Shell cancels 2014 Arctic drilling – Arctic Ocean & Inpuiat rights reality check

Today Shell announced it was canceling its 2014 drilling in the Alaskan Arctic. Last week the Court of Appeals for the Ninth Circuit ruled that the US government violated the law when it sold offshore oil and gas leases in the Chukchi Sea off the coast of Alaska.  The decision stems from a lawsuit filed by a coalition of Alaska Native and conservation groups.  Indigenous Plaintiffs included The Native Village of Point Hope, Inupiat Community of the Arctic Slope and Resisting Environmental Destruction on Indigenous Lands (REDOIL), among numerous conservation groups.  EarthJustice, a nonprofit environmental law organization, represented our groups.

REDOIL joined this lawsuit because we strongly uphold and promote the subsistence rights of Alaska Natives and offshore development poses a very real threat to those rights in relation to the Chukchi Sea and Inupiat subsistence and that is unacceptable.

This decision is one that we celebrate.  Although we’ve had legal victories in court skirmishes on this issue, we’ve been dealt political blows that favored Shell and ignored the rights of the Inupiat and their food security.  This is another opportunity for those in decision making positions to realize that offshore drilling in this region is too risky, not only to Inupiat subsistence but to this critical ecosystem.

Indigenous Peoples have always viewed human rights and a healthy environment as fundamentally linked. The careful management and protection of the Arctic environment is a requirement for the enjoyment of Alaska Native human rights, particularly as they relate to the “subsistence” or “traditional” economy.  Indigenous Peoples of Alaska have long fought for recognition of subsistence rights as a basic inherent fundamental human right.  The Inupiat of the North Slope of Alaska continue to live the ancestral subsistence way of life, which is dependent on a healthy ocean ecosystem.

This right is recognized and affirmed in the international covenants on human rights.  Article I of both the International Covenant on Civil and Political Rights, and the International Covenant on Economic, Social and Cultural Rights read in part:

In no case may a people be deprived of its own means of subsistence.

Proposed offshore drilling of the Chukchi Sea puts subsistence rights and multi-national companies at odds.

Though the subsistence rights of Inupiat was not the foundation of the ruling, it puts the impacts to those subsistence rights on the table again, because the impacts to the natural habitat and ecosystem of subsistence resources needs to be analyzed once again, and you cannot separate environmental impacts from subsistence impacts, for they are the same.

In this recent win, the Court ruled that the Department of Interior failed to adequately analyze the potentially dramatic environmental effects of the sale before offering the leases.  It determined that the agency had analyzed

only the best case scenario for environmental harm, assuming oil development,

and that

[this analysis] skews the data toward fewer environmental impacts, and thus impedes a full and fair discussion of the potential effects of the project.

The agency will have to revise or supplement its analysis for the lease sale once again and must reconsider its lease sale decision.

We believe that the lease sale should be cancelled.  That would be the best decision that the US Government can make on this issue, for several important reasons.  First is the relationship that the Inupiat have with the Chukchi Sea and the resources it provides the communities for their food security.

With this court ruling; it has given me a sense of contentment for now that we have prevented another intent to drill in nature’s abundance of our food resources. With whaling season coming in a few months we will worry not, my heart sings with joy for this ruling we know there is justice!

The Chukchi Sea is home to several important Arctic species such as polar bears, walrus, beluga whales, bowhead whales, and seals. Therefore the Chukchi Sea of the Arctic Ocean is critical to Inupiat subsistence lifestyle. These vital subsistence resources that are intrinsic to the livelihood of Inupiat within the Arctic Oceans are at risk from pollution, noise disturbance, and spills.  A major oil spill in the Arctic Ocean would be impossible to clean up and could have devastating consequences for the region’s ecosystem and communities.

Another factor to take into consideration is that Shell has proven that it has no capacity to drill in this region.  In 2012 the company suffered severe setbacks and mishaps—including running one of its rigs aground, almost running its other rig aground, and incurring pollution and safety violations exceeding a million dollars, with investigations still ongoing.  This should be taken into consideration, since the company itself suspended its program for 2013,acknowledging that it was not equipped to drill in this harsh Arctic region.

A final factor would be that the Arctic is warming at twice the rate of the rest of the world. Indigenous communities in Alaska are already facing severe climate impacts. Why compound this with further oil extraction disrupting their food system?   Barack Obama should take action to show he is still committed to act on climate change for the sake of future generations.  The decision whether to affirm leases in the Chukchi Sea presents an important opportunity for the Obama Administration to take real and meaningful action to address climate change. He should cancel the leases and leave the oil in the ground under the sea, where it won’t spill or further warm the planet.  Humanity would benefit from a decision to cancel the leases, but also the Indigenous peoples of the North’s food security would be assured, and an inevitable oil spill accident would be avoided in this critical ecosystem that is home to many threatened Arctic species.

Northwest Starfish Experiments Give Scientists Clues To Mysterious Mass Die-offs

MUKILTEO, Wash. — Near the ferry docks on Puget Sound, a group of scientists and volunteer divers shimmy into suits and double-check their air tanks.

They move with the urgency of a group on a mission. And they are. They’re trying to solve a marine mystery.

“We need to collect sick ones as well as individuals that appear healthy,” Ben Miner tells the divers as they head into the water.

Miner is a biology professor at Western Washington University. He studies how environmental changes affect marine life. He’s conducting experiments in hopes of figuring out how and why starfish — or sea stars, as scientists prefer to call the echinoderms — are wasting away by the tens of thousands up and down North America’s Pacific shores.

Scientists first started noticing sick and dying sea stars last summer at a place called Starfish Point on Washington’s Olympic Peninsula. Then reports came from the Vancouver Aquarium in British Columbia, where diver biologists discovered sea stars in Vancouver Harbour and Howe Sound dying by the thousands.

It’s been coined “sea star wasting syndrome” because of how quickly the stars deteriorate. Reports have since surfaced from Alaska to as far south as San Diego, raising questions of whether this die-off is an indicator of a larger problem.

“It certainly suggests that those ecosystems are not healthy,” Miner said. “To have diseases that can affect that many species, that widespread is, I think is just scary.”

At first only a certain subtidal species, Pycnopodia helianthoides, also known as the sunflower star, seemed to be affected. Within a day or two of showing symptoms, the fat, multi-armed stars melted into piles of mush.

Then it hit another species, Pisaster ochraceus, or the common, intertidal ochre star. Then another. In all, about a dozen species of sea stars are dying along the West Coast. Sea star wasting has also been reported at sites off the coast of Rhode Island and North Carolina. But researchers say until they’ve identified the cause of the West Coast die-offs, they can’t confirm any connection between these outbreaks.

Scuba diver Laura James was one of the first to notice and alert scientists when the morning sun star, Solaster dawsoni, and the striped sun star, Solaster stimpsoni, began washing up on the shores of Puget Sound near her home in West Seattle.

“I thought, ‘This is just getting a little too close for comfort, I need to go see what’s going on. And I need to document it,’” said James, an underwater videographer.

She decided to take her camera to a popular West Seattle dive spot, a place she knew to be a home to a rainbow of starfish. Underwater James discovered a scene from a horror film.

“There were just bodies everywhere,” James said. “There were just splats. It looked like somebody had taken a laser gun and just zapped them and they just vaporized.”

She returned the site weekly, tracking the body count. At first, young stars seemed to be hanging on, a sign of hope that the next generation might be spared, but then even the smallest succumbed.

James has been diving in Puget Sound for more than two decades and says she’s never seen anything like it.

“People always ask me, ‘Do you see any big difference between now and when you started?’” she said. “I’ve seen some subtle differences, but this is the change of my lifetime.”

Reports from recreational divers like James have made it possible for scientists to track the ebb and flow of the syndrome. That’s what led Miner and his dive team to Mukilteo — a place where sea stars showing initial symptoms could be gathered.

“It turns out that you just need a lot of people out looking to be able to detect the spread,” Miner said.

Miner’s team surfaced, laden with 20 giant orange sunflower stars. They gathered stars that appeared healthy and others that had lesions and weren’t acting normal -— unnaturally twisting their arms into knots.

Miner trucked the stars to an aquarium-filled lab and placed one sickly star in with one healthy looking star. He also set up tanks containing only healthy-looking stars for comparison.

Then he watched to see what would happen.

Within a few hours, the sick stars started ripping themselves apart. The arms crawled in opposite directions tearing away from the body. While starfish have the ability to lose their arms as a form of defense, these starfish were too sick to regenerate their arms. Their innards spilled out and they died within 24 hours.

As for the healthy looking stars, Miner said they didn’t show symptoms anymore rapidly by being in the same tank with sickly stars.

A few weeks later divers returned to Mukilteo to find that most of the sea stars there have died. Miner concluded that all of the stars his team had collected were likely already infected just experiencing varying stages of illness. His team has since continued other infectiousness experiments collecting stars from other areas of Puget Sound where the disease hadn’t yet surfaced.

One such place was San Juan Island, part of an archipelago in the marine waters of Washington and British Columbia.

An Opportunity For Science

“We’re holding steady here and we’re not sure why,” said Drew Harvell, a marine epidemiologist from Cornell University who has studied marine diseases for 20 years. She teaches an infectious marine disease course at the University of Washington’s Friday Harbor Labs on San Juan Island and was at the labs when the disease broke.

Harvell immediately recognized the die-offs as an important opportunity for science. Marine organisms are often plagued by disease outbreaks, she explained, but seldom are scientists able to identify the exact cause.

“We have a problem of surveillance for disease in the ocean because they’re out of sight and out of mind,” Harvell said.

For the past few months, Harvell has been coordinating a network of scientists on both coasts who received rapid response funding from the National Science Foundation to investigate the die-offs. The team has established a website and map run by Pete Raimondi from the University of California Santa Cruz. It’s one of the fastest-ever mobilizations of research around a marine epidemic.

“This is an opportunity for understanding more about the transmission and rates of disease in the ocean, so it’s important that we gather the right kinds of data,” Harvell said.

In her lab, Harvell anesthetizes a healthy sea star before cutting off one of its arms and slipping it into a sterile bag. She’s sending samples to Cornell where her colleague Ian Hewson, a microbial biologist, will compare them with samples of sick sea stars from along the West Coast.

Using cutting-edge DNA sequencing and metagenomics, Hewson is analyzing the samples for viruses as well as bacteria and other protozoa in order to pinpoint the infectious agent among countless possibilities.

“It’s like the matrix,” Hewson said. “We have to be very careful that we’re not identifying something that’s associated with the disease but not the cause.”

Ruling Out Possible Culprits

In the search for what’s causing this sea star die-off, it’s important for scientists to rule things out. Some have suggested that these die-offs could be linked to low oxygen levels in the water and environmental toxins entering the water through local runoff. Yet this seems unlikely, they say, because these conditions would normally impact a wider array of animals, not just sea stars.

Others have pointed out that marine die-offs in the past have been linked to larger environmental factors like climate change and ocean acidification. Warming waters and changing pH levels can weaken the immune systems of marine organisms including sea stars, making them more susceptible to infection.

Some have asked whether radiation or tsunami debris associated with the Fukushima disaster could be behind this die-off. But scientists now see Fukushima as an unlikely culprit because the die-offs are patchy, popping up in certain places like Seattle and Santa Barbara and not in others, such as coastal Oregon, where wasting has only been reported at one location.

Others have wondered if a pathogen from the other side of the world may have hitched a ride in the ballast water of ocean-going ships. Scientists say this fits with the fact that many of the hot spots have appeared along major shipping routes. However, the starfish in quiet Monterey Bay, Calif. have been hit hard, whereas San Francisco’s starfish are holding strong.

But at this point, there’s no evidence to entirely confirm or entirely rule out these hypotheses.

A Sea Without Stars

Sea stars are voracious predators, like lions on the seafloor. They gobble up mussels, clams, sea cucumbers, crab and even other starfish. That’s why they’re called a keystone species, meaning they have a disproportionate impact on an ecosystem, shaping the biodiversity of the seascape.

“These are ecologically important species,” Harvell said. “To remove them changes the entire dynamics of the marine ecosystem. When you lose this many sea stars it will certainly change the seascape underneath our waters.”

Because the die-offs are patchy, scientists aren’t concerned that sea stars will be wiped out entirely. But there’s no end in sight and the disease continues to spread.

“We may still be at the very early stages of this. We don’t really know,” Harvell said. “But it’s as important as ever right now, that we’re monitoring to know where the disease hasn’t been yet and when it first hits.”

New experiments in Washington state started this week to test possible infectious agents. The network of scientists collaborating on this project hope to make an announcement in a few months.

Tribes could get help for sockeye fishery closure

SEATTLE — Commercial and tribal fishermen in Washington state could be getting federal help after the closure of the Fraser River sockeye salmon fishery last year cost them millions of dollars.

U.S. Commerce Secretary Penny Pritzker issued a disaster declaration for the fishery Tuesday. That allows Congress to send money to the affected communities.

The Fraser River flows from the Canadian Rockies into the Strait of Georgia at Vancouver, British Columbia. Low returns of sockeye to the river prompted the closure.

Several Washington tribes, including the Lummis, Nooksacks and Tulalips, fish for sockeye. They and the state’s nontribal, commercial fishermen typically bring in a collective $4.1 million per year from sockeye. The Commerce Department says last year, the total was just $115,000.

Pritzker said that if Congress appropriates money, the National Oceanic and Atmospheric Administration will work closely with Congress, the tribes and the state to distribute it.

Klamath Youth Program Melding Science and Traditional Knowledge Wins National Award

A unique collaboration between a Klamath youth leadership development program and U.S. government researchers has won the U.S. Department of the Interior’s Partners in Conservation award for its use of traditional knowledge in conjunction with modern science.

The Klamath Tribal Leadership Development for Integrative Science and Traditional Ecological Knowledge Program, operating in northern California and southern Oregon, was one of just four recipients working with the U.S. Fish and Wildlife Service, the Klamath Tribes said in a media release. The partnership was one of 20 recipients overall out of groups working with various federal agencies on environmental conservation and won for its work in habitat restoration and the implications for fisheries management.

The cornerstone was the Klamath tribal youth program, started last summer to connect scientists and college students to Klamath Basin restoration projects. Juxtaposing traditional knowledge and modern science, youths from the Yurok Tribe, Hoopa Valley Tribe, Karuk Tribe, Quartz Valley Indian Reservation and Klamath Tribes worked with scientists from NASA, the U.S. Fish and Wildlife Service, the U.S. Geological Survey and the U.S. Forest Service for 10 weeks in the Klamath Tribal Leadership Development Program for Integrative Science and Traditional Ecological Knowledge. Together the partners restored habitat, developed models and collected data from two Klamath watershed tributaries, the Sycan River in Oregon and Shasta Big Springs Creek in California, that support tribal fisheries, the Klamath said in the statement.

The U.S. Department of the Interior noted the unique melding of tribal cultural knowledge with today’s technology that got the program chosen out of the 14 partnerships that were nominated for the award by the U.S. Fish and Wildlife Service. Students worked first with tribal elders to gather ancestral knowledge of the region’s lands and waterways, then applied that knowledge to programs whose goal is to restore and manage native fish populations in the Klamath Basin. At the same time, the program gave tribal youth job skills, setting them up as future conservation leaders even as they contributed to present-day management of fish species that are important to indigenous culture and the ecology, the Fish and Wildlife Service said in a release.

“This partnership has the promise to result in some of the most advanced approaches to fisheries management in the country and will help prepare tribal youth for future careers in conservation,” the Fish and Wildlife Service said. “To date, these agencies have brought their collective resources and expertise with established and emerging technologies and have applied these to this collaborative effort, including remote sensing and unmanned aircraft systems. These technologies hold promise for improving our knowledge base and conservation effectiveness through energy efficient, cost-effective approaches to data collection with less impact on our ecosystems.”

Other partners involved were the Nature Conservancy, Humboldt State University, Southern Oregon University and the Oregon Institute of Technology, the Klamath statement said.

“The Department of the Interior is proud to recognize the accomplishments of those who are innovating and collaborating in ways that address today’s complex conservation and stewardship challenges,” said Department of the Interior Secretary Sally Jewell, who handed out the awards on January 16. “These partnerships represent the gold standard for how Interior is doing business across the nation to power our future, strengthen tribal nations, conserve and enhance America’s great outdoors and engage the next generation.”

Fixing old water and gas pipelines would create far more jobs than building Keystone XL

In the coming months, President Obama will decide whether to approve the permit for the Keystone XL pipeline, which would transport crude tar-sands oil from Alberta to the Gulf of Mexico. We know that the pipeline would greatly aggravate climate change, allowing massive amounts of the world’s dirtiest oil to be extracted and later burned.

The payoff, say supporters such as the U.S. Chamber of Commerce, is a job boom in construction industries, which are currently suffering from high unemployment. Earlier this month, Chamber of Commerce CEO Tom Donohue called on the president “to put American jobs before special interest politics.”

If you believe headline-grabbing challenges such as Donohue’s, the president is painted into a corner on the KXL pipeline — trapped by a stagnant economy and an ailing environment.

The president knows KXL’s jobs promises are way overblown. In July, he explained it this way to The New York Times: “Republicans have said this would be a big jobs generator. There is no evidence that is true.” The most realistic estimates, said the president, show that KXL “might create maybe 2,000 jobs during the construction of the pipeline, which might take a year or two.” And after that, “we’re talking about somewhere between 50 and 100 jobs in an economy of 150 million working people.”

Still, even a few thousand construction jobs can’t be dismissed out of hand, in an industry where nearly a million people are estimated to be out of work. Those jobs would put food on the table and pay mortgages. They would alleviate a lot of pain, even if only temporarily. As a country, we’re still hungry for jobs. It seems as if we’re collectively out on the street and KXL is the only offer that has come along.

But that’s not actually the case.

According to “The Keystone Pipeline Debate: An Alternative Job Creation Strategy,” a study just released by Economics for Equity and Environment and the Labor Network for Sustainability, targeted investments in our existing water and natural-gas pipeline infrastructure needs along the proposed five-state corridor of the KXL pipeline would create many more long-term jobs than Keystone XL, both in absolute terms and per unit of investment.

We can create far more jobs in the construction industry and do it right in the regions that would stand to benefit from the KXL pipeline. We can get beyond the zombie jobs-vs.-environment debate that keeps rearing its ghoulish head, putting people back to work without breaking the climate. We can do all this by tackling the national crisis of aging infrastructure — repairing things such as crumbling water mains and leaking gas lines that are critical to our communities and our economy.

The data from the report are straightforward and compelling. Meeting the $18 billion in needed water and gas line repairs would support:

–  More than 300,000 total jobs across all sectors

–  Nearly five times more jobs, and more long-term jobs, than KXL

–  156 percent of the number of direct jobs created by Keystone XL per unit of investment

All of this necessary infrastructure work can be financed, as the report describes, just by closing three federal tax breaks fossil fuel companies enjoy for drilling and refining activities.  So the tax loopholes that would help subsidize the KXL pipeline could instead fund many more longer-lasting jobs repairing existing water and gas infrastructure.

To be clear, natural gas has serious negative impacts to communities and the environment. Fracking, the now commonly used process of extracting shale gas from deep underground, releases 30 percent more greenhouse gas emissions than conventional drilling and is poisoning water supplies across the country. But we still need to fix leaks in our existing natural-gas pipelines, which are contributing significantly to climate change. Shoring up those pipelines will also protect communities and businesses that rely on gas now, as we transition to cleaner energy.

Damage caused by leaking and unsafe gas pipelines cost governments across the country more than $450 million between 1984 and 2013. The American Society of Civil Engineers, in its latest Infrastructure Report Card, recently gave the country a D+ on energy infrastructure, and a D on drinking-water and wastewater infrastructure. If we don’t get our act together, we’re going to see more devastating explosions like the one that tore through San Bruno, Calif., a few years ago.

What’s curious is that many of the politicians and lobbying groups who have touted the KXL pipeline as a source of jobs have opposed legislation to invest in job-creating pipeline infrastructure programs. Yet when it comes to job creation, infrastructure improvements beat out KXL by a country mile. KXL has become a litmus test for being pro-job, but one that’s far detached from reality and that’s drawing attention away from effective ways to get people back to work.

Meanwhile, environmentalists, frequently excoriated as “job killers,” are becoming a strong collective voice for investment in infrastructure and other things our country really needs. They are increasingly working with organized labor to develop concrete alternatives to jobs that may destroy the environment.

If job creation is our primary goal, then politicians should pivot away from the Keystone XL pipeline and toward repairs to existing pipeline infrastructure. This is how President Obama — and the whole country — can get out of the Keystone jam.

Is it safe to eat fish from the Pacific Ocean in the wake of the Fukushima nuclear disaster? The consensus since the 2011 power plant failure has been a yes, but Seattle’s Loki Fish Co. found customers remained concerned.

The fishing company, a local institution, went on to do its own testing for radiation levels in its fish, and shared the laboratory reports online. (The short version: The fish were fine.)

“We were getting so much blowback from customers that have just been reading incredibly paranoid stuff on the Internet,” said Pete Knutson, co-founder of the family-owned business. Beyond some of the “off the charts” fears, though, he understands why people would be concerned, and he’s always interested in knowing how pure his own products are. The decision: “Let’s just do the testing and let the chips fall where they may.”

It helped his decision that he could find no specifics from public agencies like the FDA, which simply says on its website that “to date, FDA has no evidence that radionuclides from the Fukushima incident are present in the U.S. food supply at levels that would pose a public health concern.”

After the $1,200 endeavor, Loki’s web page reported that “All seven stocks of salmon were tested for the radionuclides associated with the nuclear plant failures in Japan: Cesium 134, Cesium 137, and Iodine 131. Of the seven samples, five did not register detectable levels of radionuclides. Two of the samples registered at trace levels – Alaskan Keta at 1.4Bq/kg for Cesium 137, and Alaskan Pink at 1.2Bq/kg for Cesium 134. There were no detectable levels of iodine-131 in any samples.

“To put those numbers in perspective, the critical limit set by the FDA for either Cesium-134 or Cesium-137 is 370 Bq/kg, far above the amount found in Loki’s Alaskan Keta and Pink salmon.”

The full lab testing reports can also be downloaded from the page. (There was also a certain amount of both natural and man-made radioactivity in the ocean pre-Fukushima.)

Is that enough to ease the minds of diners? One customer on the Loki Facebook page wrote “A. it’s only January. B. keep testing.” Another warned that “it would be unrealistic to tell people afraid of the radiation on the basis of one test that the fish is safe forever.”

Knutson said that “I tell people, this isn’t conclusive, it’s only 7 samples, but it’s a random sampling,” not one that could have been gamed in any way. At the least, “it makes me feel better.”

Bellingham-based Vital Choice Wild Seafood & Organics, which sells fish online, has had fish tested several times with similar results. Knutson wasn’t aware of anyone else doing so, but thinks such moves might be more common in the future. His son, Dylan, faced regular queries about the radiation issue at Loki’s farmers market tables, though those customers are “a pretty motivated group that’s interested in chain of custody,” and perhaps more likely to raise the issue.

People are “not fully confident the government’s telling the truth,” or that corporations are telling the truth, he said. Sharing such direct data from producer to customer, he said, might just be “where the future of food is.”

SEATTLE — Washington lawmakers took up a proposal Wednesday to require more transparency from companies that transport oil through the state.

The hearing on House Bill 2347 played out before a packed committee room in Olympia. The new bill would require oil companies to file weekly reports with the state Department of Ecology detailing how much oil is being transported, what kind of oil it is, how it’s being moved and what route it’s traveling through the state.

Right now oil companies aren’t required to share any specific information with state agencies about how much oil is traveling the railways.

Johan Hellman of BNSF Railway says it should stay that way. BNSF is the company currently delivering oil from the Bakken oil fields of North Dakota to Washington refineries. That traffic could increase as rail-to-ship transfer terminals are being proposed for ports on the Columbia River and Puget Sound.

Hellman said increased transparency brings greater security risks.

“You can imagine if you’re publicizing information about specific routes, specific volumes, locations where those are being shipped it does provide a tremendous security concern,” he said in his testimony, adding that the oil companies don’t want to share that information for competitive purposes.

The U.S. Department of Transportation has classified Bakken oil as a hazardous material because it catches fire and explodes at much lower temperatures than previously thought.

Several city and county officials voiced support for the bill and concerns over the uptick in oil-by-rail traffic.

“I think we’re taking bombs through our cities when you look at Spokane,” said Ben Stuckart, president of the Spokane city council. “We’re in a situation where our town would be split in half if we look at a derailment.”

Oil trains currently run through Spokane before following the Columbia River. Once in Western Washington, they head north through the Interstate 5 corridor, passing through other towns and cities along their route.

More oil was spilled from trains in 2013 than in the last four decades combined. That’s according to an analysis of federal data by McClatchyDC.

The bill could be amended before passing out of committee. No Republicans have signed on to support the bill.

GMO labeling debate shifts to Olympia

SEATTLE — Months after Washington voters narrowly rejected an initiative requiring labeling of genetically modified foods, lawmakers are reviving the GMO debate in Olympia.

One bill would require labeling genetically engineered salmon for sale, even though federal regulators have not yet approved any genetically modified animals for food. Another bill requires many foods containing GMOs to carry a label.

The debate comes as the U.S. Department of Agriculture is considering approval of an apple engineered not to brown. The U.S. Food and Drug Administration is also weighing an application for a genetically modified salmon that grows twice as fast as normal.

In Olympia, a public hearing is scheduled Friday in the House Committee on Agriculture & Natural Resources on the bill. That measure also would prohibit genetically engineered finfish from being produced in state waters

More oil spilled from trains in 2013 than in previous 4 decades, federal data show

WASHINGTON — More crude oil was spilled in U.S. rail incidents last year than was spilled in the nearly four decades since the federal government began collecting data on such spills, an analysis of the data shows.

Including major derailments in Alabama and North Dakota, more than 1.15 million gallons of crude oil was spilled from rail cars in 2013, according to data from the Pipeline and Hazardous Materials Safety Administration.

By comparison, from 1975 to 2012, U.S. railroads spilled a combined 800,000 gallons of crude oil. The spike underscores new concerns about the safety of such shipments as rail has become the preferred mode for oil producers amid a North American energy boom.

The federal data does not include incidents in Canada where oil spilled from trains. Canadian authorities estimate that more than 1.5 million gallons of crude oil spilled in Lac-Megantic, Quebec, on July 6, when a runaway train derailed and exploded, killing 47 people. The cargo originated in North Dakota.

Nearly 750,000 gallons of crude oil spilled from a train on Nov. 8 near Aliceville, Ala. The train also originated in North Dakota and caught fire after it derailed in a swampy area. No one was injured or killed.

The Pipeline and Hazardous Materials Safety Administration doesn’t yet have spill data from a Dec. 30 derailment near Casselton, N.D. But the National Transportation Safety Board, which is the lead investigator in that incident, estimates that more than 400,000 gallons of crude oil were spilled there. Though no one was injured or killed, the intense fire forced most of Casselton’s 2,400 residents to evacuate in subzero temperatures.

The Association of American Railroads, an industry group, estimates that railroads shipped 400,000 carloads of crude oil last year. That’s more than 11.5 billion gallons, with one tank car holding roughly 28,800 gallons.

Last year’s total spills of 1.15 million gallons means that 99.99 percent of shipments arrived without incident, close to the safety record the industry and its regulators claim about hazardous materials shipments by rail.

Czdvw.La.91But until just a few years ago, railroads weren’t carrying crude oil in 80- to 100-car trains. In eight of the years between 1975 and 2009, railroads reported no spills of crude oil. In five of those years, they reported spills of one gallon or less.

In 2010, railroads reported spilling about 5,000 gallons of crude oil, according to federal data. They spilled fewer than 4,000 gallons each year in 2011 and 2012. But excluding the Alabama and North Dakota derailments, more than 11,000 gallons of crude oil spilled from trains last year.

Last week, the principal Washington regulators of crude oil shipments by rail met with railroad and oil industry representatives to discuss making changes to how crude is shipped by rail, from tank car design to operating speed to appropriate routing. Transportation Secretary Anthony Foxx called the meeting productive and said the group would take a comprehensive approach to improving the safety of crude-oil trains.

Foxx said the changes would be announced within the next 30 days.

U.S. Sen Begich speaks out against proposed Pebble Mine in Alaska

JUNEAU — U.S. Sen. Mark Begich has come out against the proposed Pebble Mine, calling the massive gold-and-copper project “the wrong mine in the wrong place for Alaska.”

In a statement released by his office Monday, Begich said he has long supported Alaska’s mining industry and believes continued efforts must be made to support resource-development industries that help keep Alaska’s economy strong. But he said “years of scientific study (have) proven the proposed Pebble Mine cannot be developed safely in the Bristol Bay watershed.”

“Thousands of Alaskans have weighed in on this issue, and I have listened to their concerns,” he said. “Pebble is not worth the risk.”

In 2011, the U.S. Environmental Protection Agency initiated a review of large-scale mining in the Bristol Bay region in response to concerns about the impact of the proposed Pebble Mine on fisheries. The agency released its final report last week, concluding that large-scale mining in the Bristol Bay watershed posed significant risks to salmon and Alaska Native cultures that rely on it. The region is home to a world-premier sockeye salmon fishery.

The report did not recommend any policy or regulatory decisions. But EPA regional administrator Dennis McLerran said it would serve as the scientific foundation for the agency’s response to the tribes and others who petitioned EPA to use its authority under the Clean Water Act to protect Bristol Bay. Mine opponents have been pressing the agency to take steps to block or limit the project.

Begich, a Democrat, is the only member of the state’s congressional delegation to outright oppose the project, and his position, first reported by the Anchorage Daily News, won praise from Pebble critics on Monday.

Sen. Lisa Murkowski and Rep. Don Young, both Republicans, last week expressed concerns that the EPA report could be used to pre-emptively veto the project, saying that would set a bad precedent.

“If the EPA has concerns about the impact of a project there is an appropriate time to raise them – after a permit application has been made, not before,” Murkowski said in a release.

Under section 404c of the Clean Water Act, the EPA has the authority to restrict, prohibit, deny or withdraw use of an area as a disposal site for dredged or fill material if the discharge would have “unacceptable adverse” effects on things like municipal water supplies or fisheries, according to an EPA fact sheet. The agency says it has issued just over a dozen final veto actions since 1972.

Mike Heatwole, a spokesman for the Pebble Limited Partnership, the group behind the project, said Pebble is disappointed that Begich had “come out against thousands of new jobs, hundreds of millions in state revenue, and potentially billions in economic activity for Alaska.”

Heatwole said in a statement that it is “no secret that there is a substantial difference of opinion regarding the science of EPA’s recent Bristol Bay Assessment. Not many Alaskans think EPA is impartial.”

He said there is a process that exists for evaluating a project, and there is no environmental harm in allowing Pebble to follow that permitting process.

Begich told The Associated Press that one of the complaints he hears from the mining industry is that it needs to know what federal agencies want before getting too far along in the permitting process. He said if Pebble intends to apply for a permit, the watershed assessment provides a framework for what to respond to before the permit process starts.
