, USET will hold its annual Impact Week Meeting in Washington, D.C.  The four-day event including meetings with Members of Congress and various government organizations about top issues facing Indian Country, as well as a variety of cultural activities and celebrations.

Researchers help guard sunken tribe artifacts from turbines

PROVIDENCE, R.I. (AP) – University of Rhode Island researchers are working with Native Americans to ensure that energy companies hoping to erect massive wind turbines off New England don’t inadvertently disturb the tribes’ ceremonial sites and burial grounds, now submerged under hundreds of feet of water.

Providence-based Deepwater Wind is planning what could be the nation’s first offshore wind farm, located off the coast of Block Island. But federal regulators and Native Americans worry that wind turbines could inadvertently be parked on top of the sunken lands where Native Americans lived thousands of years ago.

Narragansett Indian Tribe oral history holds that they lived on land that is now off Rhode Island’s shore more than 15,000 years ago until their villages were inundated by water and they had to evacuate. Sea level was about 400 feet lower globally during the last Ice Age and what is now covered by water was once dry land.

With the help of the tribe, researchers are trying to figure out the best way of searching the ocean floor to identify ancient archaeological sites so they aren’t disturbed.

If one was ruined, “It would not only be a loss to the Narragansetts, it would be a loss to the world,” said John Brown, the tribe’s historic preservation officer.

When offshore wind developers began focusing on southern New England, Native Americans said they were concerned about their sacred sites. And federal regulators realized they didn’t know how to find the sites to avoid affecting them, said Brian Jordan, the federal preservation officer at the Bureau of Ocean Energy Management.

“That was a pretty big awakening for our bureau,” Jordan said.

The oceans bureau gave URI $2 million for a four-year study in 2012, with the hope that the bureau could use the study’s recommendations for identifying potential sites to update its guidelines nationally, Jordan said. Energy companies must do site surveys now as part of the permitting process, and federal agencies require them to avoid harming historical and archaeological sites at sea, when possible.

The project’s principal investigator, URI professor John King, and his team collected samples of submerged sediments in Greenwich Bay in Warwick with a machine that vibrates through the top layers of sand and mud. They analyze the sediment for signs of human activity, such as seeds from plants grown by people or flakes from arrowhead-making, to decipher what the landscape looked like thousands of years ago.

The five-turbine Block Island proposal is one of several offshore wind farm projects in the works along the Eastern seaboard. Construction is slated to begin later this year so the wind farm can begin operating in 2016.

Deepwater Wind has also been granted a lease to build a wind farm of at least 200 turbines between Block Island and Martha’s Vineyard. Cape Wind is planning for a 130-turbine wind farm off the coast of Cape Cod, though the future of that project is in doubt. The federal government has said areas off New Jersey, Virginia and Maine are suitable for offshore wind development, too.

“This study is forward-thinking,” Jordan said. “A lot of projects are still in the planning phase, and hopefully it will inform a lot of those.”

Deepwater Wind hired marine archaeologists to scan the area around the Block Island wind farm using sonar and other instruments, said CEO Jeffrey Grybowski. They did not find any cultural artifacts, but the company is moving its transmission cable slightly on land because what appeared to be stone tools were in its path.

“The offshore wind industry would very much like to see some standardization in the process over time and best practices,” Grybowski said. “To the extent that our survey techniques can improve, I think the industry would embrace that.”

King said the method he’s testing could be used to further investigate anything that appears interesting during the ocean surveys. He said it’s important to develop a technique that is less destructive than conventional archaeological digging out of respect for tribal cultures.

The Narragansett Indians helped Deepwater Wind, and they’re sharing their oral history and local knowledge with the URI team. Doug Harris, the deputy tribal historic preservation officer, said the tribe’s ancestors had a close relationship with life.

“There was always a respectful, reciprocal relationship,” he said. “If we humans are going into their territory, we should tread softly and cautiously and respectfully. We’re trying to bring that dimension to this process.”

Police probe opened in Rush racism incident

Police opened an investigation Tuesday into a Saturday night incident in which a group of Native American students was reportedly subjected to beer baths and racial slurs while attending a Rapid City Rush hockey game.

Rapid City Police Lt. Mark Eisenbraun said his department had just opened an investigation into the matter Tuesday afternoon.

“It was just reported to me that we have had parents of the kids call in and give us information that will allow us to investigate this incident further,” Eisenbraun said. “So we have opened an investigation, and we thank the public for reporting criminal activity when they see it.”

Also Tuesday, a witness stepped forward with more information about the incident.

Andy Hollander, of Sturgis, a season ticket holder and longtime former supervisor of officials for USA Hockey, said he was 10 to 15 seats away from the American Horse School group from Allen, which had a total of 65 tickets for students and their chaperones. Hollander said the student group was one of the best-behaved he has seen in his years of attending games.

Hollander said he was too far away to hear what happened, but he saw two men in the skybox above the students “who seemed to be taking real pleasure in continuing the confrontation” with an adult member of the school group.

The group left before the game ended, leaving three empty rows. Hollander said the men in the skybox “seemed to gloat over what they had accomplished in chasing the student group from the game” and handed out a number of beers to other fans in what Hollander said appeared to be a “celebration.” He said several other people in the skybox “seemed extremely uncomfortable with what was going on.”

The group left before the end of the third period of a game that went into overtime and a shootout, with the Rush eventually losing to the Wichita Thunder 4-3.

“It was a very exciting finish, and they missed it,” Hollander said.

He hopes the men in the skybox will apologize publicly to the kids and be barred from attending future events at the Rushmore Plaza Civic Center, and he hopes the students will be brought back for another game and given a few perks.

Meanwhile, the Rushmore Plaza Civic Center’s director and the president of Eagle Sales said Tuesday they were devastated by the episode.

“Having been in the industry for 25 years, I’ve never seen anything like this before,” said Craig Baltzer, executive director of the civic center. “I am amazed by what kind of idiots there are in the world.”

Eagle Sales of the Black Hills President Tom Helland called the incident “incredibly horrible.” Helland, a beer distributor, rents the arena suite from which one person, and possibly as many as three others, slung beer and racial epithets at the group of fourth- through eighth-graders from the school’s 21st Century Club, who were seated below.

“I feel terrible about it,” Helland said. “Unfortunately, we can’t change what happened. From what I gathered, it was one individual who did most of the inappropriate behavior. I don’t condone it and, if it was one of my employees, they’d no longer be employed.”

Helland, who was not at the Rush game, said one of his employees was in attendance, but neither that employee nor most of the other 20 people in the suite were aware of the incident. He said he had not yet been able to identify the offending individuals.

“We are cooperating with authorities, and we are working to get to the bottom of it,” Helland said. “I apologized to those children, those students who worked so hard to get to go to the game. And, it’s been devastating to me personally. I’m not used to getting beat up in social media. I even feel bad for the team, which had nothing to do with it whatsoever.”

Eisenbraun said it was too early to know what tack the probe would take. Earlier Tuesday, the police spokesman noted that Chief Karl Jegeris had been in conversations with civic center staff about the incident.

The episode comes just weeks before Rapid City voters go to the polls March 10 to decide the fate of the proposed $180 million expansion of the civic center. At a Tuesday morning coffee klatch at which the planned expansion was discussed, Payu Harris told attendees the incident made supporting the proposal problematic.

“I’m hearing words like ‘boycott,’” Harris said. “How do I go back (to other Native Americans) with that positive message” that they should vote for the civic center expansion?

Baltzer said the incident would undoubtedly lead to enhanced security at the civic center as well as additional training for staff.

Asked if the entire incident could be attributed to over-consumption of alcohol, Baltzer said he had no way of knowing if drinking contributed to such behavior.

“It’s hard to catch everything when there are 5,000 people in attendance,” he said, sighing. “I think it is possible they were mental midgets with the added courage of drinking, but I don’t know. I did get a report they were drinking beer, but I don’t know their stage of drunkenness.

“We do refuse admittance to people who are clearly too intoxicated. We do cut people off just like a bar, or we eject them, or there can be further action,” Baltzer added.

Calls seeking comment from American Horse School Principal Jodi Richards, one of the student chaperones at Saturday night’s game, were not immediately returned Tuesday.

Mainstream entities test the waters of ACA in Indian Country

OKLAHOMA CITY – Despite living in a state where Medicaid was not expanded, Oklahoma’s 38 federally recognized tribes have found a way to state tribal liaison, Sally Carter – and she has found her way to them. In this newly created position, Carter is quick to tell you that she considers Oklahoma to have 39 tribes because even though the Euchee are not federally recognized, they are state recognized. Breathlessly, she says she is learning fast.

“I still count them,” she said.

Carter carries Euchee concerns on health matters back to the state capital as part of a new stance where the health decision makers seek to repair a long and tenuous relationship between historical archetypes. When the Affordable Care Act (ACA) was passed in 2010, a series of listening sessions between Oklahoma and the tribes occurred at six different tribal jurisdictions across the state to talk about the federal health overhaul.  Replete with opening ceremonies and songs, the state was figuratively stretching its hand toward its Native inhabitants.

From these beginnings, Carter takes the message back to the capital that the tribes want to be at the decision-making table with state leaders, including the newly re-elected Republican governor, Mary Fallin.

Carter said the tribes don’t just want to be told about important developments, they want to help shape the direction the state will take on things such as the implementation of the ACA and how to reduce health disparities like high smoking and diabetes rates in their nations.

To date, 1,638 American Indians in Oklahoma have enrolled for federal health insurance through ACA while 13,061 have enrolled nationally, according to a U.S. Department of Health and Human Services (HHS) report. When compared to the 9.1 million estimated Obamacare enrollees, American Indians number roughly 1 percent of all Americans who now have health insurance who had none before.

But that thing that makes Oklahoma’s Indian Country so different—that thing that separates it from other U.S. states with tribes – is that it has no official Indian reservations. A federal land allotment experiment from the 1900s crisscrossed the state’s territory into a veritable smorgasbord of jurisdictions – federal, tribal, municipal, state.

Carter is working on how to stimulate enrollment among Oklahoma tribes.

If the government wants to reach the American Indians here, it’s best to go to each tribe, Carter said. That was a go-to move state health officials embraced as they discussed ACA with the tribes. The things Carter found surprised her although she is an Oklahoma resident and had lived near various tribal jurisdictions for years.

“They are the only (minority) group that has to show their race,” she said, her voice lilting. “I mean, no other group has to do that. They have to prove it with an enrollment card of some kind.”

Official American Indian citizenship is important because the ACA has special provisions that allow Indians to “opt out” of having to enroll in federal health insurance, if they choose. But Indians need to fill out form OMB No. 0938-1190 that officially removes them, officials said. Not doing so will mean an eventual penalty.

“(ACA) is very complex and not one of us would say that we know it all,” Carter said. So the state took the best of what they knew after weeks of training on the health plan to several tribal jurisdictions. When all sides met, Carter said she was schooled. American Indians have strong opinions about the state/ federal government encroaching on their personal privacy and tribal sovereignty with this new federal health insurance.

Because Oklahoma chose not to expand Medicaid, enrolling American Indians in ACA takes a certain degree of cultural finesse and dogged persistence, Carter said. In other tribally populated states, like North Dakota, the move to expand Medicaid fills in where ACA may not be a strong priority, said Sen. Heidi Heitkamp, D-ND. The emphasis is reducing uninsured numbers, she said.

“The State of North Dakota expanded Medicaid, which has helped uninsured, low-income individuals and families, including many Native Americans throughout the state, get access to affordable health care,” Heitkamp said. “ Medicaid expansion is giving families opportunities they didn’t have before to afford to see a doctor regularly and get access to needed medications, while reducing costs for everyone – those with health coverage and those without.”

The Oklahoma tribal liaison added that even while enrollment curiosity abounded, many did not qualify for ACA because they did not file income tax returns. American Indians can enroll in ACA at any time – not just during enrollment periods, but their tax filings allow them also to file the exemption – if they chose to forgo coverage.

American Indians have a higher unemployment rate than other groups–peaking in 2013, according to the Bureau of Labor Statistics Current Population survey. Indian unemployment rates averaged 11.3 percent compared to 9.1 percent of the mainstream during that time. High unemployment rates among Indians tend to keep more Indians ineligible for ACA enrollment, Carter said.

What has also dampened Oklahoma’s outreach has been a distrustful relationship between the state and tribes—this makes it harder for federal initiatives to come through the front door, said Terry Cline, Oklahoma’s commissioner of health. He points to the good faith of the tribal/state meetings.

“I considered the listening sessions a good start,” he said. An official summary on the sessions reported 193 attendees at the six sessions, several of which Cline attended.

“We held those sessions to have open dialogue,” he said. “What you hear from one tribe might be different from another tribe says.”

As for ACA and tribes,  a tribe’s type of relationship with the federal government, either Self-Governance or direct service, dictated outreach approaches because that’s how health dollars are administered by tribes in states, especially in Oklahoma, officials said.

Tribes that operate under provisions of the Indian Self Determination Act might outreach on ACA directly to members in their own tribally run health systems and tribes that are direct service entities may forgo outreach to their local Indian Health Service (IHS) service facility. In both regions, IHS and tribal facilities can accept ACA insurance from patients and lessen the amount of contract (out-of-IHS system) health dollars it spends, officials said.

“Tribes have a lot of interest in ACA,” Carter said. “Tribal leaders and the health department can inspire and direct tribal members to enroll.”

Both of the tribal-to-federal relationships are considered when the state of Oklahoma contacts tribes, and the state tends to follow the federal approach, Carter said. Putting on different hats to deal with different tribes is prudent.

“Tribes need to see people they know and that they can trust who know about American Indian provisions,” she said. “I believe in face-to-face interactions.  States usually contact them (tribes) with emails or letters, but a relationship needs to be worked on and allowed to develop.”

Cline said no special state appropriations exist to outreach to tribes for ACA enrollment in Oklahoma but he’s optimistic that other types of federal grants to reduce health disparities will help. The health commissioner said he knows Oklahoma has room for ACA Native growth through grants.

The HHS report points out that Oklahoma has the highest density of Indians among Federally Facilitated Marketplace (FFM) states with 3.5 percent of the population followed by Wyoming, with 3.1 percent. Wyoming’s total Native ACA enrollment stands at 309, the report shows.

At this point, Oklahoma seems to lead the state in the number of Natives it has enrolled, just exceeding figures for California. But as enrollment rolls on, officials expect more American Indians to register.  Indian Country (the term used to characterize where a federal-tribal relationship exists) extends beyond Oklahoma.

Other states with significant Native populations include Arizona, California, New Mexico, South Dakota and North Dakota. ACA data gathering for Native numbers is in its infancy, organizers said. They say the goal is to pool their information from various regions (via Indian advocacy agencies) to get a more precise picture of Native ACA enrollment. Due to their smaller population numbers, American Indian statistics are often overlooked, officials said.

Other mainstream entities who track the progress are unclear about just how many have actually signed up for ACA. Michelle McEvoy, vice-president of survey, research and evaluation for the Commonwealth Fund, said that no Native specific information has been garnered by her group.

“Latinos currently represent about 17 percent of the U.S. population, so they have a greater probability of being sampled than American Indians who represent about 1.2 percent of the U.S. population,” she said.

Likewise, the non-profit Enroll America, relies on Native ACA enrollment numbers from federal sources, wrote Jessica McCarron, deputy press secretary, by e-mail.

“We do work with partners at the local level to reach different communities, like Native American groups in certain parts of the country,” McCarron stated. “We work with a few partners who have made outreach to tribal communities a high priority.”

Meanwhile, Carter is optimistic about ACA enrollment and reaching American Indians in Oklahoma.

“(ACA) is bigger than all of us,” she said. “We can’t do this alone; it only happens when the state extends its hands across the table and says we need to do this for all the people.”

Use of the Word ‘Redskins’ By Announcers Drops; Pundit Predicts Sale of Team in 2015

The dictionary-defined pejorative ‘Redskins’ was mentioned 27-percent less during NFL broadcasts this season, according to reports.

Timothy Burke of Deadspinreportedthat announcers said the word 472 fewer times in the 2014-15 regular season.

Meanwhile, use of the word ‘Washington’ to identify the team slightly increased during broadcasts. In 2014, ‘Washington’ was mentioned 1,390 times. In 2013, it was mentioned 1,380.

The team itself has been mired in controversy over its use and defense of its name. In June, the U.S. Patent and Trademark Office stripped the team of six of its seven trademarks, finding the word to be “disparaging to Native Americans.”

Since then, a growing chorus of dignitaries, celebrities and former players have called on team owner Dan Snyder to change the name. Former Secretary of State and possible 2016 presidential hopeful Hillary Clinton called the team name “insensitive”, and even President Barack Obama said if he were the owner of the team he would consider changing the name.

Snyder said he will “NEVER” change the name.

On Dec. 28, The Washington PostAssociate Editor Bob Woodward predicted on FOX News Sunday that Snyder will sell the team this year to either Apple or Google.

“Danny Snyder, the owner of the Redskins, who’s had past success in business, will realize he’s part of the problem,” he said, “and he’s going to sell it; he’s going to sell the Redskins and the bidding war is going to be between Apple and Google. Think of it — the ‘Washington Apples’?”

Too Many Scholarships, Not Enough Native Students Applying

In talking to my friend Al Paulson recently, it turned out we have a common problem. We can’t give away scholarships. What a shame.

In the modern age of computers, scholarships are everywhere, it seems. FastWeb, the most popular scholarship site, has over 1.5 million entries in its database. Other websites such as Scholarships.comhave similar numbers. But it’s hard to give them away, let me tell you. I have been doing it for 42 years, and we never have enough applicants.

Al Paulsen who lives in St. Paul, Minnesota founded Marketplace Productions 20 years ago. After he had some success in business, he and other members of the Minnesota American Indian Chamber of Commerce decided to launch an Indian scholarship program. But for almost a decade now, he has had trouble getting Native American studentsto apply for it.

Paulsen has worked with casinos and business development on Indian reservations for over 30 years now. His mother was a LaDuke from White Earth before she married his father Albin Paulsen. So Al is a first cousin of the famous Indian activist Winona LaDuke. He says his mother got hooked on his father because he was a member of a band that played in the local area.

They lived north of White Earth and farmed for a few years, and then moved to the Twin Cities. Albin got a job in the Ford plant and worked there until he retired. Al got a job at Ford after he finished high school, but the hard work convinced him he needed to go to college. He became one of the early White Earth citizens to finish college.

He picked St. Cloud State University(SCSU) because they had a great hockey team and he wanted to play. The Minnesota Chippewa Tribe (MCT) gave him a scholarship; without it, he says, he would not have been able to go to college. “Without that grant,” he told me, “I don’t know if I could have afforded to complete my college degree.” He finished in 1966, and is now in the SCSU Hall of Fame as a hockey player.

He was the first LaDuke to finish college, and Winona was the second. “By the end of my sophomore year,” he said, “I realized that educationwas a great equalizer, so I got serious about college and graduated in four and a half years.” He made the varsity hockey team as a freshman, and is still the only Indian ever to play hockeyfor St. Cloud State.

He paid for his first year himself, from work at Ford and from a rice business he had set up. But the scholarship from MCT paid his tuition for the rest of his college.

Al is also an enthusiastic volunteer, and has been for 20 years. “I am an instructor at Indian schools for Junior Achievement as my way of paying back for what the tribe did for me in paying for my tuition and books and assisting me in getting my college degree,” he told me. “I am also on the Diversity Council for MNSCU, the Minnesota State College and University board, overseeing 42 state colleges and tech colleges in Minnesota.”

“We talk a lot about retention rates and graduation rates, comparing all ethnic minorities with all the others and the caucasian student rates. There is a big difference in rates, with white students and Asian students having the best rates…and us Indians having the lowest rates. From our state, it appears the rates for Indian students are improving.”

The Indian Chamber, which he chaired for awhile, set up a scholarship fund several years ago to give two scholarships of copy,500 each to two students. They wanted to give them to students with business majors, but got so few applicants that they opened it to students with any major. And they still get only a handful of applicants.

I told him about some of my experiences trying to get Indian students to apply for scholarships. I was in Holbrook, Arizona 10 years ago to try to recruit Indian students for our scholarship.

We encourage students to apply not only for ours, but for every scholarship they can find. These days, that is 40 or more. We had a student from Laguna Pueblo four years ago, Isaiah Rodriguez, who found 102 scholarships—which is still our highest total. We have been going since 1986. The national record is still 200, which a black girl from Macon, Georgia accomplished in 1991. Her name is Marianne (Angel) Ragins, and she is now “Miss Scholarship.” She has written three books about how to win scholarships. Our reservation school libraries do not have these books.

As I talked to the students at Holbrook, I told them they should find all the local scholarships as well, such as Lions, Elks, Rotary, Moose, and so on. The counselor at Holbrook High School, Dean McNamee, whose daughter is one of our grads, piped up and said, “Yes, the Elks had four scholarships last year, and no one applied for them.”

That makes me sad. I hate to see any scholarship not be awarded. I know there is a student somewhere, maybe an Indian student, who could use that scholarship.

For four straight years, I visited one high school on the Navajoreservation to recruit students. But one day my assistant asked me why I was going there. “How many applicants have we gotten from there?” she asked.

I had to admit, “None.” She said, “Why are you going there every year?” I haven’t been back. But old hard headed here will probably go back this year. We have to talk to 100 students to get two to apply.

I know the high schools are not preparing Indian students for college. In a research project I did 15 years ago, fewer than 10 percent of Indian students had taken the courses in high school they needed to be ready for college.

Fewer than 10 percent had taken four years of English. Fewer than 10 percent had taken four years of science. Fewer than 10 percent had taken four years of math, including Algebra I, Algebra II, Geometry, and Trigonometry. Fewer than 5 percent had taken Calculus. If they go to college, they are going to have to take remedial classes, which is a real let down to the Indian valedictorian who was the BMOC (Big Man on Campus) in high school. Some of them never get over the humiliation. Is it any wonder that our dropout ratefor Indian college students is over 80 percent?

High school preparation for college is an excellent research project for a graduate student, by the way. I just finished reviewing dozens of articles and books for my next book, and there is very little research on the high school preparation of Indian students for college. The little that is there is surprising, sometimes. For instance, traditionalism has little to do with college success, according to one article. Another article reports that high GPA students drop out about as often as low GPA students, which is frustrating.

In the research I did, the average number of scholarships Indian students applied for was one. That is, most Indian students did not apply for any scholarships; they rely totally on federal financial aid. Then every twentieth student applied for 10 or 20 scholarships, bringing the average up to one.

Granted the scholarship application process is a little difficult. You should know what you are going to major in, and what you are going to do after graduation. But the rewards are huge. I tell students they should win all the scholarships they can, and if they have more than they need for college, they should give their momma money. And I mean it. Few students do that, but they should. And they can start their retirement with it if they want to.

There is a national scholarship group that was formed 15 years ago. It is an association of college and private scholarship people. I went to the first or second meeting, and several people told me they wanted to get applications from Indian students. “We never get an application from an Indian student,” they told me.

God bless Al Paulsen and the other people who are trying to run scholarship programs. Don’t give up, boys and girls. We need to develop all the talent we can in Indian country.

Native American populations ‘hugely at risk’ to sex trafficking

NEW TOWN, N.D. – As the Fort Berthold Indian Reservation reels from the impacts of producing a third of North Dakota’s oil, the reservation must add human trafficking to its list of increasing hazards.

“We’re in crisis mode, all the time, trying to figure out these new ways, these new crises that are coming to us that we never thought we’d have to worry about,” said Sadie Young Bird, director of the Fort Berthold Coalition Against Violence. “No one was prepared for any of this.”

The Three Affiliated Tribes are implementing a new tribal law designed to combat human trafficking at Fort Berthold.

“I’m really hoping to send a message that we are not tolerating this on our reservation,” said Chalsey Snyder, a tribal member who helped draft the law.

Meanwhile, victim advocates and leaders of tribal nations in neighboring Minnesota and South Dakota worry about reports of American Indian women and girls being trafficked to the Bakken.

Suzanne Koepplinger, former executive director for the Minnesota Indian Women’s Resource Center, said she started to hear anecdotal stories in 2010 and 2011 about a boyfriend or friend telling women and girls, “Let’s go to North Dakota over the weekend and make some money.”

“Because of poverty and high rates of mobility with Native people, it’s not unusual for them to go up to White Earth for a party and then say, ‘Let’s just buzz over to North Dakota and see a friend of mine,’ and then she’s gang-raped over there,” Koepplinger said.

Since 2010, Indian girls in Minnesota have reported to service providers that family members or friends have tried to talk them into going to North Dakota.

“Their girls go missing and then show up in the North Dakota child protection system, or are picked up by law enforcement in Williston, Minot,” Koepplinger said.

Erma Vizenor, chairman of the White Earth reservation in western Minnesota, said sex trafficking of women and girls has been a concern there for a long time, and the proximity of North Dakota’s oil boom adds to that concern.

The White Earth DOVE Program (Down On Violence Everyday) has identified 17 adult victims of sex trafficking last year, said Jodie Sunderland, community advocacy coordinator.

The DOVE program received funding through the Minnesota Safe Harbor law and is connecting Indian youth who are victims of sexual exploitation with services. The efforts will include collaborations with Red Lake and Leech Lake reservations in northwest Minnesota.

The vulnerability of Indian populations to become victims of sex trafficking, particularly at Fort Berthold with the impacts of the oil boom, is a major concern, U.S. Sen. Heidi Heitkamp, D-N.D., said.

“The grooming of the candidate for trafficking tends to go to lower income, tends to go to kids who’ve been victimized in the past, so automatically that puts them in a category that is hugely at risk,” Heitkamp said during a discussion hosted by the McCain Institute for International Leadership and moderated by Cindy McCain.

Mark Fox, recently elected chairman of the Three Affiliated Tribes, said he hears concerns about human trafficking at Fort Berthold from law enforcement and social services. He’s also noticed it himself.

“You can’t help but sometimes, walking around the casino, you see individuals who would be highly suspect,” Fox said.

Young Bird, whose program has seen a significant increase in domestic violence victims, has assisted some sex trafficking victims, although the women and girls don’t usually identify themselves as victims. Some have returned to South Dakota reservations, she said.

“We see that most of the human trafficking victims want to leave, they just want to get out, they want to go back to where they came from, they want to go back somewhere safe,” Young Bird said.

The domestic violence program, which has a new shelter in Mandaree and a new safe house elsewhere in the Bakken, primarily serves Indian women, but also will serve non-tribal members.

A meth epidemic on the reservation contributes to the violence Young Bird sees, including more severe sexual assaults.

“You can tell when there’s no meth around and you can tell when there’s a new shipment of meth around. The severity is worse when the meth is gone,” Young Bird said. “When the new shipment comes, it’s more that they head out and they leave and they leave their family with nothing. They spend all the money. Then when the wife is asking for money, that’s when the violence occurs.”

Heroin is a major problem for the reservation, too, she said. In one sex trafficking case, the pimp kept the woman compliant using heroin, Young Bird said. The woman did not want to press charges.

“They all want to leave. They don’t want to stay around. And we can’t force them. We’re the advocates; we’re not law enforcement. We’re there to support people,” she said.

A recent law change will allow the tribal court to prosecute human trafficking cases that don’t rise to the level of being charged in U.S. District Court.

“This law allows our reservation to take back ownership and take back the prosecution and penalties,” Snyder said.

The law is called Loren’s Law in memory of Loren White Horne, a behavioral health specialist from Fort Berthold who used to deal with sexual abuse and sexual assault cases on the reservation. White Horne was a driving force behind raising awareness about trafficking and working toward a new law before she died in a vehicle accident in 2013, said Snyder, who continued her work.

The law also requires defendants to pay for any expenses incurred by the victim, such as drug abuse treatment.

“These victims can seek help and they can get help without having to worry about any financial obligations,” Snyder said, if the convicted trafficker has resources or such resources were seized.

Statistics show that minorities represent a disproportionate amount of sex trafficking victims.

That has been true in South Dakota, where the U.S. Attorney’s Office has prosecuted sex trafficking cases involving several dozen victims. About half of those victims were American Indian women and girls.

In most cases, the victimization did not occur on the reservations, but in Sioux Falls and other larger cities.

“Most often, it is girls and some women who come from the reservation to Sioux Falls,” said. U.S. Attorney Brendan Johnson. “When they are here, if they’re coming without a lot of resources, they’re often targeted by these guys.”

Washington, DC:  Vice President Joe Biden joined over 300 tribal leaders at the sixth annual White House Tribal Nations Conference today. At the opening of the conference, Vice President Biden delivered an impassioned speech about violence against women in Indian Country saying “The most horrific prison on earth is the four walls of an abused woman’s home. For far too many Native American women that is a daily reality.”
 
The Vice-President, who was the original author of the Violence Against Women Act and has been its most steadfast supporter over the past 20 years, was introduced by Councilwoman Deborah Parker from the Tulalip Tribes , “Vice President Biden has led the movement to protect women against rape and domestic violence.  Last year he helped pass the much needed protection to help Native women from violence.   Mr. Vice President, you are correct when you say no means no — no more abuse.”
 
Referring to the provisions added to VAWA in 2013 that allow tribal governments to prosecute non-Indian domestic violence offenders in certain cases, the Vice-President apologized that it took so long to give tribal governments the tools to hold offenders accountable in their communities, saying “as long as there is a single place where the abuse of power is excused as a question of jurisdiction or tolerated as a family affair, no one is truly safe, and we cannot define ourselves as a society that is civilized.”
 
The Vice President delivered a call to action saying, “Tribal governments have an inherent right, as a matter of fact they have an obligation, to protect their people. All people deserve to live free of fear.”  He urged all tribal governments to be prepared on March 7 when the law goes into effect to use their authority to aggressively prosecute domestic violence offenders. He stressed the need to change the culture that too often leaves victims asking what they did wrong and instead to focus on sending a strong message that violence against women is always unacceptable.
 
Vice President Biden also acknowledged that we have much more to do to protect Native women from violence including giving Alaska tribes the same authority and expanding the provision to cover sexual assault and other crimes. Biden called on Congress to appropriate the $25 million in grants authorized in VAWA 2013 to implement the new law. 
 
Attorney General Eric Holder followed Vice President Biden, and strongly stated the Department of Justice’s commitment to improving law enforcement in Indian country, and to institutionalizing that commitment so that it will continue.  He announced that he has implemented a Statement of Principles to guide the Department’s work with tribal nations into the future.
 
Attorney General Holder also announced a new initiative to promote compliance with the Indian Child Welfare Act in partnership with the Departments of Interior and Health and Human Services.  Holder stated that the initiative is “working to actively identify state-court cases where the United States can file briefs opposing the unnecessary and illegal removal of Indian children from their families and their tribal communities.” Holder went on to explain that DOJ will work with its partners and tribes to “to promote tribes’ authority to make placement decisions affecting tribal children; to gather information about where the Indian Child Welfare Act is being systematically violated; and to take appropriate, targeted action to ensure that the next generation of great tribal leaders can grow up in homes that are not only safe and loving, but also suffused with the proud traditions of Indian cultures.”
 

The Advocate: Tracy Rector

Last summer Tracy Rector spent three and a half weeks traveling 650 miles across the Salish Sea by canoe, recording the evolving relationship between tribal peoples of the Pacific Northwest and the waters they’ve called home for thousands of years. The journey was part of her forthcoming feature documentary, Clearwater, which Rector and co-director Lou Karsen started filming three and a half years ago.

Rector herself has Seminole roots, but she’s quick to outline the complexity of her identity. “I am French, Hungarian, Scottish, Irish, Choctaw, Seminole and African American. I identify as a Mixed Race Urban Native, more specifically. And I am a single mother of two amazing young men.”

In addition to filmmaking, Rector is co-founder and executive director of Longhouse Media, a nonprofit that documents the contemporary lives of Native people in the Puget Sound area. She’s a Sundance Institute Lab Fellow, a recipient for multiple awards in media and social justice, and serves on the Seattle Arts Commission.

“For me it’s not an option to be quiet,” she says.

Rector came to filmmaking circuitously. After burning out as a domestic violence advocate 14 years ago, she returned to school at Evergreen State College to study traditional medicine in the garden of a Skokomish elder, Gerald Bruce “Subiyay” Miller. While there, local filmmaker Katie Jennings approached Miller about documenting Miller’s life. He agreed— “’but only if a Native student can intern on the film, because our people need to learn the skills to tell our own stories,’” Rector paraphrases. “The door opened for me and I’ve been making films ever since.”

In 2008 she produced the coming-of-age documentary March Point, about three teenagers from the Swinomish reservation in northwest Washington. After running into trouble with the law and landing in drug court, the teens were offered the option to make a documentary, with the help of Longhouse Media, about the impact of oil refineries on their community. (It was the only Seattle documentary to be featured that year on the national PBS series Independent Lens.) Another of Rector’s documentaries, Unreserved: The Work of Louie Gong, about the Seattle artist and activist, screened in 2010 at Cannes.

With major support from PBS, Tribeca, Sundance and Washington Filmworks, Rector and Karsen will wrap up Clearwater this year and they’re planning a multimedia, interactive installation to coincide with the film’s release in January 2016. Rector will continue to program the “Indigenous Showcase,” a film series created in partnership with Northwest Film Forum, and is creating a new initiative with SIFF called 4th World to focus on Native content and to train youth and adult indigenous filmmakers, with additional support for female and LGBTQ indigenous artists.

Yet another one of her passions is Native Lens, a program hosted by Longhouse that provides education and technology to at-risk Native youth in both rural and urban areas. “My dream,” Rector says, “is to be a transformative force for good through art and arts activism.”

Cladoosby: Tribes will revisit pot after feds’ ruling

Newly licensed marijuana business owners could find themselves with some unexpected competition.

A new federal policy on pot has opened new business options for Native Americans, and the Swinomish are ready to take a look.

The Swinomish Indian Tribal Community will consider the possibilities at a meeting the first week of January, said Swinomish Chairman Brian Cladoosby, following a policy statement recently released by the U.S. Department of Justice.

“We haven’t had an intelligent discussion on it,” said Cladoosby. “It’s definitely something we’d like to look into.”

Meanwhile, marijuana business owners recently licensed under the state Initiative 502 wonder what the impacts will be if marijuana is grown or sold on tribal land, outside of the state-managed system that created a limited number of permits for different processing and retail operations.

Skagit County’s first recreational weed retail store opened in September after the owners were chosen in a lottery that included many months of wrangling for permits and approvals.

“I would think it would negatively impact my business,” said William Keeney, owner of Dank Dynasty, a small marijuana producer and processor in Sedro-Woolley that opened less than two months ago. “I would think that’s going to be hard to compete with.”

A memorandum from the Justice Department has opened the door for Native American tribes seeking to grow and sell marijuana on tribal lands, provided they follow federal guidelines adopted by states that have legalized it.

Priorities for U.S. attorneys listed in the memorandum centered on prevention of serious marijuana-related threats such as trafficking, the funding of gangs and cartels, drugged driving and violence.

The potential for revenue, as well as public health hazards, will need to be assessed by each tribe individually, said Cladoosby, who is also president of the National Congress of American Indians and president of the Association of Washington Tribes.

Cladoosby said the potential for millions if not billions of dollars in revenue might be possible for tribes in Washington alone. Swinomish tribal leaders will review the situation at an upcoming meeting and seek legal advice, he said.

“Even though the state had legalized (marijuana), it is still illegal in tribes. Now we will re-evaluate that to see if that’s something we want to reverse course on,” Cladoosby said.

However, the potential for substance abuse could be a dissuading factor for many tribes, Cladoosby said.

“Native Americans statistically have the highest rates of drug and alcohol abuse of any sector of society,” Cladoosby said. “It’s a tough call for tribal leaders because of that problem.”

The Justice Department will deal with tribes on a case-by-case basis, said Justice spokesman Wyn Hornbuckle.

“Some tribes are very concerned with public safety implications, such as the impact on youths, and the use of tribal lands for the cultivation or transport of marijuana, while others have explored decriminalization and other approaches,” Hornbuckle said in an email.

“Each U.S. Attorney will assess the threats and circumstances in his or her district and consult closely with tribal partners and the Justice Department when significant issues or enforcement decisions arise in this area.”

However, the memorandum states it does not alter U.S. authority or jurisdiction to enforce federal law where marijuana is illegal under the Controlled Substance Act.

The state Attorney General’s Office said Wednesday that it does not consider marijuana legal on tribal lands in Washington but offered no further comment.

The original memorandum, issued by Deputy Attorney General James M. Cole on Aug. 29, 2013, allowed marijuana businesses and the state regulatory system to move forward without fear of federal reprisal, said Brian Smith, spokesman for the state Liquor Control Board.

“It was an assurance for us that we were on the right track, and it brought a sigh of relief from people in the industry, that if they started a business, the government would not swoop in and seize all their assets,” Smith said.

“We didn’t know, when we were building our system, that the federal government was not going to stop this on a dime.”

The Aug. 29 memorandum notes that “jurisdictions must provide necessary resources and willingness to enforce their laws and regulations in a manner that does not undermine federal enforcement priorities.”

If tribes do start growing and selling marijuana, the structure of the industry would determine impacts to businesses licensed under I-502.

Keeney said he would likely go out of business if tribes could sell on Washington’s marketplace at lower prices.

“If the tribes are allowed to do commerce with the state, we’ll probably have to pack it in. I don’t think we could compete with that. The market will become flooded,” Keeney said.

Nate Loving, owner of the Loving Farms retail marijuana store in Mount Vernon, said he believes in tribes’ right to grow and process on their own land, but was unsure how retail sales would be addressed.

“I think it’s a good deal if they want to grow on their own land. Why shouldn’t they be able to do it?” Loving said. “Being that (the Liquor Control Board) already allotted licenses, I don’t know if they’ll add extra stores. They have a set number of licenses.”

Smith said much is still unknown as to how tribal marijuana business would be regulated and which agency would be responsible for it, or how it would integrate with the state’s recreational marijuana system.

He said the board will first need to convene and talk with its attorneys before taking any other action.

“What the memo seems to say is the Cole Memorandum applies to tribal lands the same way it applies to the state. There’s a lot of moving parts that are involved with that,” Smith said. “I don’t think anyone has any or all of those answers yet. I think people were surprised it was as wide open as it was.”
