First Checks are Mailed for the Nearly $950 Million in Cobell Trust Administration Class Payment

SEATTLE, Sept. 15, 2014 /PRNewswire/ — The Garden City Group, Inc. (Garden City) and Kilpatrick Townsend & Stockton, announced that the first checks were mailed today, Monday, September 15, to the Trust Administration Class in the Cobell Indian Trust Settlement.

On August 30, 2014, the Interior Department provided the data to Garden City, the firm Court-appointed to administer the Settlement, for the payments and on September 11, The United States District Court for the District of Columbia entered an Order approving plaintiffs’ unopposed motion to begin distribution of nearly $950 million. This was the final approval needed to commence payment of the Trust Administration portion of settlement funds to Class Members.

“Garden City is sending checks to Trust Administration Class Members where we have a current address beginning today,” said Jennifer Keough, Chief Operating Officer, Garden City. “Checks may take five to seven days to reach Class Members once they have been mailed.”

The Cobell Settlement is the largest class action settlement against the federal government.  Filed in 1996 by the late Elouise Cobell and other Native American leaders, it sought an accounting of the individual Indian trust accounts and reform of the trust system, which had been mismanaged for over a century.  Once the case settled, counsel for the Plaintiffs, Bill Dorris and David Smith of Kilpatrick Townsend, and Garden City were tasked with distributing funds to 500,000 individual Indian beneficiaries across the country.  However, the records from the Department of Interior reflected decades of neglect.

As David Smith, Counsel for the Cobell Plaintiffs in the Washington, DC office of Kilpatrick Townsend explained, “There were insufficient or absolutely no addresses for over 315,000 class members, 22,000 individuals Interior listed as alive were deceased, over 1,200 Interior listed as deceased we found were still alive, and there were thousands of whom Interior had no record at all.  But it was important that Elouise Cobell’s legacy be fulfilled and that class members receive the money to which they were entitled under the Settlement.  By working closely with tribes, associations, and individual Indians across the country we were able, in just over a year and a half, to fix trust records that had not been adequately addressed by the federal government for generations.”

The 22nd annual Salmon Homecoming Celebration being held September 18 to 20 at Waterfront Park in Seattle, Washington is dedicated to the life and memory of the late Billy Frank Jr., Nisqually, longtime defender of treaty rights and chairman of the Northwest Indian Fisheries Commission.

The celebration’s theme is “Man has responsibility, not power,” based on a traditional proverb of the Tuscarora Indian Nation.

Frank passed away on May 5 at the age of 83. He had been an adviser to and supporter of Salmon Homecoming throughout its history. “Billy understood the responsibility spoken about in that Tuscaroran proverb,” said Salmon Homecoming president Walter Pacheco, Muckleshoot. “He knew we are all responsible for the health of the salmon, the environment and the protection of the land, air and water.”

The event celebrates Native American culture and the importance of salmon—culturally, economically, environmentally and spiritually—to the people of the region. The celebration includes arts and crafts, environmental exhibits, visits to the Seattle Aquarium, storytellers, a salmon bake, a Northwest gathering and powwow, and a canoe welcoming event.

“For 22 years, the Salmon Homecoming Alliance has brought Native American culture and traditional environmental knowledge into the heart of Seattle, providing a unique opportunity for people from all walks of life to learn about and enjoy the many lessons and customs of the indigenous people of this land,” Pacheco said.

“It has always been our belief that everyone, regardless of age, gender or vocation is someone of great importance and—as the Tuscarora proverb indicates—has a responsibility to help take care of the land and natural resources needed to sustain future generations.”

The U.S. Mint has announced its designs for the 2015 and 2016 Native American $1 coins, and the choice of subjects—Mohawk Iron Workers and Code Talkers—represent a focus on  late 19th- and 20th-century Native history. Since 2009, beginning with a depiction of the “three sisters” agricultural technique, which Natives practiced for thousands of years before European contact, reverse-side coin designs have spotlighted elements of Native culture or episodes from history in a sort of timeline. The 2014 coin commemorated the Native role played in Lewis and Clark’s 1804-06 journey into the Pacific Northwest.

Under the terms of the Native American Coin Act signed by President George W. Bush in 2007, the 2016 coin will be the program’s last.

WASHINGTON – The United States Mint announced today the reverse (tails side) designs selected for the 2015 and 2016 Native American copy Coins.

The theme for the 2015 design is “Mohawk high iron workers, builders of New York City and other skylines (from 1886).”  The design depicts a Mohawk ironworker reaching for an I-beam that is swinging into position, rivets on the left and right side of the border, and a high elevation view of the city skyline in the background.  The design includes the required inscriptions United States of America and copy, and the additional inscription Mohawk Ironworkers.  United States Mint Artistic Infusion Program (AIP) artist Ronald D. Sanders designed the reverse, and United States Mint Sculptor-Engraver Phebe Hemphill will sculpt it.

The theme for the 2016 design is “Code Talkers from both World War I and World War II (1917-1945).”  The design features two helmets with the inscriptions WWI and WWII, and two feathers that form a “V,” symbolizing victory, unity, and the important role that these code talkers played.  The design also includes the required inscriptions United States of America and copy.  Artist Thomas D. Rogers, Sr. designed the reverse.  The sculptor-engraver will be selected at a later date.

The obverses (heads sides) of the 2015 and 2016 Native American copy Coins will continue to feature sculptor Glenna Goodacre’s “Sacagawea” design, introduced in 2000.  Inscriptions will be LIBERTY and IN GOD WE TRUST.  The year, mint mark, and E PLURIBUS UNUM will be incused on the coins’ edges.

The Native American copy Coin Program is authorized by the Native American copy Coin Act (Public Law 110-82).  The program, launched in 2009, calls for the United States Mint to mint and issue copy coins featuring designs celebrating the important contributions made by Indian tribes and individual Native Americans to the history and development of the United States.

Missing Section Of Nez Perce Trail Holds Little-Known Part Of History

The story most people learn about the Nez Perce Tribe and the capture of Chief Joseph doesn’t tell the whole history.

Now the federal government and Northwest Tribes are trying to fix that with a new historic site.

You may have heard about the Nez Perce’s epic 1,200-mile flight through Oregon, Idaho, Wyoming and Montana in 1877. The U.S. Army caught up with them before they could reach Canada. And in history books and documentaries, the story usually ends with the tribe being forced to surrender just 42 miles from the border — and freedom.

But in fact, for about a third of the Nez Perce, it didn’t end there. Nearly 300 people escaped the battlefield and did cross into Canada.

Ruth Wapato’s grandfather was one of them. Wapato is part of a group that’s been working to get the federal government to recognize the final leg in the Nez Perce National Historic Trail.

“They weren’t all off together, some up front, some way behind,” Wapato said. “Their moccasins torn and worn out, you know. And it was cold — in October. But they were on their way.”

Some stayed and their descendants remain in Canada. Wapato’s grandfather returned to the U.S. and was arrested and sent to Oklahoma.

The Forest Service is holding a series of public meetings in Oregon, Idaho and Washington through early October. They’re asking for public comment on adding an extra section and making other updates to the trail.

‘Am I Next?’ Indigenous Women in Canada Ask Social Media

It’s the heartbreaking question of our time, at least in Canada, where indigenous women have begun a social media campaign to draw attention to the prevalence of violence against them.

The movement was started by Holly Jarrett of Hamilton, Ontario, according to CBC News. Jarret is a cousin of Loretta Saunders, a grad student at St. Mary’s University in Halifax, Nova Scotia who was murdered earlier this year, allegedly by her tenants when she went to collect rent. The 26-year-old, pregnant Saunders had been researching the issue of missing and murdered indigenous women in Canada—more than 1,200 unsolved cases over the past few decades, according to the Royal Canadian Mounted Police (RCMP)—for her thesis when she went missing herself.

Most recently, across the country in Manitoba, the body of 15-year-old Tina Fontaine was pulled from the Red River in Winnipeg in August, wrapped in a bag. The homicide investigation is ongoing.

The call was raised once again for a national inquiry into the issue. Soon after Fontaine’s remains were found, the premiers of all the provinces met with the Assembly of First Nations, the Métis National Council and Inuit Tapiriit Kanatami (ITK) and came out advocating for a roundtable. Prime Minister Stephen Harper has long held that an inquiry would not yield any answers and thus was not the way to go.

It’s not just First Nations calling for such an inquiry. President Terry Audla is also advocating for an inquiry, as is Métis National Council President Clément Chartier. Both also attended the meeting with premiers. The premiers as well support the roundtable idea—a meeting with federal ministers to discuss the issue, according to CBC News—and aboriginal leaders have agreed to that as a first step.

Meanwhile across Canada, women are posting selfies of them holding signs bearing the slogan “Am I Next?” and posting them to social media under the #AmINext hashtag, as CTV News reported. There is also a petition at Change.org calling for an inquiry, started as well by Jarrett.

“Our family is Inuit, and Loretta has now become one of the over 1186 missing or murdered Aboriginal women she was fighting for,” wrote Jarrett on Change.org. “It is time for our government to address this epidemic of violence against Aboriginal women. Our family is gathering strength and we will not let her death be in vain. We will fight to complete Loretta’s unfinished work.”

Burke Museum Hopes To Bring Original Kwakwaka’wakw Seahawks Mask to Seattle

During the apex of Seahawks fever earlier this year, U.W. art students began researching the origins of the team’s logo. When they asked Burke Museum curator Robin K. Wright, she remembered a conversation she had with a past curator who identified the source as a photo in a 1950’s book of Northwest coastal art.

After a bit more research, students found the inspiration was a photo of a transformation eagle mask from the Kwakwaka’wakw—an indigenous tribe from British Columbia. After poking around some more, the director of the Hudson museum at the University of Maine revealed that the original mask was in their collection, and are now willing to lend the mask to the Burke for display in November.

The Burke Museum has launched a Power2Give campaign to pay for the conservation, insurance, and shipping of the mask. Those who donate will get an early look at the mask during the exhibit’s opening.

“If We Cannot Escape, Neither Will the Coal”

Northwest Tribes and First Nations block fossil fuel exports.

Across the Northwest, Native communities are refusing to stand idle in the face of unprecedented schemes to move coal, oil, and gas through the region. It’s a movement that could well have consequences for global energy markets, and even the pace of climate change.

Now is a good moment for pausing to examine some of the seminal moments of resistance from tribal opposition to fossil fuel exports. Yesterday, the second Totem Pole Journey came to an end with a totem pole raising ceremony at the Beaver Lake Cree Nation in Alberta. As it did last year, the journey showcased the tremendous breadth and depth of indigenous opposition to coal and oil schemes—spanning Native communities from coastal forests to the high plains interior of North America.

The journey was a reminder not only of the particular moral authority of the tribes and First Nations in the face of fossil plans, but also the fact that they are uniquely equipped to arrest these export plans.

British Columbia

Like the United States, Canada is in the midst of a natural gas boom. The industry is trying desperately to move its products to foreign markets, but concerns about public health, fishing rights, and environmental damage have First Nations raising red flags.

Many of the First Nations in British Columbia have banded together against a liquid natural gas facility at Fort Nelson in northeast BC. At what is now being called the “Fort Nelson Incident” Chief Sharleen Gale gave a rousing speech, saying:

My elders said, you treat people kind, you treat people with respect… even when they are stabbing you in the back. So I respectfully ask government to please remove yourselves from the room.

Gale later asked LNG representatives to leave as well, and the event galvanized the BC aboriginal community. Since then, no fewer than 28 BC First Nation organizations have signed a declaration to put the facility on hold.

Elsewhere in the province, aboriginal communities have been in a long standoff with proponents of the highly controversial Enbridge Northern Gateway Pipeline, a proposal that would move tar sands oil from Alberta to port facilities in BC where it would be transferred to tankers that would move the crude to Pacific markets. At least 50 First Nation leaders and 130 organizations have signed the “Save the Fraser Declaration.” Citing concerns over water quality, fishing, treaty rights, and sovereignty, nine coastal First Nations even went so far as to preemptively ban oil tankers in their territorial waters.

The Canadian federal government gave approval to the Northern Gateway Pipeline in June, and women of the Gitga’at Nation did not take it lying down. In protest, they stretched a 4.5 kilometer (2.7 mile) crochet chain across the narrow channel near Kitimat, where the export facility is proposed to be built.

“It’s to show that we’re prepared to do what it takes to stop them because we can’t let it happen. It’s the death of our community, our culture,” said Lynne Hill, who generated the idea.

Now, similar opposition is mounting against Kinder Morgan’s planned Trans Mountain Pipeline expansion in southern BC, and BC First Nations are challenging it in court.

Lillian Sam, aboriginal elder from the Nak’al Koh River region, put the situation in perspective:

You cannot eat money…you see the devastation of the oil sands: a huge part of that land is no good. What’s going to happen to us? What’s going to happen to our children?

The US Northwest

Like their neighbors to the north, Washington Tribes have had major concerns over fossil fuel exports, not to mention the way they have been treated by proponents of the projects.

In 2011, the would-be builder of the Gateway Pacific coal terminal near Bellingham got into hot water with permitting agencies after it was discovered that they had begun construction without approval. Not only did construction crews destroy acres of sensitive wetlands, they also damaged local Lummi Nation burial grounds.

It was a not-so-subtle “accident” and was the last straw for many in the local tribal community. The Lummi subsequently burned a mock check from the terminal proponents at the site of the planned coal terminal. It was a pivotal moment for activism in the Northwest.

Opposition from the tribes can be a tremendous barrier for the coal, oil, and gas industries to surmount. Above and beyond their sovereignty, most of the Northwest tribes have specific fishing rights guaranteed to them in their treaties with the US government, rights that were subsequently reaffirmed and clarified by the Boldt Decision of 1974. Those tribes have firm legal footing for demanding access to their “usual and accustomed” fishing grounds, which include most of the places where fuel terminals would be located.

Other Puget Sound tribes have also made it publicly clear that they are firmly against coal exports. In April of last year, tribal leaders joined then-Seattle Mayor Mike McGinn in the Leadership Alliance, a coalition against coal export.

Said Tulalip Tribes Chairman Melvin Sheldon:

When it comes to coal… the negative potential of what it does to our Northwest—we stand with you to say no to coal. As a matter of fact, the Tulalip say ‘hell no’ to coal.

Brian Cladoosby, chairman of the Swinomish Indian Tribal Community and one of the state’s most influential Native American leaders, declared:

For thousands of years, Washington State tribes have fought to protect all that is important for those who call this great state home. We as leaders need to protect our treaty resources, our economies, and the human health of our citizens and neighbors.

The Nisqually Tribe likewise has submitted thorough public comment in opposition to a giant coal terminal planned for Longview, Washington. Beloved tribal leader Billy Frank, Jr., who recently passed away, was a persistent voice in opposition to Northwest fossil fuel exports. In one of the last things he wrote, he declared his solidarity with the Quinault Nation, who are fighting against a trio of oil terminals proposed in Grays Harbor Washington. Frank wrote:

The few jobs that the transport and export of coal and oil offer would come at the cost of catastrophic damage to our environment for years. Everyone knows that oil and water don’t mix, and neither do oil and fish, oil and wildlife, or oil and just about everything else. It’s not a matter of whether spills will happen, it’s a matter of when.

East of the Cascades, too, Native opposition has been fierce. The Yakama Tribe came out publicly and powerfully against Ambre’s proposed coal export facility in eastern Oregon, once again citing tribal fishing rights. Yakama protests and tenacity, in conjunction with other regional tribes like the Warm Spring and the Nez Perce, were a major factor in the proposal not being permitted. In Oregon, the Confederated Tribes of the Umatilla Indian Reservation also joined the Yakama in opposition to coal on the Columbia River, batting down ham-fisted attempts by the industry to buy tribal support.

Networks of tribes, like the Columbia River Intertribal Fish Commission (CRITFC), also voiced their strong concerns about what the proposals would be mean for their communities. The Northwest Indian Fisheries Commission also declared its strong opposition to oil exports from the proposed site at Grays Harbor, highlighting fishing disruption in the Puget Sound, health problems in their communities, and pollution.

In fact, the 57 nations that make up the Affiliated Tribes of Northwest Indians unanimously voted in May of 2013 to officially oppose all fossil fuel export facilities in the Northwest.

Paul Lumley, executive director of the Columbia River Intertribal Fish Commission, may have put the tribal community’s view most clearly:

Our communities are wedged between the railroad and the river. We’ve got nowhere to escape. If we cannot escape, neither will the coal.

Lumley’s words are proving prescient. Last month, yet another Northwest coal export terminal was dealt what was likely a fatal blow. The Oregon Department of State Lands denied a crucial permit to Ambre Energy, which plans to ship coal from a site on the Columbia River. Among the most influential factors the state agency cited for its decision: tribal sovereignty.

The decision was, in some ways, recognition of the power that the region’s tribes and First Nations can exercise over the fossil fuel infrastructure projects that are cropping up across the Northwest. By asserting treaty rights and voicing cultural concerns, tribes are presenting a major barrier—are a key part of the thin green line—to a reckless expansion of coal, oil, and gas schemes.

Marysville educator recognized for advocating for Natives

The co-principal of Quil Ceda Tulalip Elementary, Anthony Craig, was recognized by a prominent Washington education group as their “Outstanding Young Educator” of the year.

Craig, who is of Native American heritage himself, was recognized for bringing “culturally competent” practices to his school and being an advocate for Native American students.

The Washington State Association of Supervision and Curriculum Development (WSASCD) announced the award during the Sept. 2 school board meeting.

“The Outstanding Young Educator award is our way of recognizing an emerging educational leader and share his or her exemplary practices with the education community at large,” said Art Jarvis, executive director of WSASCD.

Craig said he was humbled with the award and thanked his colleagues and everyone who has helped him to serve the students.

“I do this to serve my community, but also because my grandmother worked very hard so that I could go to college and be a teacher,” he said. “I once asked her what she wanted to do and she said ‘I wanted to be a teacher, but Indians didn’t go to college then, so you can do that.’ So I stand on the shoulders of a lot of people that came before me.”

Craig completed his Doctorate in Leadership and Policy Studies from the University of Washington in 2012.

Since then he has become a published author in the Journal of Staff Development and will write a full chapter in the upcoming book “Narrowing the Achievement Gap for Native American Students: Paying the Education Debt.”

Craig is committed to social justice and advocating in various roles for his students, according to a peer statement read by director of teaching and learning at the district, Kyle Kinoshita.

“Over the years he worked at Tulalip he provided exceptional instructional leadership,” read Kinoshita. “The evidence was seen in the classroom where instructional improvement was traceable to how Anthony modeled, supported and led the learning of the teachers he worked with and demonstrated some of his early leadership capabilities.”

This leadership led him to become co-principal of Quil Ceda Tulalip Elementary and help provide space for all his students.

“Dr. Craig has shown a deep commitment to serving the students in the school and creating an identity-safe place for all students. He has had the courage to confront racism and elitism in a culture of low expectations and done so in a way that unites people, rather than as a way that divides,” wrote Marysville superintendent Becky Berg in a statement.

Quil Ceda Tulalip Elementary still sees low scores on state assessments, however Berg points to the improvements that early grades have shown with high levels of achievement in district assessments.

She says the culturally competent practices and data teams implemented by Craig have helped to better engage with Native American students.

Despite the scores, Berg praised the school as “one of the most successful she has ever seen” when it comes to rebuilding education for tribal students

“Yes, the students are not at an acceptable state achievement level yet, but it takes more than three years to reverse decades of malpractice when it comes to the needs of First Nations children,” she wrote.

Native Vote Counts More in ’14 According to the Math

So what if you had more votes than everyone else? What if your vote counted more? Would you?

Well, on Tuesday the primary season ends with elections in the Northeast. And in one of those states — New York — a candidate for governor, is illustrating exactly that extra voting power. It’s what could happen with Native American voters in 2014.

Zephyr Teachout is running a rag-tag campaign against the machine of incumbent Gov. Andrew Cuomo. She insists that she’s going to win. On Saturday she told MSNBC’s Steve Kornacki that her route to victory will be the “miniscule” turnout in the primary. She said she will win the primary with 300,000 to 350,000 votes. In the last general election, Cuomo earned nearly 3 million votes.

Think of that: A primary vote is worth roughly 10 times that of a general election ballot. It’s because turnout is so low.

Remember Eric Cantor? The former House majority leader was defeated by primary challenger David Brat. Brat only won 36,110 votes — less than five percent of that district’s voters.

Low-turnout elections, whether primary or the general, favor the few, the organized, and, perhaps, Native voters.

How can that be? Let’s play with some numbers.

We know that New Mexico has the highest registration rate for Native American voters at 77 percent. That’s step one. And what if that were the standard? What if three-quarters of all eligible American Indians and Alaska Natives were registered to vote?

In Alaska, for example, the total registration for white voters is 71.1 percent, or roughly 362,000 people (figures from the Voter Elections Project and National Commission on Voting Rights.) Alaska Natives could be at least 17.1 percent of that or 87,210 votes. But current estimates are far below that — as low as 43,605.

So if we use New Mexico as the standard? Then the potential vote of Alaska Natives increases by at least 67,238, a difference of nearly 24,000 registered voters.

In a low turnout election, as 2014 is likely to be, that’s a pool of voters that every candidate would want to woo. (Remember it only took some 36,000 votes to knock off the next Speaker of the House, Rep. Cantor.)

Of course that’s just registration numbers. Step one. But the deadline for that first step is coming up across the country. Most states require registration 30 days before Election Day.

One phrase I’ve used a lot in this piece is “at least.” Let me explain. All of the numbers I am using are not precise and they’re based on elections past. But every year there is a growing number of first-time voters.

This is Indian country’s greatest advantage. Here are six more numbers to think about: 18, 11 and 19. And, 15, 23, and 16.

In 2008, when Barack Obama was first on the ballot, people 18 to 29 accounted for 18 percent of the electorate. Then, two years later, that same group voted in smaller numbers and only were 11 percent of the total. Then, two years ago, the young voter was back and it grew to 19 percent of the pie. On the other hand, older voters, 65 and older, were 15 percent of the total in 2008, rose to 23 percent in 2010 and dropped again to 16 percent in 2012. Older voters are reliable and show up. Younger voters not so much.

Indian country has the youngest population in America. Our percentage of potential young voters is growing faster than the population.

There are already success stories to shout out. In New Mexico and Montana, young Native American men, between 18 and 24, are registered at the highest rate of all Native American voters (just shy of 9-out-of-10.)

The whole premise of registering Native Americans to vote is simple, so that we can have a fair say in how this country is run and to better shape programs from health to education that determine our future.

A fair say? Pfffft. For Indian country the election of 2014 is about having a disproportionate say. Our votes will count more this time around. So will we?

How to support tribal self-determination

Why today€’s congressional policies fail to empower tribes economically

Nearly 45 years ago, President Richard Nixon delivered a special message to Congress on Indian affairs.

One of his key recommendations was to empower tribes economically. The policy shift was intended to enable tribes to govern their own affairs rather than “terminating” them — a failed policy from the 1950s in which the United States attempted to end its relationships with tribal governments recognized as sovereign.

In the decades since Nixon’s message, there have been significant changes — mostly for the better — to embolden tribes in the areas of health, education and business development. But great needs remain because of widespread unemployment, housing shortages and high suicide rates. While progress has been made since 1970, challenges remain, and the potential to slide back toward de facto termination is real.

The good and the bad

As a result of Nixon’s policy, tribes are recognized as sovereign entities that have the right and responsibility to foster and grow their economies for their citizens. Tribes engage in business ventures on the basis of the needs of and resources available to their communities, and if tribes undertake ventures that utilize local resources and expertise, they are more likely (or at least better positioned) to succeed. Economic growth is essential because many tribal communities have suffered from chronically high unemployment.

This is the essence of self-determination: enabling tribes to decide for themselves what works best. Self-determination is critical because cookie-cutter programs lack the flexibility and nuance to acknowledge the diversity of resources and opportunities that might enable each tribe to create its own strong economy.

There are some examples of economic successes, such as Ho-Chunk Village, in Winnebago, Nebraska, which has garnered praise for its strong economic growth and has dropped unemployment to approximately 10 percent, down from more than 50 percent in 1994, primarily through government contracting. Its reinvestment of profits to create housing and job opportunities in the community has also drawn praise. But such successes are generally considered outliers in the public consciousness, which tends to view tribal communities as destitute, plagued by high unemployment or reliant solely on gaming ventures. Because of that, the public may not fully comprehend the degree of desperation — and potential for success — embedded in Indian Country today and Congress’ role in its continuance.

Though Nixon left other harmful legacies, the ideal of tribal self-determination remains just and powerful.

Recent congressional policies regarding Native American communities gravely erode the possibility for economic success through empowerment. Over the past several years, there have been efforts to restrict gaming and opportunities for government contracting as well as strong resistance to the resolution of legal issues regarding Indian land that deters outside investment.

There are two distinct problems with Congress’ approach to considering and enacting legislation that affects tribal economic development.

First, Congress has largely acted on tribal economic legislation in piecemeal fashion; one hand does not know what the other hand is doing. Instead, Congress and Indian Country need to use a more holistic approach by building consensus around policies that promote continued economic growth in tribal communities rather than tackling individual issues. And legislators need to understand communities’ capital, educational, regulatory and other needs as an entity in order to provide the best chance for success.

Second, in recent years, there have been more deliberate efforts to restrict programs or authorities that facilitate various economic opportunities for tribes. As tribal enterprises grow, so does congressional attention to tribal businesses and, increasingly, proposed policies have emerged that would hinder growth.

For instance, efforts to restrict tribal gaming — particularly off-reservation gaming — have been obstacles for at least a decade. In addition, efforts to take away provisions in federal contracting programs that provide unique participation of businesses owned by entire tribal communities would undermine Native American communities that do not have significant gaming resources and thus must find other economic ventures.

The proposed changes would treat Native American community-owned businesses (providing for hundreds or thousands of people) the same as individually owned businesses for purposes of qualifying for federal small business programs. But these programs work well. Gaming and federal contracting programs account for more than $35 billion in revenue to tribal communities, which is a large sum, though nowhere near enough to meet the needs of 566 communities across the country.

Third, the Prevent All Cigarette Trafficking Act significantly diminished tribal tobacco manufacturing and distribution on reservations. The law prohibits tobacco distribution through the U.S. Postal Service, making it extremely difficult to process tobacco sales made through the Internet, a niche in the market where tribes and individual Native Americans were particularly successful. When it took effect in 2010, the Seneca Nation anticipated the law would result in 1,000 jobs lost on its territory alone.

Land trusts

Perhaps most significant, Congress has not been able to address the devastating 2009 Supreme Court decision Carcieri v. Salazar, which limited the ability of the federal government to take land into trust for tribes. This has had wide-ranging effects on tribal economic development.

The case turned on the court’s interpretation of a key law passed in 1934 that allows the government to take land into trust only for tribes that are “now under federal jurisdiction.”

The court determined Congress meant only tribes recognized by the government in 1934, not a tribe that is currently under federal jurisdiction.

Land trusts facilitate housing, commercial construction and other tribal projects. Trust status ensures the land cannot be alienated and eliminates state and local taxation of that land. With the status of tribal trust land in question, external investors and businesses are wary of investing in tribal communities. Congress’ inability to enact a positive resolution results in lost economic opportunity for tribes.

Critical health

The interstate commerce clause of the Constitution states that Congress has the power to regulate commerce among the states and among the Indian tribes. Now is the time for Congress to reinvigorate this clause and the origins of self-determination in order to empower tribes, create jobs and honor the responsibilities of the United States toward Indian tribes.

As midterm elections loom and politicians on both sides of the aisle fret over unemployment of 6 to 7 percent, unemployment on tribal reservations is nearing 19 percent. In some communities it climbs higher than 60 or 70 percent. The need for economic development in Indian Country is critical to the health of the entire country because tribal communities are part of rural America, and when tribes succeed, surrounding communities succeed too. It means more people are employed, that more capital is circulating in local economies and that the government has to provide less financial assistance to individuals to meet basic needs.

Today we should recall that Nixon urged Congress to “support and encourage efforts [that] help Indians develop their own economic infrastructure.” Though Nixon left other harmful legacies, this ideal of self-determination remains just and powerful. Congress must recommit to the ideals of self-determination by enacting comprehensive legislation to further empower tribes economically.
