Indian Country Grapples With Health Funding Shortfalls, Non-Payment

Slowly but surely, tribal governments — especially those in Alaska — are receiving millions of dollars in decades of unpaid contract costs from the Indian Health Service and Bureau of Indian Affairs.

WASHINGTON — Tribal health programs working to serve native people are not seeing funding of administrative costs keeping pace with need, and the Indian Health Service and the Bureau of Indian Affairs owe millions to tribal governments.

“The federal government has broken too many promises with tribes and though we have more work to do, I am pleased that we are seeing good progress with Alaska tribes receiving the money they are owed,” Alaska Sen. Mark Begich told the Alaska Native Tribal Health Consortium last month. “Failure to pay the full costs is unacceptable and I will continue to use my position on the Senate Indian Affairs Committee to keep up the pressure on the federal government.”

The IHS, a Department of Health and Human Services agency, provides health service systems for about 2.2 million of the nation’s estimated 3.4 million American Indians and Alaska Natives.

Funds allocated by the IHS, currently $4.4 billion per year, go toward administering medical care to tribes or are turned over to tribes for them to administer the care themselves. The IHS had been failing to provide full payments of contract costs until the Supreme Court ruled in June 2012 that the government must pay, determining that the tribes had been underpaid “between 77 percent and 92 percent of the tribes’ aggregate contract support costs” during previous decades.

Yet, according to Jacqueline Johnson Pata, executive director of the National Congress of American Indians, “payment has not happened.”

“The class action lawyers recently reported to NCAI on the lawyer’s discussions with the Justice Department. Although they couldn’t share much information, they did explain that there are close to 9,000 claim years at issue involving about 500 tribes and 19 years worth of contracts (1994-2013),” she told the U.S. Senate Committee of Indian Affairs last year.

to mandate funding for certain payments to Indian tribes and tribal organization. Additionally, the federal government has treaty and statutory obligations under the Indian Self-Determination and Education Assistance Act of 1975, which requires the government to contract with tribes to operate BIA and IHS programs. The agreement between the government and tribes is embedded in Article I, Section 8, of the U.S. Constitution.

At the end of 2013, less than 1 percent of thousands of claims in more than 200 lawsuits filed by tribes seeking a combined $200 billion had been settled — just 16 claims of an estimated 1,600.

Of the 566 nations the federal government recognizes, 229 are spread across the vast 572,000 square miles of Alaska, where they occupy small villages in remote areas — many only accessible by air or boat. For these tribes in remote areas, seeing a doctor might be inconvenient, to say the least, and almost definitely costly.

Lead counsel in the cases establishing government liability for IHS’s failure to pay, Lloyd Miller, an attorney based in Anchorage, Alaska, said IHS is severely underfunded.
“IHS is a prepared health plan paid for with a lot of blood and millions of acres of land,” Miller said. “Because the government took away their lands, there’s a responsibility.”
IHS gets $4.4 billion from Congress annually for what’s estimated to be a $15 billion need to meet the costs, he said.

Miller represents about 60 tribes, each with several claims filed for the costs owed.
In an August 2007 letter to the Senate Committee on Indian Affairs requesting an oversight hearing, Alaskan tribal health care providers reminded the committee that the Indian Self-Determination Act requires money to provide federal trust responsibilities.

“We write to once again call your attention to the grave crisis we face as a result of insufficient contract support cost appropriations which, together with Indian Health Service policies, have left our tribal organizations with annual shortfalls running from $2 million to over $8 million. We respectfully request that the Senate Indian Affairs Committee convene an urgent oversight hearing this Fall, to review what has become a genuine crisis in Indian country, and a crisis that has seriously eroded the national policy of Tribal self-governance and the delivery of quality health services to Alaska Native people,” the letter stated.

By August of this year, 12 of Alaska’s tribal health providers received $449 million to resolve contract support costs disputes with the IHS. Another 11 providers were still in negotiations. The Alaska Native Tribal Health Consortium, serving more than 143,000 native people, received the largest payment, with a $153 million settlement that includes $115.5 for past-due costs and $37.7 million in interest. At about $128 million, Southcentral Foundation received the next largest settlement.

The NCAI has been working with tribes and the IHS on contract costs since the Indian Self-Determination Act went into effect.

The congress is hosting the annual Tribal Unity Gathering and Legislative Impact Days on Sept. 16 and 17 in Washington. During the event, tribal leaders and representatives will meet with their delegates to the U.S. Congress to encourage action on important delegation before this session ends. IHS appropriations will be among the issues discussed.

“There’s strong support from the House and Senate,” said Amber Eberb, program manager of the NCAI Policy Research Center. “There’s quite a few champions who understand that tribes administering their own programs to respond to their community needs is more effective than a federal agency.”

There’s still progress to be made, Eberb said.
“Contract costs and other treaty issues should not be considered discretionary but mandatory,” Ebarb said. “All program money that uphold treaty agreements should be mandatory. It’s morally correct to do. Perhaps a little difficult to do right now.”

 

Disparities in well-being

American Indian and Alaska Native (AI/AN) death rates were nearly 50 percent greater than rates among non-Hispanic whites during 1999-2009, according to a study by the Centers for Disease Control.

The study was carried out by the CDC’s Division of Cancer Prevention and Control, the CDC’s National Center for Health Statistics, CDC researchers, the IHS, and partners from tribal groups, universities and state health departments.

It revealed:

Among AI/AN people, cancer is the leading cause of death, followed by heart disease, while the opposite is true for other races studied;

  • Death rates from lung cancer have shown little improvement in AI/AN populations. AI/AN people have the highest prevalence of tobacco use of any population in the United States;
  • Deaths from injuries were higher among AI/AN people compared to non-Hispanic whites;
  • Suicide rates were nearly 50 percent higher for AI/AN people compared to non-Hispanic whites, and more frequent among AI/AN males and persons under age 25;
  • Death rates from motor vehicle crashes, poisoning, and falls were two times higher among AI/AN people than for non-Hispanic whites;
  • Death rates were higher among AI/AN infants compared to non-Hispanic white infants. Sudden infant death syndrome and unintentional injuries were also more common. AI/AN infants were four times more likely to die from pneumonia and influenza;
  • By region, the highest mortality rates were in the Northern Plains and Southern Plains, while the East and Southwest had the lowest.

“Many of the observed excess deaths can be addressed through evidence-based public health interventions,” the report concluded.

In November 2013 testimony before the Senate Committee on Indian Affairs, Alaska Sen. Lisa Murkowski said:

“I listened very intently yesterday at the tribal summit when the President spoke. I went there specifically to hear what he was going to say on the issue of contract support costs. What I heard him say is, we have heard you loud and clear, but we are still working to find the answers. I don’t think we need to work to find any answers. I think that the court laid it out very, very clearly. It said that full reimbursement will be provided. So we have to make that happen within that budget. We have to make that priority.”

Murkowski said she had listened to the stories of the impact of lack of funds, saying, for example, that the regional health provider in Juneau had to close its alcohol treatment facility. Further north, in the Yukon Delta, the regional health provider laid off 20 employees, permanently closed 40 vacant positions, and reduced services for elders, she continued.

The impacts of the sequestration, she said, also meant that tribes would not be able to reduce waiting times at emergency rooms or outpatient and dental clinics.
“The impact, I think we recognize, has been significant,” she said.

Murkowski submitted comments she received from Alaska Natives around the state, including the Association of Village Council Presidents.

 

Proposed Increase for IHS Budget

“Tribes have not recovered from sequestration that resulted in across-the-board cuts to all federal programs that tribes are reliant upon. Nowhere was this more impactful than to the Indian Health Services, where due to sequestration, continuing resolutions, and the 16 day government shutdown — healthcare to Indian people was jeopardized,” U.S. Senate Committee on Indian Affairs Chairman Jon Tester, of Montana, said in March.

Tami Truette Jerue, tribal administrator and director of social services for the Anvik Tribal Council in Alaska addressed the committee’s oversight hearing in February. The Anvik are an Athabascan village of about 275 members on the west bank of the Yukon River.

Jerue represented the 37 federally recognized tribes that make up the Tanana Chiefs Conference, an inter-tribal health and social services consortium that serves an area of Interior Alaska that is roughly the size of Texas.

She delivered a message from more than 200 tribes across Alaska:
“It is absolutely essential that, without regard to technical land titles and the technical Indian country status of lands or tribal communities, our Tribes must have the tools necessary to combat drug and alcohol abuse, domestic violence, and violence against women. Fighting these scourges in our communities and healing our people cannot be made to stand on technicalities. We need to get to work, and now. And we need Congress’s help to do that. The State is not the problem, because the State is nowhere to be found in most of our Villages….

“Today, the tribes of Alaska come to you, not as victims of a failed governmental policy, but as powerful and responsible advocates for our people. We are stepping up to do what we must do. But without equally firm action from Congress, our people will suffer, we will continue with decades more of litigation battles and loopholes will continue to be found which deny our tribes the funding necessary to improve law and order in our communities.”

In the budget for the 2015 fiscal year, the Obama administration proposed a 4.5 percent increase for IHS, representing a $200 million increase over the current level to $4.6 billion.

The 2015 budget request includes:

  • An additional $50 million to help obtain health care from the private sector through the Purchased/Referred Care program (formerly known as the Contract Health Services program). This program allows for the purchase of essential health care services that the IHS and tribes do not provide in their local facilities;
  • An additional $71 million to support staffing and operating costs at four new and expanded facilities;
  • An additional $30 million to fully fund the estimated amount of contract support costs for new and expanded contracts and compacts in fiscal year 2015. This will help tribes cover the cost of administrative functions for compacts or contracts established under the authority of the Indian Self-Determination and Education Assistance Act;
  • An additional $31 million to address medical inflation costs;
  • Additional funding to pay costs for new tribes and restoration of reductions in the fiscal year 2014 operating plan.

In his statement, Tester noted the “positive highlights” in the budget request.

“The Committee is pleased that the Administration finally understands its legal obligation to fully fund Contract Support Costs for the both the Indian Health Service and Bureau of Indian Affairs,” Tester said. “I am particularly encouraged by the $11 million increase for social services and job training to support an initiative to provide a comprehensive and integrated approach to address the problems of violence, poverty, and substance abuse.”

 

Covering IHS shortfalls with the Affordable Care Act

The Southeast Alaska Regional Health Consortium and more than 50 tribes wrote a letter to President Obama on Oct. 13.

In part, it said, “Among your administration’s most important achievements has been the development of historic settlements with Indian Tribes in several major litigations, its advocacy for amendments to the Indian Health Care Improvement Act and the Violence Against Women’s Act, and its commitment to critical appropriations measures. But when it comes to honoring the Nation’s commitment to the contracting and compacting Tribes who were historically, and illegally, underpaid, and who continue to be underpaid, the administration has permitted fiscal concerns to eclipse the imperative to do justice and to honor the nation’s obligations.”

In July the IHS reached a settlement with the consortium for claims during the years 1999 through 2013. The payment — $39.5 million plus interest — totals about $53 million.
“A lot of tribes had to close down programs because of lack of funds,” Andrea Thomas, outreach and enrollment manager of SEARHC, told MintPress News. “Part of what the settlement can do is bring back what was lost.”
Alaska did not create reservations like the 48 contiguous states, and many Native communities formed consortiums, like SEARHC, to use IHS funding for health care to serve them all.

SEARHC is a nonprofit tribal health consortium of 18 Native communities which serves the health interests of the Tlingit, Haida, Tsimshian, and other Native people of Southeast Alaska. In 1982, the consortium took over operations at the IHS clinic in Juneau, and then took over operations at Mt. Edgecumbe Hospital, formerly an IHS-run facility, in 1986.

“In Alaska we have the highest cost of health care in the nation,” Thomas said. “There’s vast wilderness surrounding each place. In order for me to get out of my community, I’d have to fly or take a ferry. This gets incredibly expensive.”
Many Alaskan villages have a community health clinic, but complicated procedures such as chemotherapy or serious surgeries, require patients to go to hospitals at regional hubs or to the Alaska Native Medical Center in Anchorage. The burden is on the tribal health consortium to pay the costs of a commercial jet, float plane, ferry, or boat.

If a medical evacuation helicopter is needed, it would cost SEARHC about $95,000 — a cost that could be absorbed by the Affordable Care Act.

“The issue is that IHS only provides about half the money for services,” Thomas said. “We rely on other revenues like grants and billing Medicare and Medicaid. If native people enroll, it puts more money back and we could offer more services or expanded services.”
Further, a member of a federally recognized tribe can get a lifetime exemption. Alaska Natives and American Indians are exempt from Affordable Care Act tax penalties because they receive care through the IHS. But through the new health care scheme, they are eligible for subsidies from private insurance. Thomas said that those who fall between 100 percent and 500 percent of the federal poverty level pay a monthly premium, but no deductibles or out-of-pocket expenses.

Yet, of more than 100,000 self-identified Alaskan Natives or American Indians, only 115 had signed up for health insurance through the Affordable Care Act as of April.

“Not a lot of people realize what the Affordable Care Act does for Alaskan Native people,” Thomas said.

Coverage also extends to Native people who are not enrolled members of a federally recognized tribe and meet federal guidelines. Thomas said they can receive a lifetime hardship exemption, rather than a tribal exemption, and there may be some out-of-pocket expense.

Ten Reasons Why Every Native Should Vote

Why vote? It takes planning, some time, and the rewards are not always visible. The same problems will surround American Indians and Alaska Natives before and after the election.

It’s easy to be trite and type, “this election matters more than most” and then cite specifics to make that case. But it’s not true. Win or lose (no matter who we support) life will go on.

But there are reasons to vote. Examples big and small that show how we can make a difference. Here we go.

One. Because voting is an act of sovereignty. The late Billy Frank Jr. used to articulate different ways that we practice sovereignty today. Taking a fish is an act of sovereignty. Using an eagle feather is sovereignty. Or picking berries.

I would add voting to that list. There’s a great example going on right now: the Independence vote in Scotland. Every Scot citizen, 16-years and older, will have a say about their future country. But that voice is only possible now because of Scotland’s participation in the United Kingdom’s electoral process. The idea of returning power had to be ratified in Parliament, a proposition demanded and promoted by the elected representatives from Scotland. Other countries have gone to war over independence. But Scotland is voting. The ultimate use of sovereignty.

Two. Because too many folks don’t want you to vote. Across too many government officials are taking steps to make casting a ballot harder, limiting early voting options, alternative polling spots, or failing to account for Native languages. Across the country there are lawsuits seeking resolution.

But in addition the smartest act of defiance is to vote. Every vote is reprimand of the philosophy to limit access. One of the worst examples of that notion surfaced last week when a Georgia state senator said he preferred “educated voters” to any increase in voters.

Three. Because climate change is real and any candidate who says it’s not, should be ruled out as a leader. The science is clear 97 percent of all peer-reviewed papers say the same thing: Global warming is real and humans are the cause. (This graphic from NASA is one way to see it for yourself.)

Why does this matter? Because our political leaders are going to have to make tough choices in the years and decades ahead on issues. Indian country is already being impacted and that will only get worse as communities will need significant new resources for mitigation or even relocation. If you vote for your children, this might be the most important single reason.

Four. Because the Affordable Care Act matters. American Indians and Alaska Natives have been calling for full funding for the Indian health system for, well, since the Treaty era in the 19th century. But never in the history of the country has Indian health been adequately funded. For all its problems, the Affordable Care Act opens up a mechanism to significantly increase the revenue stream for Indian health.

And the alternative from critics? There is not one.

Five. Because the Violence Against Women Act represents how politics can serve the greater good. So roll back the clock to a time when there were not enough votes in the U.S. Senate to pass the Violence Against Women Act with the provisions to give tribes additional authority. Then on April 25, 2012, at a news conference on Capitol Hill, Then Tulalip Tribal Vice Chairman Deborah Parker told her powerful personal story about abuse. Her story carried on YouTube and across the nation via social media as well as legacy media changed everything. The Senate passed the measure. Then the House leadership supported an extraordinary deal. According to Talking Points Memo: “The Rules Committee instead sent the House GOP’s version of the Violence Against Women Act to the floor with a key caveat: if that legislation fails, then the Senate-passed version will get an up-or-down vote.”

That made it possible for Congress (and the president to sign into law) the renewal of the Violence Against Women Act.

Six. Because friends matter. Even when the disagree. Most of the time, anyway. The Violence Against Women Act is a good example of why friends matter. Oklahoma’s Tom Cole was able to convince Republican leadership about the importance of the act. This law would not have happened without him. Cole, and Idaho’s Rep. Mike Simpson, have been important voices within the Republican caucus on matters ranging from VAWA to limiting the damage from sharp budget cuts.

And that brings me to seven …

Seven. Because there should never, ever be another Alaska Exception. If the Violence Against Women Act represents the best in politics, the Alaska Exception is the opposite. Alaska has epidemic levels of sexual violence and rape. So what does Congress do? It takes away a tool that tribal communities might be able to use to turn the situation around.

What’s worse is that the exception was inserted into the bill by Alaska Republican Sen. Lisa Murkowski who owes her election to Alaska Native voters and corporate spending. (I know this undermines Reason Six.) The Washington Post said last month: “Now, after pressure from Alaska Natives, Murkowski is reversing her position and trying to repeal the provision she inserted.” There are no heroes in Congress on this provision, including Alaska Sen. Mark Begich, a Democrat, who also supported the exception. He, too, has reversed himself.

The promise unfulfilled is that Congress would revisit this issue. That has yet to happen. But this whole episode should be a warning; a never again moment.

Eight. Because Congress must pass a Carcieri fix. The Supreme Court ruled in 2009 that limits what land the Department of Interior can take into trust. This has significant impact on tribal economic development. Montana’s Sen. Jon Tester, chairman of the Indian affairs committee, told Indian Country Today Media Network that while he believes in a clean fix, “many of my colleagues in the Senate don’t agree.”

The way to change that is pressure from voters.

Nine. Because your vote counts more than the gadzillions spent by those with money. Turn on a television and you see that money at work, ad after ad, dark images, somber music, and words about the evils of certain candidates. Politics should be about ideas and policies more than personality. What do we want out of government? How do we pay for that? Those are the big questions. The best way to do that is to ignore the campaigns and just vote.

Ten. Because women matter. More than half the population of the country is female yet representation is only about one-fifth in the Senate and even less than that in the House. As The Washington Post reported this week: “The Congress has always been and continues to be the domain of white men.” I think of the words of the late Wilma Mankiller. She said Cherokee treaty negotiators asked the United States team, “Where are your women?” Cherokee women often accompanied leaders at negotiations and so it was inconceivable that the federal government would come alone. There must be balance if we want to become the democracy that we can be.

Finally, in the spirit of Spinal Tap, let’s turn this vote meter to Eleven. Why eleven? Because it’s not ten. Where can you go from there? Eleven. One louder.

So reason number eleven. Because we can win. I started this post by mentioning the election coming up in Scotland. Some 4.2 million citizens signed up to vote, a 97 percent registration. Imagine what would happen if American Indians and Alaska Natives voted with those kind of numbers. It would upend politics in from Alaska to Wyoming. Local leaders would be replaced and we would have a far greater say in programs and policies. Already there’s evidence that the Native vote make a difference, but that influence should be growing. We have a younger population and in a low turnout election, we could call the shots. We could be one louder.

Lorraine Loomis Elected Chair of Northwest Indian Fisheries Commission

OLYMPIA – Lorraine Loomis, a Swinomish tribal member, has been elected chair of the Northwest Indian Fisheries Commission.

She replaces the late Billy Frank Jr., who served as NWIFC chairman for more than 30 years. Frank died on May 5, 2014 at the age of 83.

“I am honored and humbled to be elected chair of the NWIFC,” said Loomis. “No one can ever replace Billy. It will take all of us to carry on his work.”

Loomis, who was serving as vice-chair of the commission, will fill the remainder of Frank’s term as chair through May, 2016. Shawn Yanity, Stillaguamish tribal chair, was elected to replace Loomis as vice chair. Ed Johnstone, Quinault Indian Nation, will continue as NWIFC treasurer.

Loomis, 72, has been Swinomish tribal fisheries manager since 1975. She has extensive experience in fisheries management throughout the region. She currently serves on the Fraser River Panel of the Pacific Salmon Commission that manages sockeye and pink salmon under the U.S./Canada Pacific Salmon Treaty. Loomis also coordinates tribal participation in the annual North of Falcon salmon season development process with the State of Washington.

“Our treaty rights are at serious risk today,” Loomis said. “Salmon recovery is failing in western Washington because salmon habitat is disappearing faster than it can be restored. If there are no salmon available for harvest, our treaty rights mean nothing. We must stop this ongoing loss of habitat, but so far the trend shows no sign of improvement. We are looking to the federal government, as our trustee, to take a more active role in salmon recovery and lead a more coordinated salmon recovery effort.”

The NWIFC is a support service organization for the 20 treaty Indian tribes in western Washington that are co-managers of the region’s natural resources with the State of Washington. The commission provides services to tribes in areas such as fisheries management, habitat protection and fish health. The NWIFC also provides a forum for tribes to address shared natural resource management concerns and enables the tribes to speak with a unified voice.

The NWIFC is headquartered in Olympia, with satellite offices in Forks, Burlington and Kingston and employs a staff of 70.

Part 1: Adult Chinook In The Pacific Ocean Prepare For Long Journey Home

As soon as you arrive in Sekiu, Washington, you get a whiff of salty ocean air laced with the unmistakable smell of fresh fish. The scent fills your nostrils as the gulls mew nearby, fighting for the remains of the day’s catch in the protective cove.

Located 20 miles east of Neah Bay by car, the fishing village has a long reputation for good salmon fishing. It’s also where we pick up the trail of the Lake Washington chinook. The subset of the Puget Sound salmon were listed as threatened under the Endangered Species Act in 1999 and traced here by scientists who tag them.

The fish spend their adult lives in this open ocean before heading home to spawn in the Cedar River or in Bear Creek, or the state hatchery in Issaquah.

‘A Surprisingly Quiet’ Season

Pulling into Sekiu, one might expect a bustling fishing village with flotillas of boats hooking plenty of salmon, perhaps because the summer’s headlines have touted a record run of Columbia River chinook.

Towns like Westport have been booming with the projected return of 1.5 million chinook, also known as king salmon. Anglers at Buoy 10 on the river this year reportedly spent more time looking for a place to set up their gear than they did reaching daily limits, thanks to successful management of the dams, hatcheries and habitat down south.

Also often mentioned in the reports are favorable ocean conditions that have allowed more adult fish from the Columbia River system to survive. But those ocean conditions aren’t doing much for the fishing in Sekiu.

“It’s surprisingly quiet. Usually one of the peak times of the year is right now,” says veteran guide, Roy Morris, a life-long salmon fisherman who has kept a charter boat at the docks in Sekiu for 20 years.

Unusually Warm Water 

Morris says there has been a steady decline in fish stocks. And this year, he says everyone there is reporting “one of the lowest year of catches for salmon, particularly Chinook.”

One reason, he suspects, is unusually warm water, which he says it’s been about 5 degrees hotter than normal.

“We’ve been seeing it on our instruments on our boat all year long. We couldn’t believe our instruments were correct when we saw 58 degrees, where usually it’s 49, 52,” he says. “And that changes the conditions for feed for the salmon as well as their desire to be in that warmer water.”

The warm water off the Northwest coast, which is linked to one of the hottest summers the region has ever seen, is what’s believed to have caused a record number of sockeye to bypass Sekiu and many other ports in Washington in favor of cooler waters in Canada. Morris says it probably hasn’t helped the chinook here, either.

“It is surprising, because I know there’s many people working together to try to improve conditions and survival for salmon, but it’s up and down from year to year within a decade, [and] this year is some of the lowest catches for Puget Sound chinook that we’ve ever witnessed,” he says.

‘We Have Only One Chinook In The Freezer’

Ocean conditions are a bit of a black box for scientists; they know that huge percentages of the young salmon that leave fresh water never return as adults, but information about why is scarce. The recent launch of an international research effort, the Salish Sea Marine Survival Project, seeks to fill the information gap.

But for Morris, it’s just one of many causes. For another, he cites the influence of hatchery fish that are released in droves and feed on limited food sources “like a herd of sheep” while wild fish trickle out gradually. But he links most of the fish’s decline to urbanization and development that destroys fish habitat.

He remembers the days of his youth in the 1950s and ‘60s when salmon fishing was such a popular family vacation that you could hardly find a place to park your boat in places like Ilwaco.

“Because it came with a bounty of fish that were canned and smoked and frozen, so that after your vacation you ended up with two or three hundred pounds of salmon,” he says. “Now, we have only one chinook in the freezer, where last year, we had 15, so we’ll be fishing hard [for the rest of the season].”

Why The Chinook Is King

Chinook hold a special status in the world of sport fishing.

“[It’s] called the king because it’s the biggest and the most spectacular,” Morris says, noting that sometime his guests get frightened by how long and hard they’ll pull on a line. Morris calls them “the long distance runners.” He notes that Columbia River chinook traverse nearly the entire state and reach Canada before coming back home. And his favorites, the Puget Sound chinook, even climb mountains.

“They go right to the North Cascades,” he says. And they enjoy iconic status, with tourists coming from all over to seek them out. They’re also some of the tastiest, with firm flesh, he says, “because it chored higher and higher into the watersheds.”

And they get harder to catch at this time of year, when their bodies start changing with physiology that signals it’s time for them to head to home waters and spawn. They lose interest in food, presenting extra challenges for anglers who use special lures and techniques to hook them.

“There’s slang talk like ‘slack jaw’ and more formal talk is ‘waiting fish.’ They’re not so much chowing down to build their body,” he says. “Reproductive capabilities are being developed more than muscle tissue. And as that chemistry changes, their desire to return to the natal stream and spawn overrides their desire to hunt and feed.”

‘I’m Here As A Witness To The Process’

Morris is not just a seasoned salmon fisherman; he’s exceptionally passionate about saving the fish. He says he caught his first salmon when he was 5, helped his grandson catch one at age 4 and wants that lineage to continue. But does he ever think it would be better to stop hunting an endangered species?Yes, he says, but as long as the fishing is allowed, he wants to be part of it.

“I’m here as a witness to the process,” he says. “I’m not fishing greedily to catch the last salmon, but I am participating in the seasons and open times that you can enjoy the sport.”

By being out on the water 100 days a year and also volunteering on boards as a representative of sport fishermen, he feels his perspective is an important contribution to augment data sets collected by government agencies. And he sees part of his role as educating the public about endangered fish and the issues they face.

There’s Hope Yet

“The chinook is one of the more fragile of the spectrum of salmon in the Northwest,” he says. He remembers when they were first listed 15 years ago and the fishery was closed. He thought it might never reopen, that their declines had gone too far.

“But where barriers are removed, they’re amazing the way that they’ll try to fight for their survival if they’re given half a chance,” he says.

One only needs to look to Issaquah Creek and its Salmon Days festival for evidence, he says.  In places where habitat has been restored and fish protected with policies, the fish do come back.

“At one time, those stocks had dwindled to just such small numbers, people had never even seen them or knew they were in the river. Now they throng and there’s a celebration … with booths and festivals, and people hanging over bridges,” he says. “That just is testimony to that if you give’em a chance, they will survive.”

And he sees another ray of hope in the recent return of chinook to the Elwha River, where the nation’s largest dam removal has just been completed.

“We saw fish in a habitat that there had not been wild salmon in for 100 years,” he says. “It’s just evidence that fish can return if they’re given a chance and proper conditions.”

The 22nd annual Salmon Homecoming Celebration being held September 18 to 20 at Waterfront Park in Seattle, Washington is dedicated to the life and memory of the late Billy Frank Jr., Nisqually, longtime defender of treaty rights and chairman of the Northwest Indian Fisheries Commission.

The celebration’s theme is “Man has responsibility, not power,” based on a traditional proverb of the Tuscarora Indian Nation.

Frank passed away on May 5 at the age of 83. He had been an adviser to and supporter of Salmon Homecoming throughout its history. “Billy understood the responsibility spoken about in that Tuscaroran proverb,” said Salmon Homecoming president Walter Pacheco, Muckleshoot. “He knew we are all responsible for the health of the salmon, the environment and the protection of the land, air and water.”

The event celebrates Native American culture and the importance of salmon—culturally, economically, environmentally and spiritually—to the people of the region. The celebration includes arts and crafts, environmental exhibits, visits to the Seattle Aquarium, storytellers, a salmon bake, a Northwest gathering and powwow, and a canoe welcoming event.

“For 22 years, the Salmon Homecoming Alliance has brought Native American culture and traditional environmental knowledge into the heart of Seattle, providing a unique opportunity for people from all walks of life to learn about and enjoy the many lessons and customs of the indigenous people of this land,” Pacheco said.

“It has always been our belief that everyone, regardless of age, gender or vocation is someone of great importance and—as the Tuscarora proverb indicates—has a responsibility to help take care of the land and natural resources needed to sustain future generations.”

The U.S. Mint has announced its designs for the 2015 and 2016 Native American $1 coins, and the choice of subjects—Mohawk Iron Workers and Code Talkers—represent a focus on  late 19th- and 20th-century Native history. Since 2009, beginning with a depiction of the “three sisters” agricultural technique, which Natives practiced for thousands of years before European contact, reverse-side coin designs have spotlighted elements of Native culture or episodes from history in a sort of timeline. The 2014 coin commemorated the Native role played in Lewis and Clark’s 1804-06 journey into the Pacific Northwest.

Under the terms of the Native American Coin Act signed by President George W. Bush in 2007, the 2016 coin will be the program’s last.

WASHINGTON – The United States Mint announced today the reverse (tails side) designs selected for the 2015 and 2016 Native American copy Coins.

The theme for the 2015 design is “Mohawk high iron workers, builders of New York City and other skylines (from 1886).”  The design depicts a Mohawk ironworker reaching for an I-beam that is swinging into position, rivets on the left and right side of the border, and a high elevation view of the city skyline in the background.  The design includes the required inscriptions United States of America and copy, and the additional inscription Mohawk Ironworkers.  United States Mint Artistic Infusion Program (AIP) artist Ronald D. Sanders designed the reverse, and United States Mint Sculptor-Engraver Phebe Hemphill will sculpt it.

The theme for the 2016 design is “Code Talkers from both World War I and World War II (1917-1945).”  The design features two helmets with the inscriptions WWI and WWII, and two feathers that form a “V,” symbolizing victory, unity, and the important role that these code talkers played.  The design also includes the required inscriptions United States of America and copy.  Artist Thomas D. Rogers, Sr. designed the reverse.  The sculptor-engraver will be selected at a later date.

The obverses (heads sides) of the 2015 and 2016 Native American copy Coins will continue to feature sculptor Glenna Goodacre’s “Sacagawea” design, introduced in 2000.  Inscriptions will be LIBERTY and IN GOD WE TRUST.  The year, mint mark, and E PLURIBUS UNUM will be incused on the coins’ edges.

The Native American copy Coin Program is authorized by the Native American copy Coin Act (Public Law 110-82).  The program, launched in 2009, calls for the United States Mint to mint and issue copy coins featuring designs celebrating the important contributions made by Indian tribes and individual Native Americans to the history and development of the United States.

Missing Section Of Nez Perce Trail Holds Little-Known Part Of History

The story most people learn about the Nez Perce Tribe and the capture of Chief Joseph doesn’t tell the whole history.

Now the federal government and Northwest Tribes are trying to fix that with a new historic site.

You may have heard about the Nez Perce’s epic 1,200-mile flight through Oregon, Idaho, Wyoming and Montana in 1877. The U.S. Army caught up with them before they could reach Canada. And in history books and documentaries, the story usually ends with the tribe being forced to surrender just 42 miles from the border — and freedom.

But in fact, for about a third of the Nez Perce, it didn’t end there. Nearly 300 people escaped the battlefield and did cross into Canada.

Ruth Wapato’s grandfather was one of them. Wapato is part of a group that’s been working to get the federal government to recognize the final leg in the Nez Perce National Historic Trail.

“They weren’t all off together, some up front, some way behind,” Wapato said. “Their moccasins torn and worn out, you know. And it was cold — in October. But they were on their way.”

Some stayed and their descendants remain in Canada. Wapato’s grandfather returned to the U.S. and was arrested and sent to Oklahoma.

The Forest Service is holding a series of public meetings in Oregon, Idaho and Washington through early October. They’re asking for public comment on adding an extra section and making other updates to the trail.

A New PNW Alliance Aims to Shield the Salish From Destruction

Native Americans, environmentalists, and fed-up citizens unite to keep corporations from turning the region into a fossil fuel corridor

On August 4, a dam holding back mining wastewater burst open in Likely, B.C., gushing roughly 6,604,301,309 gallons of toxic waste into the nearby lakes—a spill 78 percent larger than initial estimates. Only a month after the incident, Imperial Metals, the corporation responsible, declared the water safe to drink again.

“One of my friends caught a salmon alive and kicking there last week,” Sundance Chief Rueben George from the Tsleil-Waututh Nation said to a packed Seattle crowd at the Daybreak Star Indian Cultural Center on Sunday. “But when my friend picked it up, the fish’s skin slid off in his hands.”

Salmon have long been spiritual symbols of the Pacific Northwest—aquatic residents of the Salish Sea that have given life to Coast Salish people for 14,000 years and white settlers for 150. That the skin of the Northwest’s spirit animal is melting off is just one of many reasons organizers say they are forming the brand-new Nawt-sa-maat Alliance, a group that has vowed to defeat oil and coal corporations bent on turning the Pacific Northwest into a fossil-fuel corridor.

Nawt-sa-maat, a Coast Salish word that means “One house, one heart, one prayer,” is an unprecedented trans-border coalition of Coast Salish indigenous nations, environmentalists, interfaith groups, and youth activists that met for the first time this past weekend in Discovery Park. The Alliance’s goal? “To protect the sacredness of the Salish Sea.”

“The tribes are the original environmentalists,” Annette Klapstein, a member of the Seattle Raging Grannies and a new member of the Nawt-sa-maat Alliance, said at the initial meeting on Sunday. Klapstein was one of three protesters who sat on train tracks in Anacortes to block the controversial “exploding” oil trains in July. It was her first direct action after years of fruitless writings to the Seattle City Council and visits to Olympia to persuade politicians to do something about the influx of dangerous rail cars.

“It was always very iffy for tribes to work with environmental organizations because these organizations were arrogant,” Klapstein said. “They would tell tribes what to do, which didn’t go over very well. This new alliance, based on respect and understanding, is so important because these different groups’ goals are much the same, and we are so much more powerful together.”

Chief George, one of the three main founders of the Nawt-sa-maat, presided over the initial meeting and made it clear that one of its biggest enemies was the massive energy company Kinder Morgan. “We stand as one, and together we will protect and restore the sacredness of the Salish Sea,” he said. “Together, we are stronger than those who wish to use our home and waters as a mere highway for dirty oil and coal. Together, we will stop them. Kinder Morgan will not win this battle.”

Formed by Richard Kinder, an ex-Enron employee, the oil mega-corporation is proposing a massive $5.4 billion oil pipeline connecting the Alberta tar sands to the Pacific through Burnaby, B.C., tripling current capacity and creating the potential for enormous spills in the North Salish that would directly affect us in Washington. Canadian Prime Minister Stephen Harper has been pushing the project despite massive backlash from British Columbian activists and the indigenous Tsleil-Waututh, who are now taking the project to court for failing to consult with the First Nations tribe on the federal review.

“You know, I’d like to thank Stephen Harper,” said Nawt-sa-maat co-founder Chief Phil Lane Jr. of the Yankton Dakota and Chickasaw First Nations, “because in his complete unawareness, he’s awakened a sleeping spiritual giant.”

The mood at the meeting was intensely spiritual at times. Four local religious leaders, a United Methodist, a Buddhist, a Sufi, and an Interspirit, came together to bless the gathering in their respective traditions, ending with an indigenous cedar-bough blessing that the crowd happily lined up to receive. Many of the religious groups present vowed to convert their houses of worship to solar energy in an act of good faith.

Being a member of the Nawt-sa-maat effectively means a couple of things. Members are expected to join in a “4 Days of Action” campaign, starting on Sept. 19, that ranges from a salmon homecoming celebration to a climate-change rally at the Canadian border and ends with an international treaty signing that will effectively ratify the new trans-border Nawt-sa-maat Alliance. Members are then expected to join in future actions and work to build the nascent network, which will soon expand its scope to tackle the proposed coal-extraction sites at Cherry Point, sacred land to the people of the Lummi Nation near Bellingham.

“I just want to make this very clear,” Chief George said as he doled out salmon to the Nawt-sa-maat near the meeting’s end, “this Alliance isn’t just for one group. It’s for everyone. The Salish Sea is for everyone, not just corporations. We will win this fight.”

‘Am I Next?’ Indigenous Women in Canada Ask Social Media

It’s the heartbreaking question of our time, at least in Canada, where indigenous women have begun a social media campaign to draw attention to the prevalence of violence against them.

The movement was started by Holly Jarrett of Hamilton, Ontario, according to CBC News. Jarret is a cousin of Loretta Saunders, a grad student at St. Mary’s University in Halifax, Nova Scotia who was murdered earlier this year, allegedly by her tenants when she went to collect rent. The 26-year-old, pregnant Saunders had been researching the issue of missing and murdered indigenous women in Canada—more than 1,200 unsolved cases over the past few decades, according to the Royal Canadian Mounted Police (RCMP)—for her thesis when she went missing herself.

Most recently, across the country in Manitoba, the body of 15-year-old Tina Fontaine was pulled from the Red River in Winnipeg in August, wrapped in a bag. The homicide investigation is ongoing.

The call was raised once again for a national inquiry into the issue. Soon after Fontaine’s remains were found, the premiers of all the provinces met with the Assembly of First Nations, the Métis National Council and Inuit Tapiriit Kanatami (ITK) and came out advocating for a roundtable. Prime Minister Stephen Harper has long held that an inquiry would not yield any answers and thus was not the way to go.

It’s not just First Nations calling for such an inquiry. President Terry Audla is also advocating for an inquiry, as is Métis National Council President Clément Chartier. Both also attended the meeting with premiers. The premiers as well support the roundtable idea—a meeting with federal ministers to discuss the issue, according to CBC News—and aboriginal leaders have agreed to that as a first step.

Meanwhile across Canada, women are posting selfies of them holding signs bearing the slogan “Am I Next?” and posting them to social media under the #AmINext hashtag, as CTV News reported. There is also a petition at Change.org calling for an inquiry, started as well by Jarrett.

“Our family is Inuit, and Loretta has now become one of the over 1186 missing or murdered Aboriginal women she was fighting for,” wrote Jarrett on Change.org. “It is time for our government to address this epidemic of violence against Aboriginal women. Our family is gathering strength and we will not let her death be in vain. We will fight to complete Loretta’s unfinished work.”

“If We Cannot Escape, Neither Will the Coal”

Northwest Tribes and First Nations block fossil fuel exports.

Across the Northwest, Native communities are refusing to stand idle in the face of unprecedented schemes to move coal, oil, and gas through the region. It’s a movement that could well have consequences for global energy markets, and even the pace of climate change.

Now is a good moment for pausing to examine some of the seminal moments of resistance from tribal opposition to fossil fuel exports. Yesterday, the second Totem Pole Journey came to an end with a totem pole raising ceremony at the Beaver Lake Cree Nation in Alberta. As it did last year, the journey showcased the tremendous breadth and depth of indigenous opposition to coal and oil schemes—spanning Native communities from coastal forests to the high plains interior of North America.

The journey was a reminder not only of the particular moral authority of the tribes and First Nations in the face of fossil plans, but also the fact that they are uniquely equipped to arrest these export plans.

British Columbia

Like the United States, Canada is in the midst of a natural gas boom. The industry is trying desperately to move its products to foreign markets, but concerns about public health, fishing rights, and environmental damage have First Nations raising red flags.

Many of the First Nations in British Columbia have banded together against a liquid natural gas facility at Fort Nelson in northeast BC. At what is now being called the “Fort Nelson Incident” Chief Sharleen Gale gave a rousing speech, saying:

My elders said, you treat people kind, you treat people with respect… even when they are stabbing you in the back. So I respectfully ask government to please remove yourselves from the room.

Gale later asked LNG representatives to leave as well, and the event galvanized the BC aboriginal community. Since then, no fewer than 28 BC First Nation organizations have signed a declaration to put the facility on hold.

Elsewhere in the province, aboriginal communities have been in a long standoff with proponents of the highly controversial Enbridge Northern Gateway Pipeline, a proposal that would move tar sands oil from Alberta to port facilities in BC where it would be transferred to tankers that would move the crude to Pacific markets. At least 50 First Nation leaders and 130 organizations have signed the “Save the Fraser Declaration.” Citing concerns over water quality, fishing, treaty rights, and sovereignty, nine coastal First Nations even went so far as to preemptively ban oil tankers in their territorial waters.

The Canadian federal government gave approval to the Northern Gateway Pipeline in June, and women of the Gitga’at Nation did not take it lying down. In protest, they stretched a 4.5 kilometer (2.7 mile) crochet chain across the narrow channel near Kitimat, where the export facility is proposed to be built.

“It’s to show that we’re prepared to do what it takes to stop them because we can’t let it happen. It’s the death of our community, our culture,” said Lynne Hill, who generated the idea.

Now, similar opposition is mounting against Kinder Morgan’s planned Trans Mountain Pipeline expansion in southern BC, and BC First Nations are challenging it in court.

Lillian Sam, aboriginal elder from the Nak’al Koh River region, put the situation in perspective:

You cannot eat money…you see the devastation of the oil sands: a huge part of that land is no good. What’s going to happen to us? What’s going to happen to our children?

The US Northwest

Like their neighbors to the north, Washington Tribes have had major concerns over fossil fuel exports, not to mention the way they have been treated by proponents of the projects.

In 2011, the would-be builder of the Gateway Pacific coal terminal near Bellingham got into hot water with permitting agencies after it was discovered that they had begun construction without approval. Not only did construction crews destroy acres of sensitive wetlands, they also damaged local Lummi Nation burial grounds.

It was a not-so-subtle “accident” and was the last straw for many in the local tribal community. The Lummi subsequently burned a mock check from the terminal proponents at the site of the planned coal terminal. It was a pivotal moment for activism in the Northwest.

Opposition from the tribes can be a tremendous barrier for the coal, oil, and gas industries to surmount. Above and beyond their sovereignty, most of the Northwest tribes have specific fishing rights guaranteed to them in their treaties with the US government, rights that were subsequently reaffirmed and clarified by the Boldt Decision of 1974. Those tribes have firm legal footing for demanding access to their “usual and accustomed” fishing grounds, which include most of the places where fuel terminals would be located.

Other Puget Sound tribes have also made it publicly clear that they are firmly against coal exports. In April of last year, tribal leaders joined then-Seattle Mayor Mike McGinn in the Leadership Alliance, a coalition against coal export.

Said Tulalip Tribes Chairman Melvin Sheldon:

When it comes to coal… the negative potential of what it does to our Northwest—we stand with you to say no to coal. As a matter of fact, the Tulalip say ‘hell no’ to coal.

Brian Cladoosby, chairman of the Swinomish Indian Tribal Community and one of the state’s most influential Native American leaders, declared:

For thousands of years, Washington State tribes have fought to protect all that is important for those who call this great state home. We as leaders need to protect our treaty resources, our economies, and the human health of our citizens and neighbors.

The Nisqually Tribe likewise has submitted thorough public comment in opposition to a giant coal terminal planned for Longview, Washington. Beloved tribal leader Billy Frank, Jr., who recently passed away, was a persistent voice in opposition to Northwest fossil fuel exports. In one of the last things he wrote, he declared his solidarity with the Quinault Nation, who are fighting against a trio of oil terminals proposed in Grays Harbor Washington. Frank wrote:

The few jobs that the transport and export of coal and oil offer would come at the cost of catastrophic damage to our environment for years. Everyone knows that oil and water don’t mix, and neither do oil and fish, oil and wildlife, or oil and just about everything else. It’s not a matter of whether spills will happen, it’s a matter of when.

East of the Cascades, too, Native opposition has been fierce. The Yakama Tribe came out publicly and powerfully against Ambre’s proposed coal export facility in eastern Oregon, once again citing tribal fishing rights. Yakama protests and tenacity, in conjunction with other regional tribes like the Warm Spring and the Nez Perce, were a major factor in the proposal not being permitted. In Oregon, the Confederated Tribes of the Umatilla Indian Reservation also joined the Yakama in opposition to coal on the Columbia River, batting down ham-fisted attempts by the industry to buy tribal support.

Networks of tribes, like the Columbia River Intertribal Fish Commission (CRITFC), also voiced their strong concerns about what the proposals would be mean for their communities. The Northwest Indian Fisheries Commission also declared its strong opposition to oil exports from the proposed site at Grays Harbor, highlighting fishing disruption in the Puget Sound, health problems in their communities, and pollution.

In fact, the 57 nations that make up the Affiliated Tribes of Northwest Indians unanimously voted in May of 2013 to officially oppose all fossil fuel export facilities in the Northwest.

Paul Lumley, executive director of the Columbia River Intertribal Fish Commission, may have put the tribal community’s view most clearly:

Our communities are wedged between the railroad and the river. We’ve got nowhere to escape. If we cannot escape, neither will the coal.

Lumley’s words are proving prescient. Last month, yet another Northwest coal export terminal was dealt what was likely a fatal blow. The Oregon Department of State Lands denied a crucial permit to Ambre Energy, which plans to ship coal from a site on the Columbia River. Among the most influential factors the state agency cited for its decision: tribal sovereignty.

The decision was, in some ways, recognition of the power that the region’s tribes and First Nations can exercise over the fossil fuel infrastructure projects that are cropping up across the Northwest. By asserting treaty rights and voicing cultural concerns, tribes are presenting a major barrier—are a key part of the thin green line—to a reckless expansion of coal, oil, and gas schemes.
