Cruise to Set Sail to Investigate Ocean Acidification

The waters off the Pacific Northwest are becoming more acidic, making life more difficult for the animals that live there, especially oysters and the approximately 3,200 people employed in the shellfish industry.

Researchers from the National Oceanographic and Atmospheric Administration (NOAA) will set sail Monday (July 29) on a monthlong research cruise off the U.S. and Canadian West Coast to see how ocean acidification is affecting the chemistry of the ocean waters and the area’s sea life.

Ocean acidification occurs when greenhouse-gas emissions cause carbon dioxide to accumulate in the atmosphere and become dissolved in sea water, changing the water’s chemistry and making it more difficult for coral, shellfish and other animals to form hard shells. Carbon dioxide creates carbonic acid when dispersed in water. This can dissolve carbonate, the prime component in corals and oysters’ shells.

The world’s oceans are 30 percent more acidic than they were before the Industrial Revolution, scientists estimate.

This cruise follows up on a similar effort in 2007 that supplied “jaw-dropping” data on how much ocean acidification was hurting oysters, said Brad Warren, director of the Global Ocean Health Partnership, at a news conference today (July 25). (The partnership is an alliance of governments, private groups and international organizations.)

That expedition linked more acidic waters to huge declines in oyster hatcheries, where oysters are bred, Warren said. Oyster farms rely ona fresh stock of oysters each year to remain economically viable.

When the data came in from that cruise, it was “a huge wake-up call,” Warren said. “This was almost a mind-bending realization for people in the shellfish industry,” he said.

The new cruise will also look at how acidification is affecting tiny marine snails called pteropods, a huge source of food for many fish species, including salmon, said Nina Bednarsek, a biological oceanographer with NOAA’s Pacific Environmental Marine Laboratory.

The research will take place aboard the NOAA ship Fairweather, which will depart from Seattle before heading north and then looping back south. It will end up in San Diego on Aug. 29. During this time, scientists will collect samples to analyze water chemistry, calibrate existing buoys that continuously measure the ocean’s acidity and survey populations of animals, scientists said.

The researchers will also examine algae along the way. Ocean acidification is expected to worsen harmful algal blooms (like red tide), explosions of toxin-producing cells that can sicken and even kill people who eat oysters tainted with these chemicals, said Vera Trainer, a researcher at NOAA’s Northwest Fisheries Science Center.

Undercover police crash anti-shale gas press conference, activists remain in woods along ‘Line 5′

Yesterday, Upriver Environment Watch called a press conference at the Super 8 motel in Dieppe, New Brunswick. Attended by about 50 people, including 4 representatives from the media, the anti-shale gas action group from Kent County hosted a panel of speakers with a variety of expertise and experience.

“Impunity is the word we’re working with today,” said Anne Pohl, host of the press conference.

Pohl had, on July 19th, sent an open letter to New Brunswick Premier David Alward. The letter was at once an invitation to Alward to attend the press conference (neither he nor any member of his caucus attended) as well as a point by point description of the experienced hardships that those continuing to call for a moratorium on shale gas exploration in New Brunswick have experienced in their dealings with the RCMP, SWN Resources Canada as well as their elected government representatives.

If there was a continuous thread to the press conference, it was a general sense of frustration.

“We feel it is time for your government to stop directing the RCMP to harass us and to throw us in jail,” read the open letter to Premier Alward from the Upriver Environment Watch.

“It is time for your government to start talking with us. We have been trying to communicate with you for a long time. We have tried petitions, letters, requests for meetings, protests and everything else we could think of to get your attention. Your avoidance of us has been complete. We are extremely disappointed in your government’s failure to respond and acknowledge our concerns. We ask for you to respect and recognize the legitimacy of our concerns.

Chris Sabas, one of two members of the Christian Peacemakers Team that has been invited to document the anti-shale actions by Elsipogtog War Chief John Levi, was the first presenter. Her information focused on her recent excursions visiting post-testing areas along ‘Line 5′, the backwoods seismic testing line that has for weeks now been the focus of SWN Resources Canada’s testing efforts.

Sabas’ had photographic evidence of unplugged ‘shot holes’, as well as disturbing photographs of animal tracks that she noted appeared in large numbers around post-explosion zones.

Willi Nolan, a long-time resident of Kent County, as well as a member of Upriver Environment Watch, focused her presentation on the dangers of the chemicals already being used in SWN’s exploration processes.

Nolan noted that while information was not readily available, SWN was most likely using a TNT explosive to detonate it’s shot holes. Having already detonated dozens of shot holes throughout the backwoods along ‘Line 5′, Nolan noted that there was no evidence of independent monitors looking after post-testing zones.

Celianne Cormier, another lifelong resident of Kent County, recounted her personal story of being bullied by SWN and Stantec Engineering when it came time for her water to be tested leading up to testing in 2011.

Cormier related a situation where it did not appear that Stantec, ostensibly a third party independent water testing company, was acting at an arm’s length from SWN, the company required to do the water testing. In fact, every time a “water tester” called the Cormier residence, she noted that they claimed to be calling on behalf of SWN. Cormier felt increasingly skeptical when water testers consistently refused to produce identification that they were in fact Stantec employees.

“Why were the callers introducing themselves as calling from SWN and why was SWN calling the shots if the testing was being done by an independent or third party?” asked Cormier. “I lost all confidence in the process, I felt violated and bullied because I felt I was not asking for anything special. In fact I felt I was only insisting on the world class safe ans secure practices as promised by our provincial government.”

Ann Pohl spoke about the difficulty of having the concerns of the citizens of New Brunswick properly heard and represented by a mainstream media almost completely controlled by the powerful Irving empire. Pohl noted that Irving, who stands to benefit from shale gas extraction  in any number of ways; from trucking, to shipping, to processing, and on, was knowingly marginalizing the message of those opposed to shale gas extraction, often framing it as a ‘Native issue’.

After fielding questions from the media, the press conference then turned into an open forum, with various concerned citizens from around the province voicing their concerns about the increasingly obvious signs of industrial hostility, whether in disregard for the natural environment, complicity with law enforcement bodies, both public and private, and lack of concern from elected officials.

As if on cue, as one woman was describing the difficulties of trying to continue to live alongside a pot ash mine in Penobsquis, it became apparent that two undercover RCMP officers had been taking notes throughout the entire press conference. When asked what they were doing, constable Dave Matthews noted that he was taking notes on “the mood” of the press conference. When cameras were trained on the officers, they quickly fled the conference.

Rogersville heats up

It may well be that the blatant disrespect of laying seismic testing equipment immediately adjacent to a cemetery where family members and war veterans lie has begun to galvanize Rogersville’s Acadian population into action.

Today, only two days after the RCMP lied to activists attempting to park on parish land adjacent to their cemetery, telling those attempting to gather that it was private property, an emboldened crowd of about 60 Acadians, Anglophones and Indigenous people – united in their purpose – gathered in the pouring rain next to an active testing line.

Fearless of the potential danger of un-exploded ordinance, a number of people ventured southward down the active testing line, heading away from Pleasant Ridge Road towards Salmon River Road. With the constant hum of a helicopter transporting bagged geophones as a backdrop, activists wandered the freshly cut seismic line. Many noticed the presence of traditionally used medicinal plants growing directly next to un-detonated shot holes.

While most people exited the seismic test line by nightfall, as of press time an unknown number of individuals remain in the woods near the ordinance.

Biofuels and biomass lose favor: Investors beware!

Having spent the past eight years or so of my life fighting back against large-scale commercial and industrial bioenergy, it feels good to finally see the tides turning, albeit slowly, maybe not always for the right reasons, and perhaps too little too late. But consider that in just the past two weeks there have been some remarkable signs that awareness is growing and policies may be slowly shifting. A few examples:

The DC Circuit Court of Appeals ruled against the EPA, stating the agency has no basis for a three-year deferral that would have exempted CO2 from “biogenic” sources (ethanol, biomass, municipal wastes, landfill gases) from greenhouse gas regulations under the Clean Air Act.

The European Union Environment committee voted to cap the percentage that biofuels made from food crops can contribute to their overall target. They also voted to consider default value “ILUC” (indirect land use change) factors in determining the emissions from biofuel production. While these fall far short of the strong steps needed to stem the tide of destruction caused by EU bioenergy policies, they do at least reflect some glimmer of changing opinion.

A growing chorus of voices in the U.S. is calling to cut back the Renewable Fuel Standard. A Senate bill to repeal the mandate was recently introduced. Those calling for repeal may not have the protection of the environment in mind — they include American Petroleum Institute and their ilk, as well as livestock producers and grocery manufacturers contending with rising costs of corn and soy.

More locally, a long-fought battle against the “Pioneer” biomass incinerator in Greenfield Mass., ended in victory for residents who favor clean air and healthy forests over false solutions. Several other biomass incinerators in the state have already been halted or are on hold after regulations were tightened last year.

A judge in Maricopa County Arizona ruled that burning garbage is not “renewable” energy and thus ineligible for subsidies.

And…

Ten-thousand Chinese citizens took to the streets to protest one of the five waste incinerators proposed for Guangzhou, citing threats to their children’s health.

The food crisis helped bring to light the foolishness of using food to fuel cars. We still hear endlessly repeated the simplistic view that the problem will be solved simply by shifting to non-food crops, eventually, if we can figure out how. But common sense tells us that land, water, and fertilizers are all needed whether the crop is edible or not. And those are in ever shorter supply. Meanwhile, as we are plummeting deeper and deeper into climate and weather extreme chaos, the protection of forests and ecosystems, is urgent. Cutting, burning, and clearing our forests and fields to supply massive quantities of plant materials to electric utilities and refineries appears ever more ludicrous and misguided. Think ancient Mayan civilization collapse.

Will visitors from another world sometime in the future arrive here, piece together what happened and marvel at the idiocy that permitted a species to first contaminate its’ life-sustaining atmosphere by burning fossil fuels and digging up and deforesting the landscape — and then tried to remedy the situation by burning what remained?

Let’s hope the story has a happier ending.

Chilean court sides with Indigenous Diaguitas, blocks world’s largest gold mining company

A Chilean appeals court ruled against the world’s largest gold mining company on Monday, favoring Chilean Indians who accuse Barrick Gold Corp. of contaminating their water downstream and creating more doubts about the future of the world’s highest gold mine.

The judges in the northern city of Copiapo unanimously ruled that Barrick must keep all its environmental promises before moving forward with construction of the Pascua-Lama mine at the very top of Chile’s mountainous border with Argentina. They also said Barrick must monitor the condition of three glaciers next to the mine project.

Chile’s environmental watchdog agency already ordered construction stopped until Barrick builds systems to keep the mine from contaminating the watershed below, and Barrick executives have publicly committed the company to fulfilling the requirements of its environmental permit.

But Monday’s ruling goes beyond that by demanding repairs to damage in the watershed below, by calling for increased monitoring of the impact on surrounding glaciers, and by opening up the project’s environmental license for review. The judges found no evidence of contamination due to mine construction, but said the watershed could face “imminent danger” without more environmental protections.Attorney Lorenzo Soto, who represents about 550 Diaguita Indians in the case, said this review might even kill the $8.5 billion mine, which has been under development for more than seven years. “The project’s conditions aren’t the same as they were in 2006. New conditions could be established, and we don’t discard any scenario, including the closing of the project,” Soto said.Scarce river water is vital to life in Chile’s Atacama Desert, and the Diaguitas fear that the Pascua-Lama mine above them is ruining their resource.Barrick acknowledged the ruling in a statement late Monday that did not say whether or not the company would appeal.

The company said it “is committed to diligently working to complete all of the projects the regulatory requirements” and is working with Chile’s environmental regulator to construct a water management system by 2014, after which time it expects to renew construction on the actual mine.

Still, the ruling could mean more lengthy delays for the binational mine, which was initially expected to be producing gold and silver already. While Argentine officials are eager to keep building, most of the ore is buried on the Chilean side. On the Argentine side, where Barrick fuels a third of San Juan province’s economy, officials have been watching closely and trying to figure out how to preserve thousands of jobs.

Barrick’s stock traded up slightly Monday at $15 a share after reaching near-historic lows due to falling gold prices and Pascua-Lama setbacks.

Lac Courte Oreilles Band to expand mining protest camp

Members of the Lac Courte Oreilles Band of Ojibwe Indians will expand a camp being used to protest a huge mine development in northern Wisconsin:

Tribal Elder Melvin Gasper is organizing the five acre site so they can hunt, fish and gather food as well as educate the public. Now, he wants the five acres to become 35 acres, adding room to harvest maple syrup. “We’re going to have two different maple sugar processes going on,” says Gasper. “We’re going to show people how — in just one little area — what it’ll produce and how we could use this one little area to make more money than GTAC’s planning on paying.” Gasper says this is their way of occupying an area where an open pit iron ore mine is proposed by Gogebic Taconite. He plans to keep it occupied until 2018.

Fighting Mines in Wisconsin: A Radical New Way to Be Radical

A brand new tribe is emerging in Northern Wisconsin. Enrollment requirements for the Penokee tribe are stringent, according to Paul DeMain, co-founder of the Penokee Hills Harvest Camp—they require all members prove they are at least 70 percent water.

Water, the element that unifies all human life, is the binding force behind a surprising coalition of people and organizations near the Great Northern Divide in the Penokee Hills. Although many of these people have had opposing philosophies regarding economic development, they are united in their desire to ensure clean water. Public concern over the impact on the water and environment of a proposed 4.5 mile wide open-pit iron ore mine is creating a whole new tribe and new way to protest. The fictitious, allegorical Penokee Tribe effectively includes all human beings since everyone needs water to survive. The Harvest Camp and inclusive nature of other groups protesting the mine underscores this binding fact. More than a simple protest by occupation, the residents and supporters of the camp demonstrate and include visitors in traditional plant gathering and preparation. The goal is to instill awareness of the natural resources of the area and how they would be affected by the mine.

Despite opposition from citizens, tribes and environmentalists, Wisconsin’s Republican-led legislature passed a mining bill in March that substantially changed the state’s mining regulations. The bill, which was created with major input from Gogebic Taconite lobbyists, streamlines the mining permit process and weakens environmental protections as well as the responsibilities of mining companies to surrounding communities for damages to infrastructures or property. Gobegic Taconite (GTAC) is doing exploratory drilling in the Penokee Hills in order to get samples of iron ore to submit to the Wisconsin Department of Natural Resources to gain permission to proceed with the mining process. If approved, GTAC can then proceed with “mini-mining,” a greater sampling process of about 10,000 tons of rock that would be extracted with explosives.

Recently, groups opposing the mine have taken a novel approach to building support and awareness of this issue. Instead of picketing, they began by educating county board members and talking neighbor-to-neighbor about the real human and community costs of such a mine.

Mining has been pitched in the state as job-creator for the economically strapped northern region of the state, notes citizen journalist Barbara With, a resident of Madeline Island. She and several tribal and citizen groups have worked together to steer the public discussion in another direction. “Instead of jobs, jobs, jobs, we’ve gotten people to begin talking about water, water, water,” she explains.

In June 2013, the Ashland County board, closest local governing authority to the proposed mine, voted to create county mining regulations that require mining companies to obtain special use permits and deposit copy00,000 in a county fund to address problems such as noise, dust, damage to public roads, etc. Further, the county requires mining companies to maintain the fund at $50,000, and make additional payments as needed. Formerly, Ashland County had been an ardent support of the mine.

According to With, the change in attitude by board members was the direct result of grassroots education efforts about the real economic, quality of life and environmental impact of the mine. She credits the more inclusive, educational efforts by tribes and advocates in the area with this change. For instance she noted that last year the Bad River Band of Ojibwe began inviting non-reservation residents to their monthly potlucks that are organized to educate and share information about the potential impact of the mine. The Harvest Camp is also welcoming to the public. More than an occupation alone, the Camp residents and supporters work to inform visitors about the potential impact of mining on the natural habitat. They do this by actively including visitors in traditional harvesting and cooking methods.

With did a risk management presentation to the Ashland County board that included factual information about how businesses need to create risk management plans in order to protect themselves. “I personally went from a combative relationship with the board to one of support and looking at ways I could support and educate them,” she says.

In February, the Lac Courte Oreilles (LCO) Band of Wisconsin Ojibwe helped created a unique way to draw public attention to the role the Penokee Hills plays in the health of the region by building a Harvest Camp not far from the proposed mining site. An 1842 treaty guarantees hunting, fishing and harvesting rights on ceded territory in the northern third of the state where the Penokee Hills are located. The site of the Harvest Camp is especially important for Wisconsin’s six Ojibwe bands since the area formerly contained almost 200 Indian allotments in the late 1800s that were stolen from Indians in favor of wealthy investors of the original shaft mining in the area. The camp will be open for hunting, fishing, harvesting (wild rice and maple syrup) and public recreational use as defined by treaty and public laws. The public is invited to pitch tents at the camp, join guided tours to the GTAC sample drilling site and participate in the traditional learn.

Residents of the camp are conducting demonstrations to youth and visitors about sustainable harvesting of plants, animals and medicines and in the process drawing attention to the role that clean water plays in a healthy environment. LCO elder Marvin Gasper told Wisconsin Public Radio WPR, “This is a brand-new way [to protest]. It’s a peaceful manner in which we are using a harvest area and showing what can be taken out of this and be saved.”

According to Demain, the camp is immensely popular, drawing visits from racially and socially diverse people. “Grandmothers, kids, county supervisors, journalists are visiting the camp to learn what is going on here,” he says.

Camp leaders also guide visitors to view GTAC’s exploratory drilling sites.

In describing the tribe’s motivation for supporting the Harvest Camp, its website says, “Any activity, mining or otherwise, that threatens water must be the subject of careful and thorough scrutiny so a healthy decision can be made.”

“The water is sacred to our people and vitally important to the survival of all the people in Northern Wisconsin,” says Gordon Thayer, Lac Courte O’reilles (LCO) tribal chair.

Iron County, partially affected by the mine, is also considering passing mining regulations similar to those of Ashland County. A rally is planned for July 1 in Hurley, Wisconsin to draw attention to a public information meeting held by the Zoning Commission about the proposed regulations. The Zoning Commission will pass their recommendations on to the Iron County board that plan to vote on passage of the regulations as soon as this week.

In the past, many Iron County residents and leaders were staunch supporters of mining, especially for its potential of bringing in new jobs. George Myer, former Wisconsin Department of Natural Resources secretary and current executive director of the Wisconsin Wildlife Federation, recently spoke to citizens in Iron County about the need for county level mining regulations.

He explained that the mine would represent a permanent land use change to the county and that local governments need ordinances to protect the property rights of its citizens and to protect taxpayers from shouldering the short- and long-term costs of a mine not covered by state law.

The public discussion about mining is definitely changing in Northern Wisconsin. On June 21, the Ashland Daily Press reported that Ashland County board chairman Pete Russo who represents the city of Mellen (the closest town to the mining site) said, “There are a lot of people with concerns on impacts [of the mine] on property values. They want guarantees on the water. We need that copy00,000 [from GTAC]. Nobody else will take care of us.”

Such sentiments represent a huge turnaround from 2011, when the board voted unanimously in support of the mine.

GTAC spokesman Bob Seitz told the Milwaukee Journal-Sentinel that such county ordinances were unnecessary and may be impossible to meet since state regulations were already in place. In describing Ashland County’s recently passed mining regulations he said, “What they passed is an open checkbook. There is no limit to what the company would have to pay.”

Frank Kuehn, president of the Penokee Hills Education Project, and others opposed to the mine are skeptical about GTAC’s hints at discontinuing their plans. “I’m not convinced of anything that comes out of GTAC’s mouth. They’ve threatened to leave in the past. At one point they closed their offices but never really left. They may be trying to wait us out.”

In a June 22, 2013 interview with the Cap Times of Madison, With said, “Everybody who thinks this mine is good has been completely hoodwinked, and people in Iron County are waking up to it,” With says. “The tide has really turned up here.”

Quebec rail disaster shines critical light on oil-by-rail boom

(Reuters) – The deadly train derailment in Quebec this weekend is set to bring intense scrutiny to the dramatic growth in North America of shipping crude oil by rail, a century-old practice unexpectedly revived by the surge in shale oil production.

At least five people were killed, and another 40 are missing, after a train carrying 73 tank cars of North Dakota crude rolled driverless down a hill into the heart of Lac-Megantic, Quebec, where it derailed and exploded, levelling the town centre.

It was the latest and most deadly in a series of high-profile accidents involving crude oil shipments on North America’s rail network. Oil by rail – at least until now – has widely been expected to continue growing as shale oil output races ahead far faster than new pipelines can be built.

Hauling some 50,000 barrels of crude, the train was one of around 10 such shipments a month now crossing Maine, a route that allows oil producers in North Dakota to get cheaper domestic crude to coastal refiners. Across North America, oil by rail traffic has more than doubled since 2011; in Maine, such shipments were unheard of two years ago.

“The frequency of the number of incidents that have occurred raises legitimate questions that the industry and government need to look at,” said Jim Hall, managing partner of consultants Hall & Associates LLC, and a former chairman of the U.S. National Transportation Safety Board.

“The issue here is: are they expanding too rapidly?” he said. “Are they in a rush to accommodate and to make the economic advantage of carrying these?”

MUCH AT STAKE

There are many unanswered questions about the Quebec disaster that will likely shape the public and regulatory response, including why a parked freight train suddenly began rolling again, and why carloads of crude oil – a highly flammable but not typically explosive substance – caused such widespread disaster.

“There may have been some vapours, maybe? I don’t know. We don’t know exactly what happened,” Edward A Burkhardt, chairman of Montreal, Maine & Atlantic Railway, said in an interview on Saturday when asked about why the tankers may have exploded.

Apart from the human toll, the disaster will draw more attention to environmental risks of transporting oil.

Much is at stake: Oil by rail represents a small but important new source of revenue for big operators like Canadian Pacific Railway Ltd (CP.TO: Quote, Profile, Research) and Warren Buffett’s BNSF, which have suffered a drop in coal cargo. It is also a flexible and cheaper option to more expensive European or African crude for refiners like Irving Oil, which confirmed on Sunday that the train was destined for its 300,000 bpd plant in Saint John, New Brunswick.

And for producers like Continental Resources Inc (CLR.N: Quote, Profile, Research) which have pioneered the development of the Bakken fields in North Dakota, railways now carry three-quarters of their production; new pipelines that can accommodate more oil are years away.

Saturday’s train wreck may also play into the rancorous debate over the $5.3 billion Keystone XL pipeline from Canada to the U.S. Midwest, which is hinging on President Barack Obama’s decision later this year.

Obama said last month that approval for the line would ultimately depend on its impact on carbon-dioxide emissions. An earlier draft report from the State Department suggested that rejecting the project would not affect emissions because crude would still be shipped by rail.

As a result, the incident may strengthen the resolve of those opposed to the Keystone pipeline rather than soften resistance. The oil industry at large is already broadly supportive of both rail and pipeline transport.

“Committed critics … could conceivably seize upon the Lac-Megantic incident – in tandem with recent pipeline spills – to argue against oil production, irrespective of its mode of transport,” said Kevin Book, managing director of Research at ClearView Energy Partners.

MOVE IT BY RAIL

The railway industry has this year mounted a more robust effort to counter the suggestion that rail is a riskier way to transport crude than pipelines.

The American Association of Railroads has declined to comment on Lac-Megantic, but previously said its spill rate – based on the number of gallons of crude oil spilled versus every million miles of transport per barrel – is less than half that for pipelines.

The AAR also said the number of train accidents involving the release of hazardous material has dropped by 26 percent since 2000, and by 78 percent since 1980.

Since the beginning of the year, U.S. railroads moved nearly 360,000 carloads of crude and refined product, 40 percent more than in 2012, according to the AAR. In Canada, year-to-date traffic is up 24 percent.

With that growth has come a number of high-profile spills and accidents, many on Canadian Pacific Railway’s network, which runs through Alberta, the largest oil exporter to the United States, and the Bakken field.

Canadian Pacific suffered the industry’s first serious spill in late March, when 14 tanker cars derailed near Parkers Prairie, Minnesota, and leaked 15,000 gallons of crude. Regulators have not released the results of their investigation into the incident, and Canadian Pacific declined to comment.

Even before Saturday’s disaster, the practice of shipping oil by rail was stirring opposition in Maine.

“It’s a wake-up call of the worst kind,” said Meaghan LaSala, an organizer with 350 Maine, a group that opposes the hydraulic fracturing – or “fracking” – technology that makes shale production possible. “They say rail is the safest method, but there simply is no guaranteed way to transport such highly toxic and explosive materials.”

TOO SOON TO SAY

Many observers say it is too soon to say if the Lac-Megantic disaster will quell the crude-by-rail boom. Refiners not connected to the Midwest pipeline network will still use rail to access the cheapest crudes.

“On the face of it this should be a boost for pipeline solutions, especially given the improvements in pipeline technology over the past five decades,” said Ed Morse, managing director of commodity research at Citi Group.

But he and other analysts noted that not every devastating tragedy leads to new policy.

“We need all forms of transportation for oil, whether they’re rail, whether they’re pipeline, and no system is failsafe,” Charles Drevna, president of American Fuel and Petrochemical Manufacturers, said in a phone interview.

For Montreal, Maine & Atlantic Railway, crude oil shipments are a relatively new phenomenon. With just 510 miles of line, the small railway primarily carried paper and forest products until the financial crisis, and had suffered in the years after until the shale boom came along.

In the first four months of the year, it carried about 16,500 barrels per day (bpd) of crude, 10 times more than a year before and up from zero in early 2011, according to data from the Maine Department of Environmental Protection.

“In the 10 years or so we’ve been in business, this is the only serious derailment we’ve ever had,” Burkhardt told Reuters in the interview.

Henry Posner III, a former business partner who invested with Burkhardt in a railroad in Estonia, said he could not recall any incidents similar to what happened in Quebec during the 5-1/2 years they were in business together.

“Safety is the most important component of railway culture in North America and that’s one of the things we’re most proud of having exported to Estonia,” said Posner, who chairs Railroad Development Corporation, a Pittsburgh-based company that invests in railroads.

AZ Sen. Jackson Becomes a Native Voice on Keystone XL Pipeline

Arizona Democratic Sen. Jack Jackson Jr., Navajo, is resigning his post to work as a tribal liaison on environmental issues for the federal government.

Jackson had served one previous term in the state legislature between 2003 and 2005, overlapping with his father, Sen. Jack C. Jackson Sr., who served between 1985 and 2004. They became the first father and son to serve together in the Arizona State Legislature.

But the younger Jackson declined to seek re-election in 2005, and for a time worked as a consultant on tribal issues, among other roles. He returned to elected office in 2011, in the Arizona Senate, and began his second consecutive two-year term in January. But shortly thereafter, he was recruited to serve as senior advisor and liaison for Native American affairs in the State Department’s Bureau of Oceans and International Environment and Scientific Affairs.

Jackson’s new position was crafted in response to tribal leaders who have complained about improper consultation during the process to approve the Keystone XL Pipeline.

“We know that tribal leaders in North Dakota walked out of a consultation meeting with the State Department, saying that they wanted someone there like the President or Secretary Kerry to meet with them, as tribal leaders,” Jackson said, taking a break from unpacking boxes in Washington on July 4. “I believe that this new position, with someone who is Native American and has a background in dealing with tribes, hopefully that will help those tribal leaders remain at the table.”

Like all oil pipelines, the Keystone XL Pipeline falls under the State Department’s purview because of a 1968 executive order by Lyndon Johnson. Jackson’s bureau, its name often shortened to Oceans, Environment and Science (OES), works on a variety of issues besides energy. They range from water sanitation in developing countries, to climate change, to policies in space.

“For anything that deals with environmental and cultural impacts to tribes, the Department of State is trying to make sure that there’s someone there,” Jackson said.

Jackson is no stranger to Washington; he spent 12 years there after graduating from Syracuse University law school in 1989. He started as a legislative associate, and then was promoted to deputy director for the Navajo Nation Washington Office, representing the concerns of his people before the federal government. During his first stint in Washington, Jackson also worked as a legislative analyst at the National Indian Education Association and director of governmental affairs for the National Congress of American Indians.

He has been back in Arizona for 12 years, during which time he’s served on two different occasions in the state legislature and performed a variety of other roles. Most recently, he has been a senior strategist in the Blue Stone Strategy Group, a national Native-owned consulting firm that helps empower tribes in the areas of sovereignty, self-determination and self-sufficiency in the business and governmental sectors.

Even though he’s vacating his current term early, he said he’s proud of what he accomplished already this year. He was able to secure $2.4 million in emergency funding for the Red Mesa Unified School District, on a remote part of the Navajo nation near Arizona’s border with Utah. The district was threatened with financially necessary closure after it was ruled that it could not count its students from Utah when it received its Arizona state allocations.

He also worked to make tribes eligible to compete for moneys out of Arizona’s aviation fund, which go for maintenance and construction at public airports. There are 14 tribally-owned airports in Arizona. And he secured annual funding so that Navajo Technical College can build a permanent campus in Chinle, Arizona.

He said a farther-reaching effort he began in 2003 has been “inching its way” toward fruition: making sure tribes get back a fair portion of the transaction privilege taxes collected from non-Indian businesses on reservations. As it stands now, the state collects the money and divides it between the state, counties and municipalities, leaving tribes out of the equation. Finally, this year, Jackson’s legislation to remedy that formula made it out of committee – but died in the full Senate.

“I hope that next session my successor and representatives Hale and Peshlakai will be able to keep up that momentum,” Jackson said.

Jackson said he’ll miss his family and friends in Arizona, but he and his husband of five years, David Bailey, will keep a home in Phoenix to facilitate Bailey’s ongoing, Arizona-based job with U.S. Airways. So frequent travel to his homelands will be possible, Jackson said, adding that his new role is worth some sacrifice.

“Having a voice on environmental and cultural impacts on tribes is very important, especially now, with the things that our Mother Earth is facing,” he said. “As a Navajo person, my family made sure all the prayers and blessings were in place.”

Oil trains and terminals could be coming to the Northwest

Pacific Northwesterners worried by three planned new coal export hubs along their shorelines have something new to fear.

Oil refiner Tesoro and terminal operator Savage are trying to secure permits to build the region’s biggest crude oil shipping terminal at the Port of Vancouver, along the Washington state side of the Columbia River.

KPLU reports that the proposed terminal would receive crude by rail from oil fields in North Dakota and transfer it onto oceangoing tankers for delivery to refineries along the West Coast. And that’s just one of many plans to boost shipments of oil through the region to coastal ports. Environmentalists are not pleased, fearing oil spills among other problems.

The Port of Vancouver got an earful Thursday from backers and opponents of a proposed crude-oil transfer terminal who packed the Board of Commissioners’ hearing room to trumpet their arguments.

 

Executives with Tesoro Corp. and Savage Companies, who want to build the terminal to handle as much as 380,000 barrels of oil per day, told commissioners the project capitalizes on rising U.S. oil production, boosts the local economy and will operate in ways that minimize harm to the environment.

“A lot of family-wage jobs will be created,” said Kent Avery, a senior vice president for Savage.

Critics told commissioners the project, which would haul oil by rail and move it over water, conflicts with the port’s own sustainability goals, increases the risk of oil spills in the Columbia River and further fuels global warming.

“This is a really big gamble,” said Jim Eversaul, a Vancouver resident and retired U.S. Coast Guard chief engineer.

Washington Gov. Jay Inslee (D) will have the final decision on the proposal. From the Columbian again:

Port managers are negotiating the terms of a lease agreement with Tesoro and Savage. Commissioners may decide a proposed lease arrangement on July 23.

Such a decision won’t end the matter, though. The state Energy Facility Site Evaluation Council will scrutinize the proposed crude oil facility and make a recommendation to Gov. Jay Inslee, who has the final say.

The council’s review could take up to a year or more. The companies hope to launch an oil terminal at the port in 2014.

The Seattle-based nonprofit Sightline reports that 11 port terminals and refineries in Washington and Oregon “are planning, building, or already operating oil-by-rail shipments” and “if all of the projects were built and operated at full capacity, they would put an estimated 20 mile-long trains per day on the Northwest’s railway system.”

 

 

Time to Move Forward on Fish Consumption Rate

OLYMPIA – The Washington state legislature deserves thanks for not caving in to demands from Boeing and others to require yet another study of fish consumption rates in Washington to tell us what we already know: Our rate is too low and does not protect most of us who live here.

It wasn’t easy. A Senate measure requiring another study before beginning rulemaking on a new rate was tied to passage of the state budget, and nearly led to a government shutdown. Boeing and others have been trying to stop or delay development of a new rate because they say it would increase their cost of doing business.

The fish consumption rate is part of the human health standards used by state government to determine how much pollution is allowed to be put in our waters. The 20-year-old rate of 6.5 grams per day – about one eight-ounce seafood meal per month – is supposed to protect us from more than 100 toxins that can cause illness or death.

It’s a sad fact that Washington has one of the highest seafood-eating populations, but uses one of the lowest fish consumption rates in the country to regulate water pollution and protect human health. Another study could have delayed development of a new rate for three years or more.

Tribes have been reaching out to business and industry to discuss implementation of a new fish consumption rate. We are sensitive to possible economic impacts of a higher rate, and we want to continue working together to create a meaningful path forward. But those efforts have largely been ignored, and that’s too bad, because we have solved bigger issues than this by working together.

We are encouraged, however, by the actions of Dennis McLerran, regional Environmental Protection Agency administrator. He has stepped forward to express his agency’s commitment to protecting water quality and human health in Washington.

In a recent letter to Maia Bellon, director of the state Department of Ecology, McLerran pledged to support the state in developing a more accurate fish consumption rate. He made it clear, however, that if the state can’t or won’t get the job done, he will use his authority to establish a new rate. “The EPA believes there are scientifically sound regional and local data in Washington that are sufficient for Ecology to move forward in choosing a protective and accurate fish consumption rate at this time,” McLerran wrote.

Ecology director Bellon has said that we could have a more accurate fish consumption rate adopted by late 2014, and we intend to hold her to that. Oregon has increased its fish consumption rate to a more realistic 175 grams per day; we think Washington residents deserve at least that much protection.

We’re spending too much money, time and effort to clean up and protect Puget Sound and other waters to let business and industry continue to pollute those same waters. Right now we are paying for our state’s low fish consumption rate with the cost of our health, and that’s not right.

Developing a more accurate fish consumption rate isn’t about jobs versus the environment. It isn’t just an Indian issue. It’s a public health issue and needs to be treated that way. We can’t allow politics to trump common sense when it comes to protecting our own health and that of future generations.
