Kinder Morgan Pipeline Threatens Ecology and Economy of Salish Tribes

Tribes on both sides of the border intervene in proceeding to address tanker traffic and oil spill risks

Seattle, WA; Vancouver, BC — Opposition to Kinder Morgan’s TransMountain proposed pipeline project ramped up today as Coast Salish peoples on both sides of the U.S.-Canadian border vowed to oppose the project as intervenors before Canada’s National Energy Board (NEB). Coast Salish intervenors include the Swinomish Indian Tribal Community, Tulalip Tribes, Lummi Nation, and Suquamish Tribe in Washington state, and the Musqueam, Squamish and Tsleil-Waututh Nations in British Columbia. The deadline for application to participate in the NEB process was last night at midnight.

“Over the last 100 years, our most sacred site, the Salish Sea, has been deeply impacted by our pollution-based economy,” said Swinomish Chairman Brian Cladoosby. “Every kind of pollution ends up in the Salish Sea. We have decided no more and we are stepping forward. It is up to this generation and future generations to restore and protect the precious waters of the Salish Sea.”

“Our people are bound together by our deep connection to Burrard Inlet and the Salish Sea. We are the ‘People of the Inlet’ and we are united in our resolve to protect our land, water and air from this risky project,” said Chief Maureen Thomas of the Tsleil-Waututh Nation. “We will use all lawful means to oppose it. This is why we have applied to intervene in the NEB hearing process.”

In December, Kinder Morgan filed an application with the NEB to build a new pipeline to bring tar sands oil from Alberta to Vancouver, B.C. The NEB is the Canadian federal agency that regulates interprovincial energy infrastructure. It is responsible for reviewing, recommending and regulating major energy projects, such as the Kinder Morgan Trans Mountain pipeline.

If approved, the proposal would see the transport of tar sands oil expanded from its present level of approximately 300,000 barrels per day to 890,000 barrels per day. With an almost seven-fold increase in oil tankers moving through the shared waters of the Salish Sea, an increase in groundings, accidents, incidents, leaks and oil spills is inevitable.

Experts have acknowledged that a serious oil spill would devastate an already-stressed marine environment and likely lead to collapses in the remaining salmon stocks and further contamination of shellfish beds, wiping out Indigenous fishing rights.

“The fishing grounds of the Salish Sea are the lifeblood of our peoples. We cannot sit idly by while these waters are threatened by reckless increases in oil tanker traffic and increased risk of catastrophic oil spill,” said Mel Sheldon, Chairman of the Tulalip Tribes.

The proposed tar sands pipeline expansion is one of several projects that would dramatically increase the passage of tankers, bulk carriers, and other vessels through Salish Sea shipping routes and adjacent waters on both sides of the U.S.-Canada border. In addition to oil, regulators in both countries are reviewing controversial proposals to export huge quantities of U.S. coal. Taken together, these projects would greatly increase the risk of oil spills and other accidents that threaten the Coast Salish economies and cultures.

“Today we are taking a stand to honour our ancient connection to the Salish Sea. The threat of oil spills and industrial pollution continue to threaten our way of life.” said Chief Ian Campbell of the Squamish Nation. “We stand in unity with all who care about the health of the Salish Sea and defend it for future generations.”

Chairman Timothy Ballew III of the Lummi Nation stated, “I am a fisherman, a father and a member of the great Lummi Nation. As the northernmost Washington Treaty Tribe of the Boldt Decision, we are the stewards the Salish Sea and will not allow the Kinder Morgan proposal along our waterways that will threaten our harvesting areas and further the detrimental impacts to the environment and natural resources.”

Landmark Study Demonstrates Climate Benefits of Estuary Restoration

WASHINGTON – Restore America’s Estuaries has released the findings of a groundbreaking study that confirms the climate mitigation benefits of restoring tidal wetland habitat in the Snohomish Estuary, located within the nation’s second largest estuary: Puget Sound. The study, the first of its kind, finds major climate mitigation benefits from wetland restoration and provides a much needed approach for assessing carbon fluxes for historic drained and future restored wetlands which can now be transferred and applied to other geographies.

The Study, “Coastal Blue Carbon Opportunity Assessment for Snohomish Estuary: The Climate Benefits of Estuary Restoration” finds that currently planned and in-construction restoration projects in the Snohomish estuary will result in at least 2.55 million tons of CO2 sequestered from the atmosphere over the next 100-years.   This is equivalent to the 1-year emissions for 500,000 average passenger cars. If plans expanded to fully restore the Snohomish estuary, the sequestration potential jumps to 8.8 million tons of CO2   or, in other terms, equal to the 1-year emissions of about 1.7 million passenger cars.

“The study is the first to provide a science-based assessment of climate benefits from restoration at scale. The findings are clear: restoring coastal wetlands must be recognized for their ability to mitigate climate change,” said Jeff Benoit, President and CEO of Restore America’s Estuaries. “The report adds to our list of science-based reasons why restoration is so critical.”
“Healthy estuaries mean healthy economies,” Representative Rick Larsen, WA-02, said. “I have long advocated to restore our estuaries because of the critical role they play in supporting recovery of fisheries. This new study shows that estuary restoration can play a big role in countering climate change too.”
“It is very fitting that we are implementing some of the world’s leading Blue Carbon research here in Puget Sound,” said Steve Dubiel, Executive Director of EarthCorps. “We have always known that wetlands are a kind of breadbasket, thanks to the salmon and shellfish they support. Now we are learning that they are also a carbon sponge.”
In addition to the climate benefits outlined by the study, healthy and restored estuaries act as spawning grounds and nurseries for commercially and recreationally important fish and shellfish species, provide storm buffers for coastal communities, filter pollutants, and provide habitat for numerous species of fish and wildlife, as well as recreational opportunities for hundreds of millions of Americans annually.
“This study illustrates the contribution of tidal wetland restoration to reduce global warming,” said Dr. Steve Crooks, Climate Change Program Manager for Environmental Science Associates and lead author on the study. “From this analysis we find wetlands restoration in Puget Sound likely to be highly resilient to sea level rise while at the same time continuing to sequester carbon within organic soils. Similar opportunities will exist in other coastal regions of the U.S.”
“This report is a call to action. We need to invest more substantially in coastal restoration nationwide and in science to increase our understanding of the climate benefits which accrue from coastal restoration and protection efforts,” said Emmett-Mattox, Senior Director for Restore America’s Estuaries and co-author on the study. “Sea-level rise will only make restoration more difficult and costly in the future. The time for progress is now.”
This report was a collaborative effort of Restore America’s Estuaries, Environmental Science Associates (ESA), EarthCorps, and Western Washington University. Lead funding was provided by NOAA’s Office of Habitat Conservation and additional support was provided by The Boeing Company and the Wildlife Forever Fund.

Keystone XL ‘black snake’ pipeline to face ‘epic’ opposition from Native American alliance

A Native American alliance is forming to block construction of TransCanada’s proposed Keystone XL pipeline which still needs final approval from U.S. President Barack Obama after the State Department released an environmental report indicating the project wouldn’t have a significant impact Alberta tar sands production.

Members from the seven tribes of the Lakota Nation, along with tribal members and tribes in Idaho, Oklahoma, Montana, Nebraska and Oregon, have been preparing to stop construction of the 1,400 kilometre pipeline which is slated to run, on the U.S. side, from Morgan, Mon., to Steel City, Neb., and pump 830,000 barrels per day from Alberta’s tar sands. The pipeline would originate in Hardisty, Alta.

“It poses a threat to our sacred water and the product is coming from the tar sands and our tribes oppose the tar sands mining,” said Deborah White Plume, of the Oglala Sioux Tribe, which is part of the Lakota Nation in South Dakota. “All of our tribes have taken action to oppose the Keystone XL pipeline.”

The U.S. State Department released its long awaited environmental report on TransCanada’s proposed pipeline Friday. The report found that the pipeline’s operation would not have a major impact on Alberta tar sands production which is also at the mercy of market forces.

“Approval or denial of any one crude oil transport project, including the proposed project, is unlikely to significantly impact the rate of extraction in the oil sands or the continued demand for heavy crude oil at refineries in the United States based on expected oil prices, oil sand supply costs, transport costs and supply-demand scenarios,” said the report.

The project will now go into a final phase which focuses on whether Keystone XL “serves the national interest.” Pipeline’s environmental, cultural and economic impacts will be weighed in this phase and at least eight agencies will have input on the outcome, including the Department Defence, Justice, Interior, Commerce, Transportation, Energy, Homeland Security and the Environmental Protection Agency.

A 30-day public comment period will also be initiated on Feb. 5.

The State Department is also in the midst of probing conflict-of-interest allegations levelled against contractors who both worked on the report and for TransCanada.

The Lakota Nation is preparing for the eventuality the pipeline receives approval. The nation has led the formation of a project called “Shielding the People” to stop the pipeline. The Lakota also launched a “moccasins on the ground” program to train people in Indigenous communities to oppose the pipeline.

There are also plans to set up spiritual camps along the pipeline’s route. But when and where those camps will spring up remains a closely guarded secret.

“It will band all Lakota to live together and you can’t cross a living area if it’s occupied,” said Greg Grey Cloud, of the Rosebud Sioux Tribe. “If it does get approved we aim to stop it.”

Gary Dorr, from the Nez Perce Tribe in Idaho, was in Rosebud Friday for a meeting to discuss opposition to Keystone.

The Nez Perce tribe has already used its treaty rights to block the transport of so-called megaloads of mining equipment headed to Alberta’s tar sands through its territory. The tribe launched blockades and won a court battle to stop the shipments from traversing its lands.

“It will be obvious, it will be concrete, and I think once it starts and they start building you will start to see the momentum and the force of the tribal people…it is an epic project, it will have an epic response from the tribal people,” said Dorr. “The tar sands is already affecting the people (for Fort Chipewyan in Alberta), climate change is already obvious. To facilitate that is not something the Native people of the U.S. are going to do. We are not going to sit idly by and let it happen.”

The pipeline has been called the ‘black snake’ in reference to prophecies that had previously been linked to construction of highways and railways. In recent ceremonies, however, discussions sifting through the prophecies noted that the black snake goes under ground.

“That would be a referral to the pipeline,” said Dorr.

Paula Antoine, who works for the Rosebud Tribe’s land office, said while the pipeline does not cross any Lakota reservation lands, it comes close, sometimes metres away. Antoine said the pipeline, however, cuts through their treaty territory, sacred sites and waterways.

“They aren’t recognizing our treaties, they are violating our treaty rights and our boundaries by going through there,” said Antoine. “Any ground disturbance around that proposed line will affect us.”

The battle lines have already been drawn in tribal council chambers. The Oglala Sioux Tribe passed a resolution Friday banning TransCanada and former AFN national chief Phil Fontaine, who has been hired by the energy firm to deal with First Nations opposition to its Energy East project in Canada, from entering its territory.

The resolution received unanimous consent,said White Plume.

The Lakota, Dakota and Nakota make up the Lakota Nation. The nation includes the tribes of Rosebud, Oglala and the Cheyenne Indian reservation, the Yankton Sioux Tribe, Standing Rock, Flandreau Sioux Tribe and the Crow Creek Sioux Tribe.

West Virginia Chemical Spill Ruins Water Supply for Thousands of Natives

American Indians were mobilizing this week to help more than 4,000 Natives who are among the 300,000 people without potable water in the wake of a January 9 chemical spill that rendered tap water undrinkable in several counties.

The no-use advisory was lifted on Tuesday January 14 for at least 100,000 of those affected, but problems remained.

“My sister has good water at their house, so they have been carrying water to those who don’t, making arrangements for water delivery to shut-ins and friends with disabilities and traveling extensively in the problem areas,” said Chief Wayne Gray Owl Appleton of the state-recognized Appalachian American Indians of West Virginia. As a senior chemist and emergency response specialist, he was among those working to resolve the issue.

The clear, colorless liquid known as 4-Methylcyclohexanol methanol seeped from a tank at Freedom Industries, which manufactures chemicals for the mining, steel and cement industries. The compound, which reportedly smells like black-licorice or cherry cough syrup, is a foaming agent used in the coal industry, according to CBS News. About 5,000 gallons of it escaped from a 40,000-gallon tank, state Department of Environmental Protection spokesman Tom Aluise said.

The affected members of the Appalachian American Indians of West Virginia live in all or parts of the counties of Kanawha, Boone, Cabell, Clay, Jackson, Lincoln, Logan, Putnam and Roane. State Department of Education spokeswoman Liza Cordeiro said schools in at least five of the counties would be closed.

A good 2,000 more indigenous people who belong to the 6,000-member Native American Indian Federation Inc. of Huntington, West Virginia, were also affected, said Chief David Cremeans.

Immediately after the spill, the federal government and the state of West Virginia declared nine counties as disaster areas, sparking a run on stores for bottled water. Shelves were stripped bare, and many West Virginians had no access to water. Residents who did not learn of the warnings in time and thus drank or bathed in the water suffered rashes and nausea. Others went to local with symptoms they said came from the water contamination.

Tension was palpable outside the contaminated area, with reports of price gouging and even fistfights.

“Nobody could find water,” said LaVerna Vickers, the tribal secretary of the Appalachian American Indians of West Virginia. “My husband and I looked to see if we were affected by the spill, and thankfully we live in Jackson County just outside of the West Virginia Water System Supply District.”

Vickers said it wasn’t until she got into the affected areas that she saw just how bad it was.

“We stopped outside of a store and a truck had already come and had cleared it out. We also heard from our friends that people were charging large amounts of money for water—people were selling five-gallon water bottles for one hundred dollars,” she said.

“Places like Wal-Mart weren’t putting the water on sale either. We couldn’t even find jugs to fill in the stores,” said Vickers. “You can also really feel the tension in Charleston. There have been fistfights and other altercations over water. Everyone is really tense.”

Vickers, who lives about 50 miles from the spill, said the past few days have been devastating. Further, she added, although officials said the spill occurred on Thursday, a reputable member of her community who lives just a few miles from the spill smelled the black licorice odor as early as Tuesday January 7. The effects were immediate, and visceral, Vickers said in describing the plight of a friend whom she was helping supply with water.

“I also have another friend who is deaf and lives a few miles from the spill,” Vickers said. “She had no water and couldn’t even go outside her door. When she tried to go outside she vomited.”

Northwest Teams Lead A Growing ‘Green Sports’ Movement

Northwest sports teams are leading an effort to use the widespread appeal of basketball, football, baseball and hockey to spread an environmental message.

A group formed by six teams in Portland, Seattle and Vancouver, B.C., called the Green Sports Alliance set out three years ago to improve the environmental performance of professional sports. The alliance has grown to hundreds of teams across the country that are now competing to see who can be the greenest.
Baseball fields, basketball arenas and football stadiums across the country are installing solar panels and wind turbines. They’re selling local and organic food to their fans, and replacing trash cans with recycling and compost bins.

Supporters of this movement say sports offer a fun, non-political way to promote environmentalism. It saves money, cuts carbon emissions, and the environmental benefits count toward the teams’ record of community service.

Tracking Green Stats

The green sports game isn’t as exciting to watch as a slam dunk, a home run or a touchdown. But it has racked up some impressive stats:

  • The Portland Trail Blazers have cut the carbon emissions at the Moda Center by 50 percent since 2008 and saved $3.3 million in utility costs in five years.
  • The Seattle Seahawks and Sounders installed the largest solar array in the state of Washington at CenturyLink Field in 2011; and
  • The Seattle Mariners raised their recycling rate from 38 percent in 2010 to 90 percent in 2013 and saved $2.2 million in utility costs in seven years.

The teams are tracking their environmental performance with help from the Natural Resource Defense Council and the Environmental Protection Agency. So they know where they stand in the environmental rankings. According to Martin Tull, executive director of the Green Sports Alliance, that has spurred some friendly competition.

“When one facility puts up 3,000 solar panels, the next time an owner is going to build a stadium, he wants to have 3,001,” Tull said. “We try to use that as much as we can to give them little catalyst to have the biggest solar array or to have the least energy used.”

Scott Jenkins, vice president of ballpark operations for the Seattle Mariners, said his team has been trying to match the San Francisco Giants’ recycling rate for years. This year, the Mariners fell a little short once again as the Giants reached a 95 percent recycling rate.

“Every time I think we’re going to catch up to them they raise the bar a little bit more,” Jenkins said.

Tracking environmental performance has also yielded some interesting data. When the Blazers commissioned a study to measure their carbon footprint in 2008, it revealed that 70 percent of the carbon emissions associated with the Moda Center come from fan and employee transportation to and from the arena. Team transportation and business travel, by comparison, only accounted for 4 percent of the team’s carbon emissions.

“That surprised us all,” said Justin Zeulner, sustainability director for the Blazers. “We realized we have to start engaging with our fans and our community to get to our impacts because they’re the ones selecting behavior. They’re the ones that decide: How am I going to get to the game?”

Making it fun

Sports teams aren’t looking to bog people down with environmental doom and gloom. Instead, they say, they try to make the idea of sustainable living fun. One hockey arena, for example, invites fans to shoot aluminum cans into the proper recycling receptacle.

The Mariners introduced two recycling superheroes: Captain Plastic and Kid Compost. They roam the concourse of Safeco Field offering photo ops and recycling and composting assistance. The compost from the games goes to Cedar Grove Composting, which in turn creates bags of Safeco Soil made from compost at its facility. Fans can take that compost home to use in the garden; the team also offers “kitchen catchers” to hold household food scraps.

The Blazers have a living wall that invites fans to high-five a hand print if they support the team’s environmental mission. It also has a chalkboard for people to share how they’re going green in their own lives.

Saving money

Tull says money is another motivation for teams going green – and one the alliance uses to attract new members.

“When we sit down with a new team that we haven’t worked with we ask a very simple question: Would you like to learn how other teams have saved millions through conservation,” he said. “And what do you think they say? They say hell yeah.”

Northwest sports teams are among the first to prove that conservation measures such as replacing light bulbs and reducing water use at event centers have a quick return on investment.

“When you look at your bottom line and say I’m saving $400,000 a year in utilities, I’m saving $200,000 a year on my waste costs, and I’m building brand value and doing what’s right, it really is a no-brainer to get into that area,” said Scott Jenkins, vice president of operations for the Mariners.

Selling environmentalism

For those who are rooting for a cleaner environment, Tull says, sports teams are a great way to sell the idea to a mass market.

“If I talk to a middle school student and say, ‘Did you realize the Portland Trail Blazers cut their energy use in their house by 30 percent?’ It’s a lot more exciting than if we say, ‘Did you realize that this local bank did a retrofit and cut their energy use?’”, said Tull. “Even with the exact same statistics it’s always going to be more exciting if it comes through the lens of sports.”

Allen Hershkowitz, director of the Natural Resource Defense Council’s Sports Greening Program, says his environmental group hatched the idea of using sports to sell environmentalism back in 2004.

Sporting events themselves don’t have huge environmental impacts, he says, “however, where the impact of sports is enormous is in its cultural and market influence. The cultural and market influence of sports is almost unparalleled.”

He cites a statistic: 13 percent of Americans follow science while 63 percent follow sports.

“So, if you want to reach Americans, you’ve got to go where they’re at,” he said. “Using the non-political, non-partisan, politically neutral space of basketball, baseball, football, hockey, tennis, soccer to educate people about the need for recycling, energy efficiency, water conservation and safer chemical use. It’s a spectacular platform and at the same time tens of millions of pounds of carbon have been reduced.”

Peter Murchie is an environmental health manger for the EPA in Seattle. He says his agency is hoping that fans will take environmental lessons home with them from the big game. He’s hoping the movement will trickle down to younger sports teams, too.

“Sports translates down into your local communities,” he said. “If you see that the Seattle Seahawks or Portland Trail blazers being green, there’s a chance that your local little league and youth sports will also look at how they can do things in a more sustainable way. That gets an even broader marketplace.”

What about climate change?

So far, sports teams are leading by example and sticking with subtle environmental suggestions. However, this year several league commissioners sent letters to Congress acknowledging the issue of climate change.

The Trail Blazers are the first and only professional sports team to sign a climate declaration. Zeulner says he’s hoping the unifying nature of sports can move people beyond political barriers toward taking action on climate change.

“You can go to a sporting event and be sitting with people who are complete strangers to you, but you’re all focused on that energy of what’s happening on the field – what’s happening on the playing surface,” he said. “You start seeing people high-fiving each other, hugging each other over this thrill of whatever the sport is. The emotion of that sport. These are Republicans and Democrats. They’re different races. Different sexes. It doesn’t matter. Sports gives you that opportunity to strip all those barriers down and realize we actually want the same things.”

The Green Sports Alliance is already expanding into college sports and is now looking at the prospect of including teams across the globe in Europe and South America.

Monroe cow manure to help power PUD

MONROE — For the past five years, 300 homes outside Snohomish County have been powered by cow manure from farms near Monroe.

For the next five years, that power will stay in the county.

Qualco Energy, which runs a biogas plant south of Monroe, has been selling its power since 2009 to Puget Sound Energy.

Now, Qualco has signed a five-year contract with the Snohomish County Public Utility District, effective Wednesday.

The PUD provides electricity to Snohomish County and Camano Island. Puget Sound Energy, based in Bellevue, provides electricity to parts of eight counties in the region but not Snohomish.

The PUD “was able to offer a better rate than PSE did,” said Daryl Williams, environmental liaison for the Tulalip Tribes and a Qualco board member.

The PUD will pay Qualco $47.84 per megawatt hour in 2014, steadily rising to $67.60 in 2018, according to the utility. The price is based on a complex formula established by the PUD.

Qualco is a nonprofit formed by three groups: the energy division of the Tulalip Tribes; Northwest Chinook Recovery, a salmon advocacy group based in Anacortes; and the Sno/Sky Agricultural Alliance, a farmers’ group based in Monroe.

Qualco was created after cattle farmer Dale Reiner wanted to use a piece of property he’d purchased but was concerned about flooding and environmental effects on nearby streams.

He worked with Northwest Chinook Recovery on a fish habitat restoration project. Haskell Slough — a former main channel of the Skykomish River that had been diked off to create farmland — was restored into a salmon spawning stream. The project also has served to prevent flooding on Reiner’s property.

The unusual alliance of a farmer and environmentalists clicked, and the participants looked for another project. They brought in the Tulalip Tribes for added perspective on salmon habitat.

The group realized that making use of cow manure could help farmers and fish. Clearing farms of animal waste would reduce pollutants running into streams and cut costs for farmers in complying with environmental regulations. This, in turn, could allow them to add to their herds.

Biogas was the way, the group agreed.

Qualco was formed. The group obtained, through donation by the state, a former dairy farm in the Tualco Valley run by the Monroe Correctional Complex. The group also received a federal loan for renewable energy and a grant from the state Department of Agriculture. The equipment cost more than $3 million.

The group nets about $300,000 a year, Reiner said. The money goes to bond payments, environmental projects and upgrades to the system.

“None goes into our pockets, not a dime,” he said.

The work at the plant is done by dairy farmers on a volunteer basis.

The biogas plant uses the waste from about 1,200 cows. About 900 of them are located at Andy Werkhoven’s dairy farm about a mile and a half away. That waste is mixed with water and sent to the Qualco site via pipeline. The other 300 cattle are located on site next to the plant. Their only job is to eat and put out fuel for the generator.

Qualco also accepts unsold foods and beverages from stores, blood from meat processors and restaurant grease and uses it all in the mix. Qualco collects fees from companies to take the waste.

These materials are dumped into a concrete pit 15 feet deep and about 25 feet across, into which the liquid manure is piped.

An agitator with propeller blades churns the material into a swirling, roiling mix.

It’s then piped into a 1.4 million-gallon underground tank — 16 feet deep, 180 feet long and 74 feet wide — where it bubbles and gives off methane gas.

That gas is piped into a generator in a neighboring building, creating the power. The electricity is sent to the grid through three transformers mounted on a pole outside the building. The PUD is planning to replace those transformers with larger ones, Reiner said.

Previously, the energy went into the PUD’s system and the utility sent an equivalent amount to Puget Sound Energy. Now the power will stay home.

Effluent and solids from the process are applied to several farms as fertilizer.

Qualco’s original agreement with the state requires the fuel mix to be at least 50 percent cow manure and no more than 30 percent food-and-beverage waste. Qualco uses cow manure for the remaining 20 percent, creating a 70-30 ratio.

The sugars in the food waste, however, generate methane gas at a much higher rate than the cow waste, Qualco members said. As a result, the plant produces more gas than it can convert into electricity, and burns it off through an exhaust system.

While the generator creates enough power for about 300 homes, the plant produces enough gas for 800 homes, according to the Qualco website.

The plant would need another generator, or some type of expanded system, to take advantage of the remaining gas.

Qualco members plan to expand the plant, Reiner said. Options include steam power generation and compressing the fuel for use in cars.

“There are many directions we could go, and all of them are good,” he said.

Reiner believes the potential of biofuel is unlimited. Much more food waste and cow manure is available than is being used, he said.

Qualco could burn more food waste if it had the capacity and its agreement with state allowed it to do so, Reiner said.

He said any organic material that’s combustible could be turned into fuel.

“It’s just barely starting,” he said.

 

Tulalip Tribes partner with others to restore salmon habitat

STANWOOD — The coastal stream at 18510 Soundview Drive NW in Stanwood began as a “degraded straight ditch,” according to Brett Shattuck, forest and fish biologist for the Tulalip Tribes, but the gulch came to reclaim its old name of Greenwood Creek in the wake of its restoration as a salmon habitat this fall.

“We spent years studying all the coastal streams in the Whidbey basin, looking for which ones were used the most by juvenile chinook salmon, and we found the highest number of them here,” said Shattuck, who reported that Tulalip Tribal Natural Resources staff counted 280 chinook, out of a total of 600 juvenile salmon that also included coho and other species, during a single day’s electrofishing survey. “Even though this property is owned by Snohomish County and in a public right-of-way, it was an ideal restoration site, so we spent the past year pursuing that. Our neighbors were very supportive, and the county was willing to work with us and the Adopt-A-Stream Foundation to find a strategy that was beneficial to the county, the local residents, the Tribes and the fish.”

Shattuck explained that crews pulled back the banks of the stream to widen it, cleared out invasive species such as blackberry brambles, installed large wood debris to foster a better habitat for the salmon, and planted a dense variety of native vegetation to help hold back the stream banks and provide shade for the salmon.

“We’ve got about 300-400 trees and shrubs, not including the live stakes, all about two feet apart from each other,” said Shattuck, who listed willow, red cedar and red twig dogwood as among those species. “Volunteers and Tribal Natural Resources staff did most of the planting in about a day. The county donated the plants and wood debris, and their staff helped us with the permitting and engineering of the site. Again, the stream’s neighbors were really behind us, and it was good working with the Adopt-A-Stream Foundation’s contractor. Our funding source was the Pacific Coast Salmon Recovery Fund.”

According to Shattuck, the contractor work ended in September and the planting took place in October, and all that’s left now is to install the interpretive sign for the site — which he expects will be completed within the next couple of months — and to continue the monitoring work that led the Tribes to select the stream in the first place.

“We monitored this site for three years prior to implementing anything,” Shattuck said. “This is a pilot program, because there are plenty of other drainage streams in the basin that could be made into better habitats for their fish.”

“If we are truly committed to seeing salmon stocks rebound to harvestable levels, we must work together on recovery projects both large and small,” Tulalip Tribal Chair Mel Sheldon Jr. said. “Greenwood Creek represents a small project with a huge benefit. The Tulalip Tribes look forward to working with Snohomish County on future projects to solve our salmon crisis.”

 

Endangered Species Act: a 40-year fight to save animals

Forty years after the passage of the federal Endangered Species Act, the state and Snohomish County remain squarely on the edge of that preservation frontier.

More than 40 animal species in Washington are listed by the federal government as either endangered or threatened under the law, signed by President Richard Nixon on Dec. 28, 1973. Many others are listed as species of concern.

Among creatures found in waters in and around Snohomish and Island counties, seven species of fish or marine mammals are listed under the act.

Southern resident killer whales and bocaccio rockfish are listed as endangered. Puget Sound chinook salmon, Puget Sound steelhead, bull trout, yelloweye rockfish, canary rockfish and Pacific smelt are threatened.

Nationwide, 645 species of animals and 872 plants or trees native to the U.S. are listed as threatened or endangered, according to the U.S. Fish and Wildlife Service.

Of the local fish species and orcas, salmon and bull trout were listed in 1999, the killer whales in 2005 and the other fish species in 2010.

Reasons cited for the decline of the fish are many, including pollution, overfishing and loss of habitat. In the case of killer whales, dwindling supply of their diet staple — chinook salmon — is a major contributing factor, officials say.

Supporters claim many success stories for the Endangered Species Act, with bald eagles and peregrine falcons among the more prominent examples.

Gray whales were taken off the list in 1994 and steller sea lions just this year.

According to U.S. Fish and Wildlife, 99 percent of the hundreds of species listed since the Endangered Species Act became law have been prevented from going extinct.

The law protects species by preventing them from being harmed or captured and by regulating human activity in their habitat areas.

Perhaps the best feature of the Endangered Species Act, some say, is that it keeps the species’ problems in the public spotlight.

“It has pulled people together to talk about what to do,” said Daryl Williams, environmental liaison for the Tulalip Tribes.

Recovery for many species, however, is slow and not guaranteed.

“Listing is a way of sort of planning for recovery, if you will,” said Brent Norberg, a marine mammal biologist with the National Marine Fisheries Service in Seattle.

The southern resident orca population, for example, had 88 whales in 2004, the year before it was listed under the ESA. The population now is down to 80, according to the Orca Network, a Whidbey Island-based group that tracks the whales.

“Because they’re so long-lived and their recruitment is so slow and their numbers are so small, it’s going to be quite a lengthy process,” Norberg said.

William Ruckleshaus, the first director of the Environmental Protection Agency under Nixon in the early 1970s, is 81 and lives in Medina.

The EPA was created and Endangered Species Act was passed after pollution and declines in species had reached alarming levels, Ruckleshaus said. The Cuyahoga River in northeast Ohio, for example, famously caught fire in 1969.

“The public demanded something be done about it and the president responded,” he said.

He said the endangered species law might have overreached.

“We passed laws that promised levels of perfection that probably weren’t possible. It’s hard to do it, to be honest with you,” Ruckleshaus said. The law has been refined over time, he said.

Ruckleshaus works part-time for Madrona Venture Group, a venture capital firm, and has served on the boards of the Puget Sound Partnership Leadership Council and the Salmon Recovery Funding Board.

“The motivation behind the ESA couldn’t have been any higher — we want to preserve all living things on Earth. Who’s against that?” Ruckleshaus said.

“I think it’s been very positive overall,” he said. “It’s shown how what we believe to be innocent acts can have devastating effects on species.”

The Endangered Species Coalition, a Washington, D.C.-based environmental group, has issued a report titled “Back from the Brink: Ten Success Stories Celebrating the Endangered Species Act at 40.”

Among those stories is perhaps the most high-profile recovery: the national symbol, the bald eagle.

The eagle’s numbers in the 48 contiguous states declined from roughly 100,000 in the early 19th century to only 487 nesting pairs in 1963, according to the U.S. Fish and Wildlife website.

Several measures were taken to help the eagle, beginning with the 1940 Bald Eagle Protection Act, which made it illegal to kill an eagle. The pesticide DDT, found to have thinned the eggshells of eagles and other birds, was banned in 1972.

Still, “listing the species as endangered provided the springboard” for the U.S. Fish and Wildlife Service to accelerate recovery through captive breeding, law enforcement and nest-site protection, according to the agency’s website

Bald eagles rebounded and they now number about 10,000. The eagles were taken off the list in 2007.

The Endangered Species Act’s effect on salmon is not so clear, the Tulalips say.

Development that destroys habitat is not restricted enough to offset the losses, Williams said.

“We’re still losing habitat faster than we’re gaining it from restoration,” he said.

The problem is inconsistency in rules among various agencies involved in environmental protection, said Terry Williams, fisheries and natural resources commissioner for the tribes.

Also, because of the ESA, some habitat restoration projects have to jump through the same hoops as other construction, causing delays in measures that could help fish, Daryl Williams said.

“I kind of have mixed feelings about it,” he said.

Those restrictions may be a necessary evil, said Norberg, of the fisheries service.

For example, if creosote-soaked logs are being removed from a waterway, if it’s not done properly, it could result in creosote finding its way back into the water, “so it does as much harm as it does good,” he said.

Restrictions also can affect landowners’ use of their property. This not only angers some property owners but can defeat the intent of the law, said Todd Myers, environmental director for the Washington Policy Center, a right-leaning think tank in Seattle.

Because the law governs use of land where a listed species is found, some landowners take steps to eliminate habitat for a species on their property so it won’t be seen there, Myers said.

“You get a regulatory stick that puts landowners at odds with habitat recovery,” he said.

A better way, he said, is to reimburse landowners for measures taken to preserve or promote habitat, he said.

“That at least takes a step toward making a landowner a partner as opposed to an opponent.”

Despite the ESA’s flaws, “it is working well in terms of bringing all the various parties together to talk and to plan accordingly,” Norberg said.

The decline of the salmon might not be reversed without it, Ruckelshaus said.

“It is an extraordinarily complex problem,” he said. “But for the ESA I doubt we would have paid the attention to it we have, and I think that is absolutely necessary for it to recover.”

 

There could be happy green news hidden in the budget deal

Congress can often seem hopelessly anti-environment, what with right-wing Republican extremism, the power of extractive industries in both parties, and the rural bias of the Senate. This week is a partial exception, so savor it.

On Tuesday night, House Budget Chair Paul Ryan (R-Wis.) and his Senate counterpart Patty Murray (D-Wash.) struck a deal to fund the government through Sept. 30, 2014, and reverse some of the painful spending cuts from sequestration. The Bipartisan Budget Act does not specify how much money would go to each government program, only that $63 billion that would have been cut from federal discretionary spending over the next two years will instead be replaced thanks to some increases in fees and some cuts from other areas such as federal employee pensions. About half of the spending will go to defense, and half to domestic agencies, including environmental programs. If it passes, it will be up to the House Appropriations Committee to determine exactly which program gets what.

Environmental organizations such as the Natural Resources Defense Council are issuing statements celebrating the good news. “This is a positive first step in undoing some of the damage to national parks, clean drinking water, air pollution monitoring, and other environmental priorities,” says Alex Taurel, deputy legislative director for the League of Conservation Voters.

The celebration could be premature, though. The bill may not even pass the Republican-controlled House of Representatives. Conservatives were objecting to the deal before it had even been made, and anti-government zealots on the far right, such as the Ron Paul–affiliated Campaign for Liberty, are coming out against it.

And if it does pass, environmentalists will still have to pressure congressional appropriators to restore funding to important environmental programs. The wish list is long. Sequestration cuts have made it more difficult for state and local governments to monitor and maintain air and water quality. The Clean Water State Revolving Fund, for example, is an EPA program that gives grants to states to lend money to localities that need to make capital improvements to their drinking-water or wastewater-treatment facilities. Sequestration cuts have meant that governments are putting off these essential investments. Scott Slesinger, legislative director at NRDC, says restoring those funds and making sure that the National Oceanic and Atmospheric Administration has adequate funding are top priorities. A blunt instrument such as sequestration can be very bad for NOAA because some years it needs to make a big expenditure, such as launching a new satellite, that will pay off over many years thereafter. But a hard, low cap on that year’s NOAA appropriation means it won’t have money for other programs.

Other environmental lobbyists point to clean air monitoring as an area where they hope to partially reverse sequestration. “A big area people ought to be concerned about is air pollution,” says Taurel. “A ton of money comes from the EPA and goes out to states to measure levels of smog in the air to tell people if it’s a code red day, or code orange day, and old people, kids, and people with respiratory problems need to stay in.”

Some environmental programs are likely to fare better than others. The EPA, for example, is a terrible bogeyman in the eyes of Republicans, so it may not see much additional funding. Interior Department programs, such as national parks, are less politically polarizing.

“You’ll have hopefully less closures at national parks in 2014 than you saw in 2013,” says Taurel. In addition to national parks and monuments being closed during the recent government shutdown, many were closed during portions of the year due to lack of funds. “One message from the government shutdown is that the public cares about public lands, especially national parks,” says Athan Manuel, director of the Sierra Club lands protection program. “So in theory you would see some of those cuts restored if Republicans are looking at public opinion.”

Why the conditional? Don’t all politicians care about public opinion? Well, many congressional Republicans do not. This is a caucus that rejected gun-control measures with 90 percent public approval in the wake of a massive school shooting. House Republicans are mostly just concerned with winning over the most radical elements of their base, in order to stave off primary challenges and then coast through the general election in their safely Republican districts. But there is not an anti–national parks lobby, much less one with the awesome power of the National Rifle Association, so there is cause for hope.

Some of the $63 billion is coming from oil and gas leasing. Of course, it would be better if no such drilling occurred at all, but it was going to happen anyway. The proposed budget deal would approve a treaty between Mexico and the U.S. to divvy up offshore drilling lease revenue from the GuIf of Mexico, which would add money to the treasury. Other components of the deal, such as limiting interest payments to oil and gas companies that overpaid on leases and eliminating federal assistance for deepwater oil exploration, are actually good, if minor, steps toward removing our enormous subsidies for fossil fuels. On the other hand, the deal does not eliminate tax subsidies for the oil industry, as President Obama has requested.

It is also worth putting the budget deal in its larger, lamentable, context. This is not so much progress as it is a partial reversal of a terrible regression. The sequestration cuts in the Budget Control Act of 2011 were supposed to be so draconian that it would force the two parties to reach a big bipartisan agreement to reduce long-term deficits. The whole premise was half-baked, since at a time of fitful economic growth, high unemployment, widening inequality, and record-low interest rates on federal government borrowing, our focus should be on stimulating growth through more deficit spending, not less. Stronger growth would also reduce budget deficits in the future through higher tax revenues and lower mandatory spending on poverty-relief programs such as food stamps.

Instead of pushing hard for stimulus, Democrats caved to Republicans’ economically illiterate anti-deficit hysteria. And then they found that Republicans were unwilling to make a deal that involved any additional tax revenue, thus dooming the efforts to find a grand bargain and locking in the sequester cuts. We also suffered through a government shutdown caused by Republicans’ irrational demands that President Obama and the Democratic majority in the Senate accede to their entire agenda, as if Mitt Romney had just won the election. Both the sequester and the shutdown adversely affected virtually every environmental program. This deal between Ryan and Murray is the outgrowth of those two catastrophes, and an effort to avoid their repetition.

“We passed the political hurdle where we’re finally starting to push back against the sequester, which is great from our perspective,” says Manuel. But the 2011 budget bill locked the sequestration levels in for 10 years, making them the new baseline from which future government funding levels are negotiated. Every effort to restore or increase funding is now a huge uphill climb. “The harm is still being done,” says Taurel, “because the sequester remains in place.”

Earthquakes shake Texas town on Thanksgiving, and fracking might be to blame

Residents of a rural northern Texas area were awoken early on Thanksgiving by not one but two earthquakes. Such quakes have become alarmingly normal during the past month, and fracking practices could be to blame.

North Texas has been feeling a string of earthquakes — more than a dozen — over the past few weeks. Most have been centered around Azle, with the most recent [previous] one being on Tuesday morning. All of those quakes have registered between 2.0 and 3.6 in magnitude. Those who live in the small town have grown concerned.

Azle leaders have called on state officials to have geologists investigate the cause of these quakes. “The citizens are concerned,” said Azle Assistant City Manager Lawrence Bryant at a city council meeting. “They should be.”

“If it’s a man-made cause, it would be nice to know,” Bryant added.

 

By “man-made,” Bryant means fracking-industry-made. Frackers pump their polluted wastewater deep into the ground, a practice well known as a cause of temblors. A wastewater injection well was shut down near Youngstown, Ohio, in late 2011 after it triggered more than 100 earthquakes of growing intensity in just a year.

University of Texas earthquake researcher Cliff Frolich says the recent Texas flurry could be the result of wastewater injection. From KHOU:

“I’d say it certainly looks very possible that the earthquakes are related to injection wells,” [Frolich] said in an interview from Austin.

Frolich notes, however, that thousands of such wells have operated in Texas for decades, with no quakes anywhere near them. He adds that there are probably a thousand unknown faults beneath Texas.

Azle mayor Alan Brundrett says it’s important to determine whether this latest series of quakes are man-made.

“What could it cause, down the road?” he asked. “What if a 5.0 happens and people’s houses start falling in on them?”

Brundrett has installed an earthquake alert app on his smartphone. It shows a dozen minor quakes near his town since November 5.

The growing problem of earthquakes in America is not just limited to Ohio and Texas. The following U.S. Geological Survey graph shows how the number of earthquakes with a magnitude of at least three has spiked as fracking has become widespread. “USGS scientists have found that at some locations the increase in seismicity coincides with the injection of wastewater in deep disposal wells,” the agency notes.
