SACATON, ARIZ. The tamarisk tree down the dirt road from Tyler Owens’s house is the one where the teenage girl who lived across the road hanged herself. Don’t climb it, don’t touch it, admonished Owens’s grandmother when Tyler, now 18, was younger.

There are other taboo markers around the Gila River Indian reservation — eight young people committed suicide here over the course of a single year.

“We’re not really open to conversation about suicide,” Owens said. “It’s kind of like a private matter, a sensitive topic. If a suicide happens, you’re there for the family. Then after that, it’s kind of just, like, left alone.”

But the silence that has shrouded suicide in Indian country is being pierced by growing alarm at the sheer number of young Native Americans taking their own lives — more than three times the national average, and up to 10 times on some reservations.

A toxic collection of pathologies — poverty, unemployment, domestic violence, sexual assault, alcoholism and drug addiction — has seeped into the lives of young people among the nation’s 566 tribes. Reversing their crushing hopelessness, Indian experts say, is one of the biggest challenges for these communities.

“The circumstances are absolutely dire for Indian children,” said Theresa M. Pouley, the chief judge of the Tulalip Tribal Court in Washington state and a member of the Indian Law and Order Commission.

Pouley fluently recites statistics in a weary refrain: “One-quarter of Indian children live in poverty, versus 13 percent in the United States. They graduate high school at a rate 17 percent lower than the national average. Their substance-abuse rates are higher. They’re twice as likely as any other race to die before the age of 24. They have a 2.3 percent higher rate of exposure to trauma. They have two times the rate of abuse and neglect. Their experience with post-traumatic stress disorder rivals the rates of returning veterans from Afghanistan.”

In one of the broadest studies of its kind, the Justice Department recently created a national task force to examine the violence and its impact on American Indian and Alaska Native children, part of an effort to reduce the number of Native American youth in the criminal justice system. The level of suicide has startled some task force officials, who consider the epidemic another outcome of what they see as pervasive despair.

Last month, the task force held a hearing on the reservation of the Salt River Pima-Maricopa Indian Community in Scottsdale. During their visit, Associate Attorney General Tony West, the third-highest-ranking Justice Department official, and task force members drove to Sacaton, about 30 miles south of Phoenix, and met with Owens and 14 other teenagers.

“How many of you know a young person who has taken their life?” the task force’s co-chairman asked. All 15 raised their hands.

“That floored me,” West said.

 

A ‘trail of broken promises’

There is an image that Byron Dorgan, co-chairman of the task force and a former senator from North Dakota, can’t get out of his head. On the Spirit Lake Nation in North Dakota years ago, a 14-year-old girl named Avis Little Wind hanged herself after lying in bed in a fetal position for 90 days. Her death followed the suicides of her father and sister.

“She lay in bed for all that time, and nobody, not even her school, missed her,” said Dorgan, a Democrat who chaired the Senate Committee on Indian Affairs. “Eventually she got out of bed and killed herself. Avis Little Wind died of suicide because mental-health treatment wasn’t available on that reservation.”

Indian youth suicide cannot be looked at in a historical vacuum, Dorgan said. The agony on reservations is directly tied to a “trail of broken promises to American Indians,” he said, noting treaties dating back to the 19th century that guaranteed but largely didn’t deliver health care, education and housing.

When he retired after 30 years in Congress, Dorgan founded the Center for Native American Youth at the Aspen Institute to focus on problems facing young Indians, especially the high suicide rates.

“The children bear the brunt of the misery,” Dorgan said, adding that tribal leaders are working hard to overcome the challenges. “But there is no sense of urgency by our country to do anything about it.”

At the first hearing of the Justice Department task force, in Bismarck, N.D., in December, Sarah Kastelic, deputy director of the National Indian Child Welfare Association, used a phrase that comes up repeatedly in deliberations among experts: “historical trauma.”

Youth suicide was once virtually unheard of in Indian tribes. A system of child protection, sustained by tribal child-rearing practices and beliefs, flourished among Native Americans, and everyone in a community was responsible for the safeguarding of young people, Kastelic said.

“Child maltreatment was rarely a problem,” said Kastelic, a member of the native village of Ouzinkie in Alaska, “because of these traditional beliefs and a natural safety net.”

But these child-rearing practices were often lost as the federal government sought to assimilate native people and placed children — often against their parents’ wishes — in “boarding schools” that were designed to immerse Indian children in Euro-American culture.

In many cases, the schools, mostly located off reservations, were centers of widespread sexual, emotional and physical abuse. The transplantation of native children continued into the 1970s; there were 60,000 children in such schools in 1973 as the system was being wound down. They are the parents and grandparents of today’s teenagers.

Michelle Rivard-Parks, a University of North Dakota law professor who has spent 10 years working in Indian country as a prosecutor and tribal lawyer, said that the “aftermath of attempts to assimilate American and Alaska Natives remains ever present . . . and is visible in higher-than-average rates of suicide.”

The Justice Department task force is gathering data and will not offer its final recommendations to Attorney General Eric H. Holder Jr. on ways to mitigate violence and suicide until this fall. For now, West, Dorgan and other members are listening to tribal leaders and experts at hearings on reservations around the country.

“We know that the road to involvement in the juvenile justice system is often paved by experiences of victimization and trauma,” West said. “We have a lot of work to do. There are too many young people in Indian country who don’t see a future for themselves, who have lost all hope.”

The testimony West is hearing is sometimes bitter, and witnesses often come forward with great reluctance.

“It’s tough coming forward when you’re a victim,” said Deborah Parker, 43, the vice chair of the Tulalip Tribes in Washington state. “You have to relive what happened. . . . A reservation is like a small town, and you can face a backlash.”

Parker didn’t talk about her sexual abuse as a child until two years ago, when she publicly told of being repeatedly raped when she “was the size of a couch cushion.”

Indian child-welfare experts say that the staggering number of rapes and sexual assaults of Native American women have had devastating effects on mothers and their children.

“A majority of our girls have struggled with sexual and domestic violence — not once but repeatedly,” said Parker, who has started a program to help young female survivors and try to prevent suicide. “One of my girls, Sophia, was murdered on my reservation by her partner. Another one of our young girls took her life.”

Stories of violence and abuse

Owens recalls how she used to climb the tamarisk tree with her cousin to look for the nests of mourning doves and pigeons — until the suicide of the 16-year-old girl. The next year, the girl’s distraught father hanged himself in the same tree.

“He was devastated and he was drinking, and he hung himself too,” Owens said.

She and a good friend, Richard Stone, recently talked about their broken families and their own histories with violence. When Owens was younger, her uncle physically abused her until her mother got a restraining order. Stone, 17, was beaten by his alcoholic mother.

“My mother hit me with anything she could find,” Stone said. “A TV antenna, a belt, the wooden end of a shovel.”

Social workers finally removed him and his brothers and sister from their home, and he was placed in a group home and then a foster home.

Both Owens and Stone dream about leaving “the rez.” Owens hopes to get an internship in Washington and have a career as a politician; Stone wants to someday be a counselor or a psychiatrist.

Owens sometimes rides her bike out into the alfalfa and cotton fields near Sacaton, the tiny town named after the coarse grasses that once grew on the Sonoran Desert land belonging to the Akimel O’Odham and Pee Posh tribes. She and her friends sing a peaceful, healing song she learned from the elders about a bluebird who flies west at night, blessing the sun and bringing on the moon and stars.

One recent evening, as the sun dipped below the Sierra Estrella mountains, the two made their way to Owens’s backyard. They climbed onto her trampoline and began jumping in the moonlight, giggling like teenagers anywhere in America.

But later this month on the reservation, they will take on an adult task. Owens, Stone and a group of other teenagers here will begin a two-day course on suicide prevention. A hospital intervention trainer will engage them in role-playing and teach them how to spot the danger signs.

“In Indian country, youths need to have somebody there for them,” Owens said. “I wish I had been that somebody for the girl in the tamarisk tree.”

Redskins Run the Wrong Play, Again, With ‘Community Voices’ Campaign

After a series of missteps during the NFL season, the Washington Redskins’ press office is continuing its recent tradition of incompetence here in the offseason with “Community Voices,” a series of articles that quote fans who do not object to the team’s name, which is defined in most dictionaries as a racial slur.

“My grandfather was three fourths Cherokee,” reads one testimonial, provided by Penny Pitre of Round Rock, Texas. “I am not offended. I have been a Redskin fan since I was a child. Keep up the good fight, tradition and honor.”

“I have loved the Redskins for many years and do not think that a change in name is necessary,” writes Carolyn Blevins of Bristol, Virginia. “Anyway, I am part Cherokee Indian and do not find the name one bit offensive. The Redskins have a great heritage and I do not think that anything should change.”

The “Community Voices” material fits the general idea that the Redskins press office has been pushing for months — that scattered personal statements of support from people claiming to be Indians are proof that the name is not offensive.

On the other side of the ball are eminent leaders, civil rights organizations, Tribal groups, and politicians (including President Obama) who have said that the name needs to go.

In previous attempts to push back on the broad support for a name change, the Redskins press office has:

—Presented irrelevant anecdotes about high school football teams who proudly go by the name Redskins.

—Publicized a fabricated a story about the Redskins logo being designed by Pine Ridge residents.

—Published supportive comments by a “full-blooded Inuit chief” who turned out to be neither full-blooded nor a chief.

—Repeatedly cited a 2004 Annenberg poll that has been criticized as flawed.

—Issued a December press release —a precursor to “Community Voices”—that contained brief statements supportive of the name from two ostensibly representative Native fans. One of the individuas picked, it was revealed, had a history of mental health issues, and had previously been a prostitute and a crack addict, prompting one ICTMN reader to ask “This is the person they use to represent Natives in their press release…?” The other person quoted in that December press release identified herself as a member of the “Iroquois tribe,” a suspicious designation given that Iroquois is the name of a confederacy of six nations — in our experience, a Native usually identifies him- or herself as Mohawk, Oneida, Onondaga, Cayuga, Seneca or Tuscarora, rather than “Iroquois.” (The December press release was issued the day after members of the Leadership Conference on Civil and Human Rights voted unanimously for a resolution urging a name change.)

The “Community Voices” campaign, like the efforts that preceded it, is not likely to win the Redskins any points with the media or national groups involved in the debate—indeed, it’s a press release that seems to court ridicule by the press.

From ThinkProgress: “The major problem with Community Voices is that it ignores the actual claims Native Americans who don’t like the name make against it. Community Voices tells us that there are football fans and Native Americans who support the name, but no one disputes that. What Community Voices doesn’t address is the actual claims some Native Americans make against it. Community Voices doesn’t dispute (or attempt to dispute) whether the name is an offensive term.”

From NBCSports.com: The team contends that, in response to owner Daniel Snyder’s October 2013 letter to fans defending the team name, the organization received more than 7,000 letters and emails of support, with nearly 200 coming from people who identified themselves as Native Americans or family members of Native Americans. The team claims that only seven letters were received from Native Americans who oppose the team name. It’s an entirely unscientific exercise, oozing with potential bias and lacking any evidence of vetting. It also ignores the organized effort against the name

But to those who are dead-set against a name change, it’s fuel. It’s more confusing verbiage that makes them think they might win this thing and get to keep their racist slur of a name. The militant supporters of the team’s name don’t seem to know it, but they’re rapidly approaching a fourth-and-very long scenario, and no amount of laughable cut-and-paste press releases the team issues will change that. But it’s plain to everyone else that pretty soon there is only going to be one play left:

The Invisibles: Seattle’s Native Americans

 

They’re rarely seen or heard, but the statistics on the population’s health, education, and happiness speak loud and clear.

Rose Gibbs is tough. Behind a youthful face and crystal-clear brown eyes resides a person hardened beyond her years. She’s been in foster care for the past five, citing her mother’s alcoholism as the reason she and six of her siblings landed there. At 15, she wears a San Francisco 49ers beanie and a look of unease when talking to a reporter. She says she “had to grow up too fast,” and it’s hard not to agree with her. Rose, who identifies as both Latina and a member of the First Nations Lyackson Tribe, is currently attending Ingraham High School in north Seattle. In the course of her life, including stints in Canada, Rose says she’s gone to “more than 10, maybe 20” schools. She thinks seven of those have been in the Seattle School District, but she’s not sure.

It’s an understated and understandable answer from a girl who seems accustomed to hiding vulnerability with aloof, indifferent distance. But it doesn’t take much to push past Rose’s hardened front.

“It happened in fourth grade,” she says of the moment alcohol and domestic violence collided, altering her life’s trajectory in an instant.

And then tears.

Rose rarely sees her mom these days, she says after a wrenching pause. Since then she’s spent time with five foster families, but hasn’t felt at home with any of them. She’s stubborn, she admits, and looks forward to her last two years “in the system.” She says she misses her siblings, and hopes one day to reunite with them.

Rose started coming to the Urban Native Education Alliance’s Clear Sky Native Youth Council, where I met her, back in April. At this point she’s what UNEA Chair Sarah Sense-Wilson describes as a “regular,” with an “indomitable spirit” —and a good example of exactly the kind of local kid the nonprofit tries to reach. Through Clear Sky, the UNEA offers tutoring, art, a sense of cultural belonging, and—perhaps most anticipated—a solid meal to urban Native American kids who need it. As it turns out, plenty in the Seattle area do.

Rose and I are seated at a round table inside the Seattle School District’s Wilson-Pacific Building. Compared to my previous visit to Clear Sky, where I’d first met Rose three weeks ago, things are considerably more comfortable. There’s heat this time. And bathrooms that work. On my first visit, the urban Native kids who come to Clear Sky gathered in a cafeteria toward the back of the soon-to-be-razed school building. The missing tiles from the ceiling and floor, and the sign on the door reading “RESTROOMS CLOSED/NO WATER” gave the gym an air of abandonment.

But tonight’s different. The meeting has been moved to a new room, and the upgrade is palpable. UNEA Co-Chair Mary Ann Peltier, who is from the Chippewa, Assiniboine and Sioux tribes, spills the details: They struck a deal with the school district, agreeing to pay $18.35 a night for the improved amenities.

A bad building wasn’t keeping Clear Sky from working its magic, however. While jackets were sometimes required, the decrepit, mural-covered cafeteria at the back of the Wilson-Pacific building was enough for Peltier and Sense-Wilson, a straight-shooting member of the Oglala Sioux tribe, to roll up their sleeves and get to work in. The UNEA’s flagship program, Cleark Sky held its first meeting in 2009, and they’ve been at it every week since.

“You donate?” Sense-Wilson drills me, nearly the moment we meet. “I’m just kidding. I know writers don’t make much money. ”

Sense-Wilson smiles as she ribs me. The room is abuzz. Subway sandwiches are on the menu, along with a class called “‘Native Journalism 21st Century.”  The Clear Sky mission of promoting “cultural, traditional activities and educational achievement” is alive around us. Though the UNEA also offers a basketball program and various other special events geared toward the urban Native population, the Clear Sky Youth council is the nonprofit’s gem. Sense-Wilson says the program provides academic support for “ensuring the success of Native learners,” and boasts a 100 percent high-school graduation rate.

Outside the walls, however, things get difficult for young urban Natives like Rose, who live off the reservation, a minority among minorities in the city. According to census data, only .8 percent of Seattle identifies as an American Indian and Alaska Native alone —a mere blip in a city named after Chief Sealth which was home to Native peoples thousands of years before a white person ever set foot here. It’s a demographic that faces a daunting set of challenges.

“You can turn a corner and see someone you relate to,” Peltier tells this white reporter. “I can turn many corners, and won’t relate to anyone.”

It can be lonely, and worse. And it isn’t getting better. According to information presented in the Seattle’s Race and Social Justice Initiative three-year plan for 2012 to 2014, American Community Surveys over the last 20 years show that the poverty rate for Natives in Seattle has fluctuated, but only slightly. In 1990, 33 percent of Natives lived in poverty; in 2000, it was 29 percent; by 2009, it was back up to 30 percent. That’s higher than the poverty rate for any other ethnic group. Meanwhile, the poverty rate for white Seattleites has stayed steady at just 9 percent.

For urban Native kids, the stats can look even worse. According to the “Community Health Profile” for the Seattle Indian Health Board released in December 2011, in King County 46.6 percent of American Indian and Alaska Native children under age 6 lived below the poverty line between 2005 and 2009, compared to 13.2 percent of children in the general population.

The difficulties only continue from there, and for a population as small, diverse, and historically maligned as this one, even finding a starting point from which to dig out can seem daunting. They include the pronounced education achievement gap between Native students and whites, resulting in historically low graduation rates and high dropout rates for American Indian and Native Alaskan students; numerous health concerns, from asthma to diabetes and obesity; addiction and alcoholism; domestic violence; a disproportionate rate of homelessness; and institutional neglect. And the fact that Natives, 1.5 percent of the overall population, make up 4.4 percent of Washington’s prison population.

There’s also the simple fact that placing an umbrella ethnic classification like “Native American” over a group of city-dwelling people from hundreds of tribes and countless cultural traditions simply doesn’t accurately define it.

As a result, the population often fades into the firmament.

“Sometimes I don’t think they see us,” Rose says. It’s a common sentiment. Changing people’s fortunes—as Clear Sky aims to do—often begins with confronting this sense of aloneness, pounded into Seattle’s Natives by politics, policy, perceptions, and nearly 200 years of history.

“To not have any representation that reflects who you are, or honors your cultural, your tradition, your history, it’s really a profound psychological, oppressive place to be,” Sense-Wilson says.

Clear Sky is a bright spot. Looking around on this Tuesday night, there is hope to be had. There’s Rose and her improved grades and self-worth. There are the other 40 or so kids who have arrived, each equally important. There are Sense-Wilson, Peltier, and the other adult volunteers, filling a need for their community when no one else did. And there are smiles.

You get the feeling that if the uncertain future of Seattle’s urban Native community is to be bright, it will likely start with exactly the kind of thing happening here.

“When we do see each other, we know,” Peltier says of the Native community in Seattle and what happens at Clear Sky. “We know when we connect.”

Call it a starting point.

It’s cold outside when the January 17 gathering of the state House’s Community Development, Housing & Tribal Affairs Committee comes to order—the kind of miserable weather Olympia is known for. On the docket is a work session titled “The Urban Indian Experience.”

With only the very occasional yawn, the seven lawmakers who make up the committee have come together this Friday afternoon to learn about the plight of urban Native Americans. For the elected policy-makers, it’s a chance to learn. For those invited to teach them, it’s a chance to have a voice in the halls of power.

Ralph Forquera, a member of the Juaneño Band of California Mission Indians and the executive director of the Seattle Indian Health Board, is first up. The semicircle of seated decision-makers listens as he gets into specifics, trying his best to describe the 29 federally recognized tribes and six unrecognized ones that meld together, along with countless individual Native transplants from across the continent, to make up our state’s remarkably diverse urban Native population. (Nationally, there are 566 federally recognized tribes and hundreds of unrecognized ones.) It’s no easy task, which is part of the larger problem.

The population is mixed, with varying ties to local, national, Canadian, and Alaska Native tribes, Forquera tells them. Some, like the 4,809 Seattle residents who identified as American Indian or Alaska Native alone in 2010, show up on the census. Many more don’t, for reasons both simple and complex. Who is an American Indian these days, and who marks the box when asked? “It’s a very difficult question to answer,” Mark Trahant, a former editor of the Seattle Post-Intelligencer editorial page and current Atwood Chair of Journalism at the University of Alaska Anchorage, tells Seattle Weekly. Trahant, a member of the Shoshone-Bannock tribes and the former president of the Native American Journalists Association, has written extensively on the lack of clear data on the Native population.

Some Natives have long hesitated to identify themselves for statistical purposes, Trahant says by phone from his office in Alaska. Others have unclear or mixed ethnic identities. How much of a connection must one have to identify as Native? What’s required by the tribe? Different ones have different standards, Trahant notes. And what about the growing generations of urban Natives off the reservations? How can we accurately account for them? None of these questions have easy answers, he says.

“Census is not very sensitive to tribe, it’s more sensitive to race,” Forquera later adds, saying “We don’t really know” how many people of American Indian heritage live in Seattle. “There aren’t any really accurate representations of the size of the population.”

But some of the numbers are indicative enough, and Forquera confronts the harsh realities every day. Leading the Seattle Indian Health Board and the Urban Indian Health Institute, he knows the “Community Health Profile” delivered in 2011 states that Natives in King County die of “unintentional injuries” (that is, accidents) more than twice as often as anyone else, at a rate of 79.3 per 100,000 deaths (compared to 32.4 per 100,000 among the general population). They suffer from asthma more than twice as often (17.3 percent vs. 8.1 percent), and diabetes too (12.2 percent vs. 5.9 percent). They’re nearly twice as likely to be obese as the general population (36.3 percent vs. 20.1 percent). The list goes on, and Forquera knows all of it well.

While his expertise is in health, this afternoon Forquera is also a history teacher. In his allotted 10 minutes, he does his best to deliver CliffsNotes on the past 160 years, providing a basis for what’s seen on the ground today. Natives inarguably have been a part of Seattle’s identity since the Denny Party’s arrival at Alki in 1851—and, of course, were the area’s identity for thousands of years before white men tied their boats to Puget Sound shores and pushed them to the side.

Addressing the “Myth of the Vanishing Race”—or, that stuff about Indians being savages and naturally giving way to white guys and their civilizations—William Cronon writes in his preface to Coll Thrush’s 2007 book Native Seattle: “Perhaps in part because Indian peoples have long been associated with ‘nature,’ it has been remarkably easy not to notice their presence in places marked as ‘unnatural’ in American understandings of landscape. Chief among these are urban and metropolitan areas, which for more than a century have provided homes for people of American Indian descent to a much greater degree than most people realize.”

In Washington, as of the 2010 census, 74 percent of those identifying as American Indians or Alaska Natives lived in cities, up from 71 percent in 2000. Statewide, the population of urban Natives is growing. According to data provided by Leslie E. Phillips, Ph.D., the scientific director at the Urban Indian Health Institute, from 2000 to 2010 Washington’s American Indian/Alaska Native population increased 30 percent, from 113,625 to 147,371.

Seattle hasn’t always been very accommodating to its Native population. As Thrush, an assistant professor of history at the University of British Columbia, describes in his book, one of the first ordinances passed in the newly incorporated Seattle back in 1865—Seattle Ordinance No. 5, to be exact—declared that “no Indian or Indians shall be permitted to reside” in the city. A complex dynamic even back then, the ordinance also mandated that those who employed Natives “provide lodgments or suitable residences . . . ” It was, from the very start according to Thrush, an “attempt to codify a middle road between segregation and integration.”

The national move toward reservations goes back even further, to a series Indians Appropriation Acts that started in 1851 and formalized the process of relocating Natives to land set aside for them by the U.S. Government. As Trahant notes in a recent research paper, however, many of the country’s earliest Native American policies have been based on the conquering view that American Indians would one day be extinct. “The assumption had come down from the earliest of times, not always voiced, but implicit, that the native inhabitants of the New World would become extinct. The notion grew stronger as the settlers waxed in numbers and the demand for living room accelerated,” D’Arcy McNickle, a member of the Confederate Salish and Kootenai tribes, wrote in his 1973 book, Native American Tribalism.

The extinction never materialized. Today, according to numbers from the United States Bureau of Indian Affairs, approximately 56.2 million acres are held in trust for Indian tribes and individuals, and there are approximately 326 Indian land areas in the U.S. The most recent numbers from the BIA indicates nearly two million enrolled tribal members.

Though local and federal government has done its part to drive Natives from Seattle, it’s also worked to bring them back to the city—for better or worse. A swell created by the federal assimilation policies in the 1940s, ’50s and ’60s—like House Concurrent Resolution 108, for example, which officially terminated the federal government’s acknowledgement of tribes from New York to California—pumped Natives into cities. The idea—or the stated one—was to free Native Americans of federal supervision and provide them with the same opportunities as other citizens.

The negative consequences, however, were noticeable. “An awful lot of people just ended up exchanging reservation poverty for urban Indian poverty,” Forquera tells Seattle Weekly of the assimilation movement. “It was a pretty cruel thing, actually.”

Nearly 150 years later, the effects of those early injustices are still felt. According to Chris Stearns—a gregarious state gambling commissioner, attorney and member of the Navajo Nation from Auburn—Natives often don’t trust the government, and things like Seattle’s Ordinance No. 5 have historically given them good reason not to. “You can’t unwind that,” says Stearns, the former chair of Seattle’s Human Rights Commission. “We were literally kicked out. That’s the bedrock of the relationship of Seattle with its Native population.”

The impact is more than psychological. This historical push and pull yields a Seattle urban Indian population that’s difficult to define—a mix of local, regional, national, and international Native people who call the city home. Thanks to small numbers and sheer heterogeneity, they exist without much voice, and often without a tangible connection to their heritages. “It’s a very diverse cultural mix, which makes it difficult to describe who we are and why we have specific needs,” Forquera offers. “As a subset of the total community, we’re very small. There’s very little attention paid to these smaller groups.”

On at least one Friday afternoon in Olympia this session, that wasn’t the case. “Be assured, we’re not just going to let this drop by the side,” Community Development, Housing and Tribal Affairs Chair Sherry Appleton (D-Poulsbo) says for the official record, before closing the meeting.

“It seems like the door was opened a little bit,” Forquera would later say of the work session, “so we’re trying to stick our foot in to keep it open.”

So far during the 2013 and 2014 sessions in Olympia, 40 bills relating to Native issues have been dropped; four have been passed by both chambers and signed by the governor.

As Rose will tell you, the invisibility felt by Natives in the general population shows up in Seattle’s schools. But according to those who’ve been around far longer than she has, this wasn’t always the case.

The District’s Indian Heritage High School, which for years found a home in the very same Wilson-Pacific building where Clear Sky now reserves a room on Tuesday and Thursday nights, was created in 1974. By the mid-’90s, the late Principal Bob Eaglestaff, a Lakota from the Cheyenne River Sioux reservation, was credited for turning the program into a national model for urban Native American education. The innovative school, which provided public education to Native students embracing cultural identity and Native American history, sought—with impressive success—to combat low graduation rates among Native students. District spokesperson Teresa Wippel points to the Seattle Public Schools history books when describing Indian Heritage, noting the 100 percent graduation rate it achieved by 1994.

However, citing low enrollment numbers, the District transitioned the Indian Heritage High School program in 2000, making it one of its then-five middle colleges (or alternative schools) that serve students of all demographics at risk of dropping out. By 2012, the Seattle School District reported that only seven of the school’s 50 students were Native. Preparing for the demolition and replacement of the Wilson-Pacific building in 2015, this year the Indian Heritage middle college program was consolidated with one located at Northgate Mall. As Wippel admits, “The withdrawal of district support and resources resulted in the decline of the program.”

Back at Clear Sky, the Seattle School District’s attempts to serve its Native population directly impact the 15-year-old sitting across from me. And with a few sharp—and obvious—exceptions, the challenges in Rose Gibbs’ life aren’t all that different from those of the children who surround us at the Clear Sky Youth Council, now beginning to line up for dinner.

In school, Rose says she does well in Spanish and history, but struggles in English and science. Sometimes she has trouble getting to school on time, a trip that requires two city buses. She admits to “hanging out with the wrong people” last year, but this year at Ingraham, things have been better, she says. I ask about friends; she tells me she has one. When I ask her whether she thinks the school district cares about her, she says, “Not really.”

The picture painted by the stats for young Native students like Rose isn’t pretty. In the Seattle School District, only about one percent of the roughly 50,000 kids identify as American Indian or Alaska Native. According to the 2013 Seattle Public Schools District Profile, in 2010 and 2011 Native students had the highest drop-out rate and lowest graduation rate of any demographic. While results vary from year to year, the report notes that “The American Indian ethnic group has historically had the highest dropout rates.”

A U.S. Department of Justice Indian Education grant application for the 2013–14 school year provided by the District depicts American Indian students well behind in mathematics, reading, and science. WASL scores in reading and mathematics for American Indian students are also the lowest of any ethnicity. Statewide, a 2008 report from the state Superintendent of Public Instruction’s Office detailed the achievement gap between white students and Native Americans, showing Native fourth-grade boys and girls behind white students in National Assessment of Educational Progress (NAEP) math and reading scores, among other deficiencies. In King County, the Seattle Indian Health Board “Community Health Profile” released in Dec. 2011 indicates that 18.3 percent of those 25 and older who identified as Native American or Alaska Natives reported not having finished high school or obtained a GED—a rate more than twice that of the general population.

Given these struggles, it’s no surprise that Seattle Schools Superintendent José Banda has made closing the achievement gap between Native and white students a theme of his administration. In his 2013 “State of the District” address, delivered last November, Banda said: “We still have unacceptable achievement gaps between our students of color and our white students, and we’re not making steady progress with our Native American students. We simply must and will do better.”

But how? That depends on who’s answering. Many in the Native community call for more Native-specific curricula, more cultural inclusion, Native language courses, and—primarily—a return of the District’s Indian Heritage High School. This last would be a decision for the School Board, Wippel says.

“Our biggest challenge and our highest priority at Seattle Public Schools is closing the achievement and opportunity gap,” says Wippel, “while at the same time raising expectations for students meeting or exceeding standards. While we truly believe it is possible to eliminate the gap, it will not happen without a focused, well-articulated plan for providing a challenging and rigorous curriculum for each and every student.”

For Native students, according to Shauna Heath, the executive director for curriculum and instruction for Seattle Public Schools, this plan includes targeting resources; utilizing federal grant funding; working to place a liaison for Native students in every school; implementing a Washington Tribal Sovereignty curriculum (which has already started in West Seattle and will continue in 2014–15); and connecting students with Native professionals and role models.

The District also hired Gail Morris as its new Native American Services Manager in October. From the Ahousaht First Nation, and locally having adopted the Muckleshoot tribe, Morris’ job, among other things, is to help ensure that as many Native students as possible qualify for Title III and Title VII federal education funding. Historically, this has been an area of struggle for the District, with funding having been lost in the past and auditors on four occasions finding that Seattle Schools overrepresented the number of Native students who meet these requirements.

District-wide, another area of concern has been Seattle’s special-education program, which hits Native students particularly hard. A December 4, 2013 “Native American Education Board Update” from the district indicates that 29.9 percent of Native students are identified as qualifying for special education—the highest percentage of any demographic in the district. Many of these Native families have voiced complaints.

Especially troubling, says Deborah Sioux Cano-Lee, board president of the nonprofit Washington Indian Civil Rights Commission, are reports from Native families that their special-education students aren’t receiving the support that their student learning plans require under federal law. Sioux Cano-Lee says her agency has received at least 16 such complaints, and they’re being investigated. Unfortunately, this is hardly the first time the Seattle Public Schools’ Special Education department has faced such scrutiny. The state Office of Superintendent of Public Instruction has chastised the program, even threatening to withhold federal funding, ordering problems (the failure to update and administer student learning plans and provide consistent special-education services from school to school) to be fixed.

“In all fairness, I’m going to have to say that [Superintendent] Banda inherited a huge mess,” offers Sioux Cano-Lee. “This didn’t start under his administration. This was an ongoing issue.”

Wippel says the District is aware of complaints from Native special-education families and others. She says these concerns go “beyond any one ethnic group,” while also noting that, when it comes to the District’s Native families, Morris frequently sits in on individual education plan meetings “in an effort to ensure that those families’ concerns are being addressed.”

“Our new Executive Director of Special Education, Zakiyyah McWilliams, has gone on record as saying that the Special Education department has experienced a high degree of staff turnover during the years and that instability has contributed to these types of concerns,” Wippel continues. “She has made it her highest priority to address these issues.”

As for the achievement gap, Wippel is blunt in expressing the District’s belief that closing it isn’t something it can do alone. In her words, it will require “intentional and strategic partnerships with our diverse families and community partners.”

Asked to describe Clear Sky’s relationship with the Seattle School District, however, Sense-Wilson offers a vague but telling assessment: “It’s complicated.”

“I’m from Seattle. I grew up here,” she explains. “I went to Seattle public schools, so I know that experience of going to school day in and day out and not being able to relate in the same way, and that constant pressure of conforming and not having your identity honored or recognized.” Rose breaks it down in far simpler terms. “Since we have the lowest scores, no one really cares,” she says, making it apparent that despite the district’s recent efforts, work remains.

“There’s not much to say, not much to tell,” Rose surmises.

If only that were true.

There are places to turn for young Natives in Seattle.

In addition to organizations like the Urban Native Education Alliance, the Clear Sky Youth Council, the Daybreak Star Indian Cultural Center and the Red Eagle Soaring Native youth theater group, nonprofits like Longhouse Media exist—at least in part—to help create a Native community within the city. Created in 2005 and currently run from a small office in the back of the Northwest Film Forum building on Capitol Hill, Longhouse was developed to “nurture the expression and development of Native artists,” according to Executive Director Tracy Rector.

A 42-year-old who identifies as Choctaw, Seminole, African-American, French, Irish, Scottish, and Hungarian, Rector grew up in Seattle and says many of the stories her 9-year-old Native-run nonprofit helps to tell “specialize in the urban native experience.” Since 2005, Rector says, Longhouse Media has helped make more than 360 short films and worked with 2,200 students—all of them young, all of them Native. She says over 80 percent live at or below the poverty line.

“In my own experience as someone who’s mixed-race and someone who didn’t grow up on a reservation, there are unique challenges in terms of our cultural intelligence and being accepted,” Rector says. “Our self-awareness as a Native person is very unique, because we also have all these other facets of who we are, and challenges and realities. [We’re] living in a big city, and negotiating what that means.”

In some ways, the role reservations have often played for rural natives in creating community and finding a voice is a void filled for urban Natives by local organizations like Longhouse. “Our people need to tell our own stories,” she offers, “and that’s what we’re committed to.”

“Many of our students haven’t been to their reservations before,” Rector says. “Their connection to their people is based on their connection as being identified as urban Native.”

Even with the work of her organization and many others, Rector worries about what the future holds for the small but important slice of Seattle’s population. Much like the ordinance that pushed Native people out of the city shortly after Seattle’s incorporation, she says gentrification and the disappearance of housing for low-wage or working-class Native families is doing the same, forcing them to “Federal Way and beyond.”

It’s a source of growing frustration, and it angers Rector. “Everybody deserves to be impacted by the beauty of Native culture in this city,” she says. “Native history is Seattle’s history.”

If Seattle’s history is Native history, then the city’s future is tied to the struggling urban Natives who call it home. As long as the city’s first peoples suffer, we suffer as a city. And for every kid at the Clear Sky Youth Council on this Tuesday night, the future is of direct consequence.

For Rose Gibbs, plotting a successful course into that future isn’t about census numbers, statistics, or trends. It’s about finding a way to pass English and science and finish the 10th grade at Ingraham. It’s about graduating from high school and, she hopes, making it to college—something Rose wants, but isn’t sure will be possible. Talking about the future elicits an equal mix of defiant self-confidence and uncertainty. She’ll be fine, she promises. She’s just not sure how.

One thing Rose is certain about, however, is that Clear Sky has helped. It speaks to the power of a grassroots movement and the importance of an invested community. It speaks to what people can do, even when it feels as if 98 percent of the population doesn’t see them; to resiliency and hope; to the promise of tomorrow, for Rose and others.

“I feel like I got support here,” Rose says of her time at Clear Sky. “It’s helping me know what it means to be Native.”

With that, she gets up and joins her friends. At this moment, in this warm room with working bathrooms, filled with people who care, Rose is anything but invisible.

Call it a starting point.

The Oneida Indian Nation is again proud to announce this year’s participation with the Karl May Festival in Radebeul, Germany.  The Karl May Festival is one of the most celebrated cultural festivals in Germany honoring famed German author Karl May. This year’s Karl May Festival will take place from May 30 to June 1 in Radebeul near Dresden, Germany.

The festival regularly attracts over 30,000 visitors and will include lecture, dance and song from the traditional and modern everyday life of the Oneida Indian Nation and the Haudenosaunee Confederacy. It will also include film exhibitions each evening. Each film presentation includes a short and feature length film about American Indians.

Cladoosby Hopes to Initiate Repatriation Discussion With France

National Congress of American Indians President Brian Cladoosby doesn’t expect he’ll have more than an opportunity to shake the hand of French President Francois Hollande at a White House state dinner February 11.

But he hopes that introduction will open the door to negotiation of an agreement for the repatriation of Native American objects in French museums.

Cladoosby, chairman of the Swinomish Tribe, and his wife Nina were invited by President Barack Obama and Mrs. Obama to the state dinner being held in honor of the French president.

During the French president’s visit to the U.S., Obama and Hollande “will discuss opportunities to further strengthen the U.S.-France security and economic partnership,” Obama said in a statement posted on www.whitehouse.gov.

“Michelle and I look forward to welcoming President Hollande … on a state visit to the United States,” Obama said.

“The United States and France are close friends and allies, including through NATO, and our countries have worked together to support democracy, liberty, and freedom at home and abroad for more than two centuries.”

The state dinner comes two months after a French judge’s decision to allow an auction house in Paris to sell 24 sacred Native American artifacts, despite the protests of the Hopi Nation, the U.S. Embassy, and indigenous civil rights organization Survival International.

The Annenberg Foundation intervened, submitting a winning bid of $530,000 U.S. for the sole purpose of returning the objects to their rightful owners – 21 items belong to the Hopi Nation, three to the San Carlos Apache.

The Native American Graves Protection and Repatriation Act gives indigenous nations in the U.S. a way to reclaim funerary objects and ceremonial items from federal agencies and museums in the United States. The law, however, does not apply to items held internationally.

Christopher Marinello, executive director and general counsel of Art Loss Register London, the world’s largest private database of lost and stolen art, antiques and collectables, told ICTMN in April 2013 that the Hopi and Apache objects should have been repatriated under the 1970 UNESCO Convention on the Means of Prohibiting and Preventing the Illicit Import, Export and Transfer of Ownership of Cultural Property. France ratified the convention in 1997.

According to the convention, “the [Hopi and Apache] pieces should have been pulled off, parties should have had a discussion to see which pieces could be sold, which were not genuine, what were the moral claims, what was important to the tribe, what is the compensation,” Marinello told ICTMN.

Marinello said there are no international agreements specifically addressing Native American artifacts, and said “it is something that the Americans should be convening and discussing because the laws in the USA protecting those Native artifacts have no weight overseas.”

That’s what Cladoosby hopes to initiate, noting, “We want to ensure our most sacred items are treated the same way” as those covered by other repatriation conventions.

Everyone’s Problem: Secretary of the Interior holds discussion on the impacts of climate change on the Pacific Northwest

Seattle – The United States Secretary of the Interior Sally Jewell, along with Dean of College of the Environment at University of Washington Dr. Lisa Graumlich, convened a meeting at the University of Washington (UW) in order to discuss climate change, the data we have already seen in the Pacific Northwest, and what the regional impacts are. Representatives from the United States Geological Survey (USGS), UW faculty, the National Parks Service, Department of Natural Resources (DNR), the North Cascades National Parks Complex, the Olympic National Park, and other organizations attended the February 4th meeting. Impacts on ecology, landscape, development and public planning were discussed, though for Native American Tribes, the implications are much more complex as they affect cultural identities. Although tribes’ interests are more deeply vested, collaboration was highlighted throughout the meeting as key to successfully combating climate change.

Dr. Gustavo Bisbal, Director of the USGS Northwest Climate Science Center, said, “{Tribes} have their finger on the pulse of the land. These communities don’t just worry about ‘oh well we can’t go snowboarding,’ or ‘I cannot go and water my carrots.’ There is a spiritual significance to the resources that they don’t see anymore. There is a danger of cultural erosion with things going away. ‘I can’t do this anymore. I cannot be…I cannot realize my tribal identity.’ That is huge, to understand the significance of how those resources are changing, and are really transforming cultures.”

For many years tribes, especially in Washington State, have led the charge in protecting natural resources. Stemming from the 1974 Boldt Decision, which protected tribal interests and rights to natural resources, tribal sovereignty was realized through the recognition of their authority to co-manage resources with state and federal entities. Today, although tribes remain at the forefront with their survival deeply vested in the preservation of natural resources, it is apparent that everyone has an interest in combating issues that come with climate change.

“I think one big lesson that nature, of course, taught us over time is there’s really no geographic or institution boundaries. When you look at the State of Washington, Department of Natural Resources owns the land, forest land, park land, tribal land, and they’re all impacted,” said Hedia Adelsman, policy analyst for the Department of Ecology and appointed proxy for the governor for the meeting. “Ultimately, how do we then work together to not have this fragmentation.”

These entities historically have worked individually, even in natural resource preservation efforts. DNR, for example, is currently developing a climate change adaptation plan, though it only affects DNR land. The boundaries on the land do nothing to contain environmental impacts. On Mount Rainier

Other entities get wrapped up in whether or not it is their responsibility to preserve natural resources or prepare for climate change.

“A climate catastrophe is not the time to have an identity crisis. From a National Parks Service perspective, I think there are still those many, many people within our population who think of national parks as zoos. Some of us realize the importance of national parks for the baseline information that they can provide regarding climate change. From a policy and legislative perspective, they look at specific species in parks, which a zoo-like mentality, as opposed to looking long range and thinking; well what if Roosevelt Elk actually move out of the park habitat, or what if they’re not doing so well. To what extreme would we go to maintain a population of Roosevelt Elk at the expense of keeping baseline data to inform climate change decisions,” said Sarah Creachbaum, Superintendent for the Olympic National Park.

Creachbaum demonstrated two roadblocks that need to change, one being the perspectives at the decision making level, and the second being the challenges in identity and questions of responsibility. The National Parks Service essentially is at the frontline, observing environmental changes on a daily basis. The potential data they stand to provide, in addition to what they do now, is overlooked because of these roadblocks. Creachbaum said they want to come to the table and be part of the team, but their significance has yet to be realized. That lack of vision in addition to oversight at the policy level creates a gap, consequentially hindering natural resource preservation.

Adelsman said, “We are just at the beginning of starting to look at it as a system. The part that I struggle the most with is we are recipient of the science, and we say we need to consider that in our planning policies, but what does that really mean?”

Climate change affects regions and regional systems beyond the natural environment, including the economy, public health, and population. For tribes, the effects will change tribal identity and culture if there are no longer traditional natural resources to have access to. At the end of the day, it is more than a tribal issue, more than a local or regional issue. In the Pacific Northwest, even speaking locally, climate change is an international challenge, as we share waters and mountains. Climate change impacts everyone and it will take a consorted, multi-national effort to plan for and prevent changes in the Pacific Northwest.

Columbia River Native Fish Shop Opens This Weekend

In the Northwest, Native Americans have caught and traded fish along the banks of the Columbia River for eons. Nowadays, natives sell just-caught fish out of coolers roadside.

This weekend, one native entrepreneur is opening her own brick-and-mortar fish shop in Cascade Locks, Ore,. called the Brigham Fish Market.

Kim Brigham Campbell is a petite woman with sleek black hair, razored just below her chin. And a laid-back, warm persona.

We walk past the clean, bright front counter to the room behind.

“In the back here we have our ice machine and our 20 by 20 freezer cooler,” she says.

“We’re getting a good variety [of fish]. There is our smoked fish, there are bellies and stuff for bait for sturgeon, there is sturgeon, we have some clam chowder that we are going to have on opening day, and more varieties of salmon.”

Bins of filets are all packaged up tight in glossy vacuum packs ready for sale.

From Brigham Campbell’s store you can see the Columbia River where these fish are plucked fresh from the chilly water. In this cooler is a precious half-year of hard work.

Brigham Campbell’s Native American family is well-known on the lower Columbia River. She’s a member of the Confederated Tribes of the Umatilla Reservation. Her father fishes, her uncles, her cousins, her sister, her children.

Brigham Campbell says her family name is tied to this store, and that means she’s had a few sleepless nights lately.

“I’ve been really comfortable building the building,” she says. “And now that it’s time to open the building, I hope that it’s everything that I want it to be and everything that people are expecting of me.”

To build the store, Brigham Campbell and her husband took out loans, cashed in a 401(k), struck a land deal with the nearby port and even borrowed money from her parents.

Brigham Campbell herself is a mother of two teenagers, an independent hairdresser and has managed to guide the construction of this new shop.

I ask her who she is most excited to see come through your the front doors.

“My parents, of course,” she says. “I’ll probably cry [when they walk through.] It will be a good thing.”

And getting to this opening hasn’t always been easy. There’s been some talk that she’s taking away from tradition, or changing things too much.

Still, she says many in her tribal community have been supportive.

“In the spring time, April or May I’m going to have a blessing,” says Brigham Campbell. “I’m going to have some drummers and singers come down and do a bigger grand opening. This is just my soft opening. I just need to open my doors. In the springtime I want to honor everyone that’s helped me and the blessing from the tribe.”

Blessing ceremonies for fishing families along the Columbia River isn’t new. For centuries Brigham Campbell’s ancestors prospered from the Northwest’s rivers and land.

With this bright new store, Brigham Campbell says she’s reasserting her belief in the Columbia River. That the wide waters will provide for her family’s future, as it has in the past.

The Brigham Fish Market opens in Cascade Locks, Oregon, at noon on Saturday, February 8.

Nike’s New Seattle Seahawks Uniforms Inspired by Native Totem Poles

Nike made “new” uniforms for all 32 football teams in the NFL.  In reality, they simply made technological advancements to material of the uniforms themselves, making them sleeker, tighter, and more strategically padded. As Mark Parker, CEO of Nike, told the USA Today, the jerseys are up to thirty percent lighter, they’re made with a four-way stretch that gives players a more contoured fit with less material for tacklers to grab, and there’s built-in padding in certain parts of the uniforms. “It’s extra layers where you need it and none where you don’t,” he told the USA Today. As for the actual look of the uniforms, most of the 32 teams in the leagues saw no discernible change in their logos, colors and designs…save for the Seattle Seahawks. USA Today reports that the Portland, Oregon-based Nike drew on design features from the team and company’s home in the Pacific Northwest, and were inspired by the rich Native history of the region. Specifically, Nike drew on the designs taken from totem poles, making the bird on the helmet come to a significant point on the back.  Instead of the Seahawks taking an Indian name and image for their mascot and logo, they’re simply allowing themselves to be inspired by the history and heritage of Native peoples of their region. The Intricate Beadwork of Jackie Larson Bread [10 Pictures]

Jackie Larson Bread is a beadworker from the Blackfeet Reservation in Browning, Montana, who currently lives in Great Falls. She won the Best in Show prize at the 2013 SWAIA Santa Fe Indian Market for “Memory Keeper,” a beaded hatbox featuring members of her family and her tribe. Shortly after the win, she discussed her work with an ICTMN correspondent.

How did you come to be one of the Native art world’s most prominent beadworkers?

I have been beading all my life, since childhood. My grandmother, who passed away before I was born, beaded. So I have always been interested in how it was done, and taught myself the techniques by studying her items, and the beadwork done by the ladies of my tribe. Among the Blackfeet, everyone knows the basic techniques. When I was 14, I started to work at the Museum of Plains Indians, which I continued to do for ten summers, where I was amazed by the beadwork, so I learned even more techniques. Then I attended the Institute of American Indian Art, in Santa Fe, to study painting and printmaking. I wanted to figure out how to introduce beadwork, because I like the mix of traditional and contemporary imagery, using old photographs. First, I did Sitting Bull and Geronimo, then photos of our people — 90%  of what I do is about the Blackfeet, telling what we look like, sharing our homes and designs. It takes so many hours that you have to be really passionate — it is time consuming! But I will always continue to do beadwork, even with the time factor, because I like it so much.

Is there a specific Blackfeet aesthetic you need to follow, or are you free to choose whatever you like in terms of colors, designs, and subjects?

I used to confine myself to traditional ideas of beadwork, but now I do what I feel comfortable with — though I do not show any ceremonial things. I stay with what is right to tell. I share the lodges, the tipi designs.

Like the pictures of your family?

Yes, my dad’s aunts and uncles. I like to look through photos of our family members. Finding someone new is exciting — I would show the picture to my father, and he would explain how we are related to the person.

Where do you usually show?

I show at Indian Market in Santa Fe, at the Cherokee Art Market in Tulsa, in Sioux Falls, South Dakota, in Tucson, and in Montana.

And now you’ve won Best in Show at Santa Fe Indian Market — probably the most prestigious award a contemporary Native artist can receive — after how many years?

I’ve showed for 15 years! I love coming to Santa Fe, and looking at what everybody does. It’s amazing. So to be recognized Best of Show is astounding, it’s the hugest honor. I am so happy I won, after 15 years.

Humetewa Close to Becoming First Female Native on Federal Bench

Hopi citizen Diane Humetewa smiled through a positive nomination hearing before the Senate Judiciary Committee on January 28 in her effort to be confirmed as a U.S. district judge in Arizona.

President Barack Obama nominated Humetewa to the position in 2013 after his administration previously forced her to step down from a U.S. attorney position in Arizona in 2009. At that time, the president chose Dennis Burke to take her position, but Burke resigned in August 2011 after admitting to leaking information about a federal agent. Humetewa went on to become a professor and lawyer at Arizona State University.

Many in Indian country were glad that Obama decided to give Humetewa a second look, this time to become the first female Native American to serve on the federal bench. She would be only the third Indian to do so in history if confirmed to the position by the full Senate.

Judging from support given to her by both Democratic and Republican senators at her nomination hearing, she will likely easily pass the committee, and then her nomination will proceed for consideration by the full Senate.

One of Humetewa’s main champions is Sen. John McCain (R-Arizona) who recommended her for both her previous U.S. attorney position and for the federal judgeship. The senator, whom she previously worked for when he led the Senate Committee on Indian Affairs, introduced her with supportive remarks at the confirmation hearing.

“It has been said that the Arizona bench ‘would be enriched by a member who reflects the community it serves.’ With that in mind, I am particularly excited about our third nominee, Diane J. Humetewa, also to the District of Arizona, in Phoenix,” McCain said. “Ms. Humetewa’s nomination is truly historic: Being a member of the Hopi Nation, if Ms. Humetewa is confirmed, she would be the first Native American woman to ever serve on the federal bench.

“Ms. Humetewa’s service to the Hopi Nation, which includes work as prosecutor and an appellate court judge to the tribe, runs deep and has remained a cornerstone of her career,” McCain added. “She is also a long-time advocate for victim’s rights, which can be traced back to her service as a victim advocate before she attended law school.”

McCain’s support for Humetewa serves as a stark contrast to his criticism of the president’s nomination of Cherokee citizen Keith Harper to become a U.S. representative to the United Nations Human Rights Council in Geneva. Harper’s nomination stalled in the Senate last December due partly to McCain’s concerns about Harper’s human rights record, but Harper was re-nominated earlier in January to the same position by the president.

Sen. Mazie Hirono (D-Hawaii), who chaired the hearing, said that she was impressed that McCain and committee member Sen. Jeff Flake (R-Arizona) worked in a bipartisan fashion with the White House to help fill several Arizona judicial vacancies.

Humetewa said at the hearing that she was very pleased to be joined by family members, friends and colleagues. She added that her parents were watching the hearing via webcam from back home on the Hopi reservation.

In response to a question from Hirono regarding how her past judicial work with the Hopi Tribe would help her in this position, Humetewa said that she learned to be objective and timely in her decision making during her time with that tribal court.

In response to a question from Flake on the implementation of pro-tribal elements of the Violence Against Women Act and the Tribal Law and Order Act, Humetewa noted that both laws are in their infancy, but she said she looks forward to working with tribes that take on the increased jurisdictional opportunities offered under those laws.

Also in response to a question from Flake, Humetewa noted that she helped prepare a 2007 report by the Native American Subcommittee of the U.S. Sentencing Commission that found disparities in the application of sentencing guidelines to Native Americans. Penalties were harsher for Indians who committed assaults in Indian country versus non-Indian who were sentenced in state courts for similar assaults, she testified. If sentencing guidelines are to be modified in the future, she said tribal consultation would be important to achieve.

Flake, impressed with Humetewa’s responses, said he was delighted by her “trailblazing way.”
