Get Real: Climate Change Scientists Cut Through Bluster in Blunt Report

Forget about reading, writing and ’rithmetic. Reality, risk and response are the new three Rs, scientists say, and the situation is dire.

The incremental changes taking place in the global climate will in the not-too-distant future add up to irreversible damage, says a new report from the American Association for the Advancement of Science (AAAS). Compiling all that is known to date about the changes taking place in Earth’s air, water and land, the U.S.’s top scientists are trying to get humanity to listen up.

“This new effort is intended to state very clearly the exceptionally strong evidence that Earth’s climate is changing, and that future climate change can seriously impact natural and societal systems,” said James McCarthy, Alexander Agassiz Professor of Biological Oceanography at Harvard University and one of three chairs of a panel that issued the 20-page report, What We Know: The Reality, Risks and Response to Climate Change. “Even among members of the broader public who already know about the evidence for climate change and what is causing it, some do not know the degree to which many climate scientists are concerned about the risks of possibly rapid and abrupt climate change.”

McCarthy is one of 13 panelists offering expertise on the matter via lectures, testimonials on a new website accompanying the report, and outreach to fellow professionals, the AAAS said in its media release.

“We’re the largest general scientific society in the world, and therefore we believe we have an obligation to inform the public and policymakers about what science is showing about any issue in modern life, and climate is a particularly pressing one,” said AAAS CEO Alan Leshner in the group’s statement. “As the voice of the scientific community, we need to share what we know and bring policymakers to the table to discuss how to deal with the issue.”

The first new R is Reality, the AAAS said.

“Climate scientists agree: Climate change is happening here and now,” the AAAS said, emphasizing that 97 percent of climate experts agree.

“The second [R] is Risk—that the reality of climate change means that there are climate change impacts we can expect, but we also must consider what might happen, especially the small, but real, chance that we may face abrupt changes with massively disruptive impacts,” the association said. “We are at risk of pushing our climate system toward abrupt, unpredictable, and potentially irreversible changes with highly damaging impacts.”

That leads to the third R.

“The third R is Response—that there is much we can do and that the sooner we respond, the better off we will be,” the AAAS said. “The sooner we act, the lower the risk and cost.”

Inaction, however, could exacerbate extreme weather conditions and cause, for example, crop failure and thus famine. Although many factors—ranging from variations in the Earth’s crust, to changes in orbit and tilt toward the sun—can cause climate changes, this time human activity is the main driver, the AAAS report said.

“Decades of human-generated greenhouse gases are now the major force driving the direction of climate change, currently overwhelming the effects of these other factors,” the AAAS report said. “Many studies show that the combined effects of natural drivers of climate cannot explain the temperature increase observed over the past half century.”

“Climate change is already happening. More heat waves, greater sea level rise, and other changes with consequences for human health, natural ecosystems, and agriculture are already occurring in the United States and worldwide,” said the AAAS report, released on March 18. “These problems are very likely to become worse over the next 10-20 years and beyond.”

Clarks Creek may provide clues to Puget Sound restoration

PUYALLUP – The Puyallup Tribe of Indians working to decrease sediment in Clarks Creek, an important salmon tributary to the Puyallup River.

“Clarks Creek is important because it supports several different species of salmon, some listed under the federal Endangered Species Act,” said Char Naylor, water quality program manager for the tribe. Clarks Creek also supports the highest salmon spawning densities in the Puyallup watershed as well as the most significant number and variety of spawning salmon within a city limits in the watershed.

“Its also important because it can be an example of how we can restore hundreds of small urban streams in Puget Sound,” Naylor said. The problems facing the Clarks Creek watershed are endemic to most Puget Sound lowland streams. The principal non-point pollutants causing degradation are excessive sediment, nuisance weed growth, nutrient enrichment and excessive bacteria loading.

“If we can tackle these issues in Clarks Creek, we can show other Puget Sound communities how to heal their streams,” Naylor said.

The tribe is leading a regional effort to clean up the creek by reducing the amount of sediment flowing into it. Too much sediment in a stream drives down salmon productivity because it impacts the fish’s ability to find clean spawning gravel in which to spawn or rear. The goal of the project is to reduce sediment loads by half and nutrient and bacteria by a third by lowering flows and stabilizing banks to reducing channel erosion.

The tribe recently finished a two-year study of sediment sources throughout Clarks Creek. The study found that if 23 major sources of sediment were repaired, over 50 percent of the creek’s sediment problem would go away. Yet by doing just the top eight bank stabilization projects, a huge amount of sediment can be removed from the stream very cost-effectively.

The tribe is putting together plans to restore two those major sources of sediment in the creek. The tribal projects would stabilize the banks of two Clarks Creek tributaries. “We would literally be changing the shapes of their banks and channels, adding gravel and planting vegetation along their banks,” Naylor said.

Other sorts of projects suggested by the study include stormwater retrofits, low impact development, and stormwater detention ponds.

Most of the creek’s sediment actually start with the river it flows into. “The Puyallup River is diked through most of its lower reach,” Naylor said. “This caused the river bed itself to drop, which means the creeks flowing into it also drop.” This down-cutting action puts more sediment into the creek than would be there otherwise.

Clarks Creek is just 4 miles long and flows through suburban neighborhoods of the city of Puyallup before joining the Puyallup River. Because it is largely spring-fed, the creek has a consistent level of water throughout the year, making it great rearing habitat for juvenile salmon. The Puyallup Tribe also operates a chinook hatchery on the creek.

“We have already begun working on implementing several of the identified sediment projects to restore the watershed almost before the ink was dry on the report,,” Naylor said. “It is satisfying to have changed the status quo, the way things have been done in this watershed over the last several decades.”

Controversial Olympic Peninsula Timber Sale Pits Environment Against Education

SEATTLE — The Washington Board of Natural Resources voted unanimously Tuesday to approve the sale of 200 acres of the Olympic Peninsula that are home to the threatened marbled murrelet. The money from the timber sale will go to the University of Washington.

200 acres might not seem like that big of a deal, but not if you ask Peter Goldman, director of the Washington Forest Law Center.

“These 200 acres are extremely important,” he said. “These lands around these timber sales are heavily used and officially mapped as occupied by the marbled murrelet.”

Goldman was referring to a rare seabird whose numbers have plummetted to the point that it’s listed as threatened under the Endangered Species Act. It nests in old-growth coastal forests of Washington, Oregon, British Columbia and California.

Goldman is working with several environmental groups, including the Sierra Club, Seattle Audubon Society, and Olympic Forest Coalition, who oppose the timber sale because it will mean clearcutting in murrelet habitat. The tracts are known as the “Goodmint” and “Rainbow Rock” timber sales, and are located on the western part of the Olympic Peninsula.

There are roughly 2,000 murrelets left in Washington and the population has been declining by up to 8 percent each year over the past decade. The birds can fly upwards of 50 miles to forage the ocean for food. For timber cutters and marbled murrelet alike, coastal forests on the Olympic Peninsula are highly desirable, and harder to come by.

Last year the University of Washington received $1.35 million from timber sales on state lands, according to the state Department of Natural Resources.

“So the question,” Goldman says, “is whether the University of Washington is really saying they want to log the last remaining habitat for the marbled murrelet for approximately $600,000.”

In an emailed statement, a spokesman for the University of Washington said: “This is the Department of Natural Resource’s decision. Some people may disagree but it is their call.”

Tom DeLuca, the director of the University of Washington’s school of Environmental and Forest Sciences, is the vice chairman of the state Board of Natural Resources, which makes decisions about timber sales. DeLuca did not vote on this particular sale and did not respond to requests for an interview.

Peter Goldmark (not Goldman) is the chairman of that board, and the commissioner of public lands for the state of Washington.

“The opponents make an emotional issue that these are the last acres available when in fact they’re not,” Commissioner Goldmark said.

These 200 acres may not be the last remaining marbled murrelet habitat but they’re part of it.

In a report released in 2008, the Department of Natural Resources identified key habitat that should be protected for marbled murrelet throughout the state. The 200 acres that are now up for sale were included in that report.

When asked about the report, Goldmark downplayed the findings.

“This is a science team report only,” he said. “It’s not proposed as a plan because, first and foremost, our major responsibility is a fiduciary interest to supply revenue for the trust beneficiaries.”

Goldmark added that the DNR has refrained from logging on thousands of acres elsewhere in the area, at a significant cost to those “trust beneficiaries” — like the University of Washington, Washington State University and public schools throughout the state, which received almost $175 millionfrom timber sales last year.

The 200 acres will be put up for sale in April. Environmental groups have indicated they will to file a lawsuit in the next 30 days.

From the Oglala Lakota Sioux on the Pine Ridge Reservation to the Rosebud Sioux and others, American Indians are standing firm against the Keystone XL pipeline, which would run through or skirt their territory if approved.

The Lakota Sioux have been pushing back against TransCanada, the conglomerate that wants to run the 1,700-mile-long pipeline from the oil sands of Alberta to the Gulf Coast of Mexico, for years. Last week the Rosebud Sioux passed a unanimous resolution against the project. And a group of American Indian tribal leaders opposing the pipeline have vowed to take a “last stand” and are working together, training opponents to put up passive resistance if it comes to that.

“We see what the tar sand oil mining is causing in Canada, we see what the oil drilling in the Dakotas is doing—as they gouge her [Mother Nature] and rape her and hurt her, we know it’s all the same ecosystem that we all need to live in,” Lakota activist and Pine Ridge resident Debra White Plume told Inter Press Service News Agency last month. “For us it’s a spiritual stand—it’s our relative, it hurts us.”

The Rosebud Sioux Tribe approved a resolution on February 25 to reject outright a document that the federal government wants the tribe’s leaders to sign saying that they have been adequately consulted according to the law.

“This Programmatic Agreement for the proposed Keystone XL Pipeline project has not met the standards of Section 106 of the National Historic Preservation Act, because the Rosebud Sioux Tribe has not been consulted,” said Council Representative Russell Eagle Bear in a statement from the tribe. “Additionally, the Cultural Surveys that have been conducted already are inadequate and did not cover adequate on-the-ground coverage to verify known culturally sensitive sites and areas.”

Keystone XL would wend its way through the Great Sioux Nation, including the lands of the Rosebud Sioux Tribe, making them the appropriate tribe to be consulted on land within Tripp, Gregory, Lyman, Todd, and Mellette Counties in South Dakota, the statement said.

“This is a flawed document and it will not be accepted,” Rosebud Sioux Tribal Council President Cyril Scott said of the federal agreement they are being asked to sign. “It is our job as the Tribal Council to take action to protect the health and welfare of our people, and this resolution puts the federal government on notice.”

It is not the first time the government has been accused of fabricating consultation. The first draft of the environmental assessment report, released a year ago, met with resistance from tribes over what they said were inaccuracies, shoddy research and incomplete consultation, among other objections.

The National Congress of American Indians (NCAI) also came out against the conclusions in the draft environmental assessment.

The U.S. Department of State is currently evaluating the final version of the environmental assessment report and accepting input from several federal agencies during a 90-day public comment period that began on January 31, when the report was issued, according to U.S. News & World Report. The State Department is also studying the consultants on the report as more and more revelations about their ties to TransCanada come to light.

Nearly 400 people, many of them students, were arrested last weekend when they chained themselves to the White House fence in protest of the pipeline, the Washington Post reported.

The Native group Moccasins on the Ground has been conducting training sessions and recently hosted a conference in Rapid City, Help Save Mother Earth from the Keystone Pipeline, to teach civil disobedience tactics.

“As the process of public comment, hearings, and other aspects of an international application continue, each door is closing to protecting sacred water and our Human Right to Water,” said Debra White Plume, a Lakota activist who lives on the Pine Ridge Reservation and has been very vocal in opposing the pipeline, in a statement from Moccasins on the Ground. “Soon the only door left open will be the door to direct action.”

Inslee Prepares To Make Moral Case For Carbon Reduction

Washington Governor Jay Inslee is preparing to take action on an issue that could secure his legacy — or complicate his re-election chances.

He wants to cap carbon, the biggest culprit in greenhouse gas emissions in Washington. It’s a controversial and potentially costly idea. But the Democrat believes long-term it’s an economic and, even, moral imperative.

An electoral mandate?

It’s no secret that Jay Inslee is passionate about combating climate change. But it was a surprise last January when Inslee’s inauguration turned into a coronation of sorts.

In the Rotunda of the state capitol, Earth Day founder Denis Hayes said, “Jay Inslee is the first political chief executive in American history to be elected principally on a platform of combating climate disruption.”

Hayes didn’t stop there.

“More than any other president or governor before him, Jay has an electoral mandate on this issue.”

Others would say Inslee has a legal mandate. By law, Washington is supposed to reduce all of its greenhouse gas emissions including carbon to 1990 levels by 2020. That’s just six years from now.

In his inaugural address, Inslee called climate change a “grave and immediate danger”

“On climate change we have settled the scientific controversy. That’s resolved,” he said to applause. “What remains now is how we respond to the challenge.”

Capping carbon emissions

It’s been more than a year since that speech. And Inslee may soon announce how to plans to respond. For months, he’s been signaling that a cap on carbon emissions is what’s needed.

“It is clear to me that in some sense, in some way we’ll need to have some restriction on carbon pollution,” said the governor Inslee at a recent news conference.

But what would that cap look like? There are any number of policies Inslee could pursue – none politically easy. Still it looks like there’s one Inslee thinks he can implement unilaterally: a low-carbon fuel standard.

But that could drive up the cost of a gallon of gas. And that concerns Republicans like state Senator Curtis King.

“You gotta look at the impact that that type of thing is going to have on how our businesses in the state of Washington can remain competitive,” says King.

Inslee promises any climate change policies he pursues will be thoroughly costed-out. But it’s the public, not lawmakers Inslee will ultimately have to convince.

Here’s one big reason why: Gasoline powered cars are the single greatest source of carbon emissions in Washington. The question is: would drivers pay more or change their behavior to reduce their carbon footprint? My informal pump-side survey at a gas station south of Olympia produced a mix of answers.

“I could pay a little more if it meant helping the environment and solving problems bit by bit, I’d definitely to that,” says Shyler Bardfield.

But Torey Krieger is wary:

“I don’t know. I would think about being more fuel efficient before increasing the price of gas.”

And then there’s Dennis Teague who definitely does not trust the governor to make these decisions.

“He better have a group of non-political scientists,” he says.

Delivering the message

The University of Southern California’s Larry Pryor, an expert on climate change communication, says that’s a really important point. Pryor believes scientists are underutilized as evangelists for policies to address greenhouse gas emissions.

“They should be organized,” he says. “They should be brought into this discussion in a big way and the public will pay attention to them.”

The challenge with carbon emissions is you can’t seem them. Pryor says that makes the role of scientists all the more important if Governor Inslee hopes to convince the public carbon emissions are a real problem.

“It’s quite rational for people to say ‘we want more proof, we want more certainty that what is being proposed to be enacted is actually going to do good.’”

Especially if it’s going to cost them more in the wallet and the benefits will be hard, if not impossible, to see.

State Senator Doug Ericksen, the Republican chair of the Energy committee, questions whether Washington should even try to meet the 1990 carbon emission levels target. That’s because about 75 percent of Washington’s energy comes from hydropower, which doesn’t have a carbon footprint.

“I mean if you compare us to Indiana or Ohio which are heavy coal states, compared to us being a heavy hydro state, we shouldn’t penalize ourselves because of our hydroelectricity,” says Ericksen.

This is where the art of persuasion comes in. Richard Perloff is the author of a book called The Dynamics of Persuasion. He says the trick for Inslee is to appeal to the public’s desire to do the right or moral thing, but to avoid coming off like a Jimmy Carter-esque moralist.

“If he can grab the moral agenda and actually talk in global terms, then he doesn’t seem like he’s self-interested and he seems something of a — to use the Michelle Obama term — a knucklehead, but a very idealistic knucklehead and people say, you know, I like this guy,” says Perloff.

Inslee’s never been short on idealism. But he’s traditionally made an economic argument for addressing climate change. Now it appears he’s ready to take a page from Perloff’s book. The governor told me recently that he’s prepared to make the moral case for capping carbon emissions.

Exploding Oil Trains Prompt More Stringent Safety Tests

The U.S. Department of Transportation has issued an emergency order requiring crude oil from North Dakota and Montana to be tested before being transported by railroads.

Tuesday’s order follows several fiery derailments involving shipments of crude oil. It is intended to ensure greater safety when the highly flammable liquid is being shipped.

Federal regulators also said Tuesday they are prohibiting shipping oil using the least-protective packing requirements.

The order is a response to derailments of trains carrying oil from the Bakken region in North Dakota that resulted in explosions and fire, including a train that exploded in Lac-Megantic, Quebec, near the U.S. border, in July, killing 47 people.

Jerry Vest, Vice President for Government & Industry Affairs at Genesee & Wyoming railroad, called the order a fundamental step to ensure safety. Genesee & Wyoming owns the Portland & Western rail line carrying Bakken crude to a terminal at Port Westward near Clatskanie, Ore. Last year, 110 unit trains carried Bakken crude to Port Westward, each one carrying about 70,000 barrels.

Vest clarified that the commodity would be tested not by the railroads but by companies using the railroads to ship the oil.

Sen. Ron Wyden, D-Ore., said the new rules will help, but won’t eliminate the risks posed by oil-by-rail shipments.

There is far more work to be done on securing the safety of oil trains, but this is one step of many that can be part of a solution,” Wyden said in a written statement.

Shippers already had to classify oil shipments based on their risk for explosion or fire, but federal investigators found that many shipments were being misclassified as less dangerous. The order requires testing for classification before shipment.

Jay Tappan, Chief of Columbia River Fire and Rescue, said his department has been waiting for stricter federal rules to help his responders know how to handle an oil train fire.

“I think we’re all finally starting to understand that the Bakken crude is a little bit more volatile, little more flammable than we had thought before so it’s good that they’re getting a handle on the exact classification of that commodity,” Tappan said.

Better classification of the Bakken crude was one of many issues raised at a January meeting between railroads, first responders and Oregon senators Ron Wyden and Jeff Merkley in Portland. Local responders and state spill and emergency planners had previously received little information from railroads and oil companies about shipments of crude oil through their areas.

Tappan’s is one of many fire departments in the Pacific Northwest preparing for the risk of an oil train derailment. A port in Oregon and five refineries in Washington currently accept rail shipments of crude oil. Several other shipping terminals have been proposed in the region.

Corps Announces The Scope Of Longview Coal Export Review

The U.S. Army Corps of Engineers has announced which environmental impacts it will consider in its review of the Millennium Bulk Terminals coal export project in Longview, Wash.

The Millennium project would export 48 million tons of coal a year to Asia. It would ship the coal by rail from Montana and Wyoming to a terminal in Longview, where it would be loaded onto vessels and sent overseas.

In a 12-page memo, the Corps on Tuesday outlined which parts of that process it will consider in reviewing the project’s environmental impacts to the air, water, wildlife and people.

Despite requests from the public to include broader impacts of mining, shipping and burning the coal, the Corps is limiting the scope of its environmental review to the project site.

Washington state recently announced it will include a wider array of environmental impacts in its review of the project.

The decision comes after public agencies collected more than 200,000 comments from the public. Many people asked the Corps to consider the impacts of railroad traffic congestion along the entire delivery route, as well as the pollution created by mining the coal and burning it in power plants overseas.

But in its memo, the agency says:

“Many activities of concern to the public, such as rail traffic, coal mining, shipping coal and burning it overseas are outside the Corps’ responsibility.”

Instead, its environmental review will be limited to the 190-acre project site and the immediate vicinity around Longview. It includes about 50 acres of the Columbia River, where the project would build piers and dredge for ships.

In addition to environmental impacts, the review will also look at the jobs and tax benefits created by the project as well as the demand on public services and utilities.

When the Corps completes its review, the public will be invited to comment on a draft document. A final environmental impact statement will outline what the developer needs to do to offset the impacts of the project.

In September 2013, U.S. Army Corps of Engineers announced split from what was to be a joint review process. They will conduct a “separate but synchronized environmental review and public scoping process.” The corps’ review will be narrower in scope than that of Washington state. The Salish Sea is one of the world’s largest and unique marine water inland seas. It is home to the aboriginal and treaty tribes of the Northwest whose shared ecosystem includes Washington State’s Puget Sound, the Strait of Juan de Fuca, the San Juan Islands, British Columbia’s Gulf Islands and the Strait of Georgia.

In December 2013, Kinder Morgan, the third largest energy producer in North America, filed an application with the National Energy Board (“NEB”) of Canada to build a new pipeline to transport additional crude oil from the tar sands of Alberta to Vancouver, B.C., where it will be put on tanker vessels and shipped to Asia. The NEB is the Canadian federal agency that regulates energy.

If approved, the proposal would result in expanded transport of crude oil from approximately 300,000 to 890,000 barrels per day. This is a 200 percent increase in oil tanker traffic through the waters of the Salish Sea. Vessel groundings, accidents, leaks, and oil spills are not only possible, they are inevitable.

New jobs and economic growth are being touted as incentives to justify the expansion of the Northwest as the “gateway to the Pacific.” But good fishing and tourism jobs will be lost that depend on a healthy and intact environment. If these projects are approved, the potentially catastrophic effects to our environment and cultural resources will put our Northwest way of life in jeopardy.

In addition to the Kinder Morgan proposal, other port projects and expansions seek to increase the cumulative export of raw fossil fuels from the Salish Sea region to the Asian Pacific and beyond.

As the first peoples of the Salish Sea, it is our responsibility to ensure that our ancestral fishing and harvesting grounds are not reduced to a glorified highway for industry. Each of these proposals represents a potential new threat to our treaty rights in the traditional fishing areas of the Coast Salish tribes and nations. These are rights that the United States promised to protect when they signed treaties with the tribes, recognizing our inherent right to fish “at usual and accustomed grounds and stations.” (1855 Treaty of Point Elliott, Article 5.)

Our relatives to the east, on the sacred Columbia River, are fighting similar battles against dirty fuel projects that threaten to pollute their lands and waters. The Nez Perce stand firm on ensuring that this unique area of the country and tribal homelands are not transformed into a “mega-load” industrial corridor.

Other Columbia River tribes, including the Yakama, Umatilla, and Warm Springs all stand with the Nez Perce to fight for their traditional fishing grounds on the Columbia River and its tributaries. Multiple energy export proposals, up and down the river, threaten to choke the very life from a once bountiful traditional fishing ground. Coast Salish tribes link arms with their cousins along the Columbia.

On February 11, 2014, the undersigned tribes and nations collectively filed for official intervener status in the National Energy Board (NEB) of Canada’s hearing process that decides whether or not to approve Kinder Morgan’s application. This will allow us to present our story, offer evidence and studies documenting impacts on our way of life, and ask important questions during the hearings to ensure the panel receives all the information needed to make an informed decision.

The Coast Salish will fight for our treaty rights, our culture, and our way of life. If protecting our homelands and cultures means standing up against Kinder Morgan’s TransMountain Pipeline, and other proposals that endanger our region, we will most certainly do so. It is our sacred duty to leave future generations a healthy world.

If our children and our children’s children are to know the taste of wild salmon, and the ancient calling of the Salish Sea, we must stand up. The Coast Salish peoples have a saying, “from white caps to white caps,” which means from the snowy peaks of our mountains to the foam-capped waves of our seas, this is our world.

We issue a call to all Native Americans, First Nations relatives, and to all people who love the Salish Sea to please stand with us to protect our rights, our health, and our children’s future. It is our generation’s time to stand up and fight. What happens to the Salish Sea happens to our peoples, and to all those who call this unique place home.

“When all the trees have been cut down, when all the animals have been hunted, when all the waters are polluted, when all the air is unsafe to breathe, only then will you discover you cannot eat money,” according to Cree prophecy.

Megaloads go to court

Lawsuit questions whether transport is more good than harm

PENDLETON, Ore. — A third and final shipment of massive oil refinery equipment is bound for Canada after departing the Port of Umatilla earlier this week. But while the convoy lumbers south on Highway 395, opponents representing environmental and tribal concerns filed a petition in Marion County Circuit Court that would keep future loads off the road without increased public input.

Petitioners Peter Goodman, with the nonprofit organization Act on Climate, and Carl Sampson, headman-chief of the Walla Walla Tribe, allege the Oregon Department of Transportation didn’t properly consider public interest when permitting the loads hauled by Hillsboro trucking company Omega Morgan.

State law allows ODOT to issue variance permits for oversize loads “if it determines the public interests will be served.” Yet the department declined to hold public hearings, provide notice or allow any opportunity for comments, according to the petition.

If the petitioners succeed, a judge would order ODOT to set aside permits for megaloads until determining actual public interest. Goodman and Sampson are also asking for a permanent injunction against new variance permits until the department establishes rules for public involvement.

Patrick Cooney, ODOT communications director, did not discuss litigation but said the agency issues 100,000 permits every year. In broad terms, public interest is served by allowing movement of freight and commerce across the state, he said.

“We do that in such a manner that there’s no damage caused to the system by oversize loads,” Cooney said.

The petitioners, however, claim it is not enough to find something in the public interest by only examining potential damage to highways. It requires that, overall, more good than harm is done as a result of the loads.

Megaloads will eventually supply the tar sands of Alberta, Canada with machinery necessary to extract and ship oil, Goodman said, leading to global climate change.

“The cargo is so damaging to the environment,” he said. “The end result for climate change is really disastrous.”

At approximately 400 feet long, 22 feet wide and weighing more than 900,000 pounds, the megaloads take up both lanes on two-lane highways and are too big to fit under interstate bridges. The route being used now instead runs indirectly south into the John Day Valley and east toward Homedale, Idaho, before cutting back north through Montana and into Canada.

The loads travel approximately 35 mph, and are not permitted to drive in hazardous weather. Numerous delays have already slowed the first two shipments, which Omega Morgan began moving in December.

Protesters also held several demonstrations throughout the region, resulting in some arrests.

In addition to increased carbon emissions from tar sands oil, members of the Confederated Tribes of the Umatilla Indian Reservation oppose megaloads on their ceded territory.

Sampson — known ceremonially in the Walla Walla Tribe as Peo Peo Mox Mox, or Chief Yellowbird — asked how decades of government-to-government relations can simply be ignored to accommodate these loads in his affidavit to the court.

“Help me understand why we, the people of this land, have not had voice on such an important matter,” Sampson said. “The simple passage of these loads alone is an affront to the traditional values and ecological integrity of the lands I have been stood up by my people to protect. We have a strong tribal culture that will suffer irreparable damage if the megaload is not stopped.”

Omega Morgan project manager Erik Zander has said there is no plan to use the route as a long-term industrial corridor through Oregon. Goodman said they remain concerned about the possibility, especially as oil sands deposits are developed in Utah.

That’s why the public needs a voice in the ODOT permitting process, he said.

“We feel the citizens of Oregon should have a say,” Goodman said. “It is not worth risking planetary climate chaos for profit for relatively few people.”
