U.S. DISTRICT COURT DISMISSES LAKE QUINAULT CASE

TACOMA, WA (5/4/15)—United States District Court Judge Ronald B. Leighton dismissed a lawsuit this afternoon which had been filed in January against the Quinault Indian Nation and the Washington State Department of Natural Resources seeking to revoke ownership of Lake Quinault from the Tribe.
“This quick and explicit ruling was never in doubt,” said Quinault Nation President Fawn Sharp. “As I said back in January, Lake Quinault is undisputedly within the Quinault Reservation. This was a meritless lawsuit. Lake Quinault is sacred to us. It is unquestionably within our Reservation and we take our responsibility to manage it properly very seriously.”
The suit, which was filed by North Quinault Properties LLC, questioned the Tribe’s ownership of the lake. The suit had included DNR for alleged failure to fulfill its management responsibilities. But the challenge actually stemmed from a few local landowners’ reactions to closure of the lake by the Quinault Nation last year, an action taken to protect the lake from pollution problems, invasive species and violation of tribally mandated regulations, said Sharp.
“Our objective is to protect the lake for future generations. We realize it is a popular recreation destination, and we are happy to accommodate those interests, but only as long as the lake is respected and protected at levels we accept,” she said.
“We want to acknowledge the fact that this frivolous lawsuit was brought by a single landowner and that a majority of landowners around the lake understand and support our objectives. They have shown respect for our efforts to reach out to work cooperatively while recognizing the exclusive governing authority of the Tribe. Good public policy among separate and distinct sovereigns requires cooperation, good faith, respect, and, when dealing with tribal nations, an understanding, in principle and practice, that our governing powers long pre-date the United States and its political subdivisions. I want to publicly thank our neighbors and say that we look forward to strengthening our valuable relationship with them. Working together, as we have been able to do, is the best way we can all assure that Lake Quinault will remain clean, beautiful and available for all citizens for many years to come,” she said.
Judge Leighton issued separate dismissal rulings for the Tribe and the DNR. The Court granted the Tribe’s motion to dismiss based on sovereign immunity. The state dismissal was based on the Eleventh Amendment to the U.S. Constitution.

Tomorrow’s Salmon

Effects of climate change and the ongoing loss of salmon habitat came home to roost at this year’s tribal and state salmon fishing season setting process. The result was some of the most restrictive salmon fisheries ever seen in some areas.

A record low snowpack, low stream flows and increasing water temperatures, combined with the results of ongoing habitat loss and declining marine survival, forced the co-managers to sharply cut harvest this year to protect both hatchery and naturally spawning chinook stocks.

The co-managers set seasons based on the need to conserve the weakest salmon stocks. The goal is to protect the weakest stocks while also providing limited harvest on healthy stocks which are mostly hatchery fish.
Last year’s salmon runs throughout Puget Sound returned far below expectations. Those fish that returned faced low stream flows that led to water temperatures soaring to 75 degrees or more in some places. Water temperatures 70 degrees or higher can be lethal to salmon. Last year many adult salmon – both hatchery and wild – died before they could spawn or reach a hatchery.

This year’s returns of hatchery and wild salmon are expected to be about 30 percent lower across the board than last year’s poor returns. Lake Washington chinook provide a good example of why this year’s fishing seasons needed to be more restrictive.

Hatchery and wild salmon returning to Lake Washington must pass through the most urbanized parts of western Washington where they are confronted by polluted stormwater runoff, barriers and low stream flows. When combined with the effects of elevated stream temperatures, the results can be deadly for salmon.

The Muckleshoot Tribe, which tracks salmon migration into the lake through the Ballard Locks, quickly realized the extent of last year’s low returns and took action to protect the remaining fish. The tribe sharply reduced or eliminated planned harvests, including culturally important ceremonial and subsistence fisheries. But by then most of the damage had already been done. Despite tribal sacrifices, Lake Washington wild chinook populations were further diminished and hatchery egg-take goals were unmet.

Given last year’s poor returns and the increased effects of climate change and habitat loss, the tribes were stunned when the Washington Department of Fish and Wildlife – apparently at the prodding of sport fishermen – proposed even higher chinook sport harvest this year. Their proposal included a mid-Puget Sound fishery targeting chinook in an area where the weak Lake Washington run congregates. But the tribes rejected the proposed harvest increases and the fisheries were withdrawn, leading to howls of protest from some anglers.

The package of fisheries developed by the co-managers for 2015 reflects the reality of lower abundance and reduced fishing opportunity for everyone. Good salmon management requires us to balance the needs of the resource against the desire by some to catch more fish every year. That is why we must have strong leadership to make the tough decisions needed to protect the resource.

The treaty tribes believe that salmon must be managed in the best interest of those who will follow seven generations from now. We will not allow tomorrow’s salmon to be sacrificed for today’s harvest.

New Oil Train Rules Get Mixed Reactions In Northwest

Oil trains are getting stronger tank cars, better brakes, slower speed limits and  possibly new routes. Many in the Northwest say that’s still not enough.

Federal transportation regulators in the U.S. and Canada released a sweeping set of final rules Friday with more stringent requirements for railroads hauling flammable liquids, including crude oil and ethanol. The rules come one day after Oregon Sens. Ron Wyden and Jeff Merkley and four of their Democratic colleagues introduced a wide-ranging bill intended to bolster oil train safety including a fee on oil shipments made in old, puncture-prone tank cars.

“It’s a meaningful step but it doesn’t do enough,” Wyden said Friday of the federal rule. “It doesn’t move quickly enough to secure Oregon communities from the risk of flammable oil trains.”

The Department of Transportation rules would require new electronic brake systems for all trains carrying flammable liquids at speeds above 30 miles per hours by the year 2021. Current air brake technology is nearly a century old. The brake system has been involved in a number of derailments, including the deadly explosion in Lac Megantic in 2013 that set off widespread concern about oil by rail.

Air brakes have also been cited in several whistleblower complaints against railroads, in which workers claim they were pressured to skip or shorten brake tests to keep trains moving on time.

Oil trains would have new speed limits of 50 miles per hour — 40 mph in densely populated areas — and a thorough analysis of routing based on security and safety risks. Oil trains currently move through populated areas in the Northwest like downtown Spokane and Seattle.

Friday’s rules call for a decade-long phase-out of old tank cars, which have been known since 1991 to be puncture-prone. The initial replacement for those cars has increased shielding to protect against punctures, but has also been called inadequate by the National Transportation Safety Board after these newer-model tankers, were involved in a string of fiery derailments. Under the rules, these flawed models would undergo a gradual phase out until 2025.

Many of these requirements are expected to carry significant costs to railroads. BNSF Railway currently hauls more oil by rail through the Northwest than any other railroad. The railroad supports instituting a new generation of tank cars, but indicated in its response to the new rules a resistance to costly upgrades.

“Any regulatory changes that automatically take away capacity will have a devastating impact on our shippers and the economy,” BNSF spokesman Michael Trevino wrote in an email. “Most importantly, capacity is not abundant. The supply chain’s experiences with the recent disruptions at the West Coast ports is clear evidence of the negative impacts substantially reduced capacity will have on the economy.”

Oil-by-rail barely existed a few years ago. But booming North American oil production outpaced pipeline capacity and railroads offered greater flexibility and new markets for energy producers. As many as 17 oil trains per week move through parts of the Northwest, carrying crude from North Dakota, Canada and Utah to refineries and marine terminals in Oregon and Washington. Several other crude-by-rail facilities have been proposed.

Environmentalists, rail workers and safety experts called the rule a positive step, but each pointed out what they think are significant safety gaps.

Jared Margolis, a lawyer with the Center for Biological Diversity, said he thinks the speed limits are too high and the phase-out of old tank cars too dragged out.

The Center for Biological Diversity has previously sued to prevent oil trains in older tank cars from moving through parts of the Northwest, like the Columbia River Gorge.

“We’ll continue to see derailments and spills even with these new rules in place,” Margolis said.

George Gavalla, a railroad safety consultant with 37 years in the industry, including seven as former head of the FRA safety office, called the new rules “a significant improvement,” particularly for requiring improved tank car designs.

“They also put forth an aggressive, yet reasonable timetable for retrofitting (or replacing) the existing tank car fleet,” Gavalla wrote in an email. “At first blush, the tank car standards appear to go a long way toward improving the tank car safety.”

But, he added, “a big issue that the rule does not address is the volatility of the crude oil, especially the Bakken crude oil.”

Herb Krohn, legislative director for the United Transportation Union in Washington, said the rule appears to be a positive development but it ignores what he calls the “larger issue of monitoring the movement of Haz-Mat trains including adequate crewing.”

Krohn’s union has been pushing for shorter trains and minimum mandatory crew sizes, opposing a railroad movement toward one-man crews.

“The railroad carriers strongly oppose any government regulation regarding train crew size and placement;  this is clear from the complete absence of any mention of this critical safety issue,” Krohn said Friday. “The omission of this issue leaves a huge gap in public safety.”

 

Maine Native Americans want state to come to the table on deal for elvers, other fish

PORTLAND, Maine — Maine’s American Indian tribes want state officials to come to the table for a potentially wide-reaching agreement about the way the tribes harvest commercial fish.

Passamaquoddy legislative Rep. Matthew Dana says members of Maine’s tribes have fished for thousands of years and deserve a bigger role in state decision making. His bill would allow for cooperative management of lucrative marine species such as lobsters, clams and baby eels.

The tribes’ request represents a broadening of an earlier drive by the tribes to get reach agreement with the state about fishing for baby eels. The Passamaquoddies and state regulators clashed last year about a state requirement that tribal elver fishermen be subject to individual quotas. The tribe eventually relented.

Seattle billionaire Paul Allen is financing a campaign that could ask Washington voters  to impose penalties for selling animal parts from certain endangered species.

The proposed ballot measure aims to protect 10 keystone species: elephants, rhinoceroses, tigers, lions, leopards, cheetahs, pangolins, marine turtles, sharks, and rays.

Conservation groups say they are among the most trafficked or poached species worldwide. They say illegal wildlife trafficking is the fourth largest transnational crime in the world, delivering ill-gotten profits of $20 billion annually.

Sandeep Kaushik is a political consultant for the initiative. He said  it would place in state law tough penalties beyond those imposed by federal anti-trafficking laws. People caught buying or selling animal parts or products from the 10 species covered by the proposed law would face up to five years in prison and a $10,000 fine.

Backers of the initiative say the best way to protect these endangered animals is to cut off the market where poachers can profit.

“The problem has been getting worse and we’re seeing just in the last few years more species being put at risk,” Kaushik said.

Sam Wasser, director of the University of Washington’s Center for Conservation Biology, said this initiative would help reduce wildlife trafficking in Washington state. He said right now it’s hard to police trafficking once items cross into the U.S.

“In a state like Washington where it is such an important port for materials coming in from Asia, it’s really quite critical that our state agents have the ability to apprehend the ivory,” Wasser said. “Much of the laws now refer to ivory passing across international borders, but state borders — there’s nothing.”

Wasser said the U.S. is one of the largest markets for wildlife products in the world.

“One of the biggest things is trying to deal with the demand side,” Wasser said. “It’s very, very important to have steps all along the way to have steps to increase the consequences if you’re caught and to make it harder for you to get the product in the first place.”

Allen co-founded Microsoft. His conservation philanthropy has been brought into question in 2013 when a Seattlepi.com investigation and lawsuits said his sister, Jody Allen, made employees help her smuggle giraffe bones and ivory out of Africa.

More recently, a bill in the Washington Legislature to increase trafficking penalties for ivory and rhino horns was met with pushback from the National Rifle Association, the Seattle Symphony, and antique collectors, according to The Seattle Times, which reported Sunday on the initiative proposal.

The measure’s backers say they’ve written the initiative to protect trade for antiquities and estate sales, musical instruments, and scientific and research purposes.

“We made sure that this was about targeting those people that are really a part of this international poaching and trafficking problem that is really putting all of these animals at risk,” Kaushik said.

The Humane Society of the United States, the Seattle Aquarium and the Woodland Park Zoo have also endorsed the initiative.

Kosher said New York and New Jersey have also recently implemented similar laws, which have helped curtail ivory and rhino horn trafficking.

Petitioners for the initiative must gather 246,372 valid signatures by July 2 for it to qualify for the November ballot.

Local tribe’s planned whale hunt draws criticism, support

SEATTLE — The Makah Indian tribe has the legal right to hunt gray whales, but some say the practice is cruel and outdated and should no longer be allowed.

It’s been a decade since the Makah tribe in Neah Bay last killed any gray whales, but tribal leaders have announced plans to hunt 20 whales over the next five years.

The tribe says the killing is for cultural reasons, and for 2,000 years it has been a central part of who they are. But many people who attended a Monday public hearing on the matter say the world has lots of examples of cultural traditions that are plain wrong.

Now the National Oceanic and Atmospheric Administration must make their decision on the law and the numbers.

European and Russian hunters nearly wiped out the gray wale population, dropping it from 20,000 to 2,000. Gray whales were then placed on the endangered species list, and the population has since returned to 20,000.

Federal regulators have yet to take a position on the Makah plan, but officials listened to both sides during an emotionally charged public hearing on Monday.

“We did not pick a preferred recommendation because we knew people feel very strongly about that. And we didn’t want to pre-judge it,” NOAA’s Michael Milstein said.

While some turned out Monday to voice support for the tribe, most of the speakers steadfastly oppose the hunt.

“They should perhaps consider what some of the other tribes have done, and honor them in a different way,” said Katherine Pruitt.

Others, including members of the Chippewa tribe, voiced support for the Makah plan.

“It’s in their treaty rights. You know, that’s the big thing. We need to honor it,” said Jeff Powell.

No members of the Makah tribe attended Monday’s meetings. The second and final public hearing will be held Wednesday evening in Port Angeles.

New program to study tribal water challenges

Schurz native Staci Emm and University of Nevada, Reno professor and Interdisciplinary Outreach liaison Loretta Singletary, a former extension coordinator at the Yerington office of the UNR Cooperative Extension, have been named to a new team that has been formed to integrate research and Extension to help Great Basin and Southwestern tribal communities develop plans, policies and practices for sustainable agriculture and water management.

The program is part of a competitive, $4.5 million grant awarded by the U.S. Department of Agriculture’s National Institute of Food and Agriculture.

The five-year program, Native Waters on Arid Lands, brings together faculty and students from three of the West’s 1862 land-grant institutions — University of Nevada, Reno, University of Arizona and Utah State University; First Americans (1994) Land-Grant Consortium (FALCON); Federally Recognized Tribal Extension Program instructors in Nevada and Arizona; Desert Research Institute; U.S. Geological Survey; and Ohio University. The program team includes tribal members from Nevada, Utah, Arizona and New Mexico.

“This is the stuff I love to do,” Emm said. I love working with people and doing programs that actually are on the ground. The program has challenges, and it has so much potential.”

American Indian farmers and ranchers provide an important economic base for the arid lands of the Great Basin Desert and American Southwest. Declining water supplies, urbanization, ecosystem change and federal Indian policies challenge American Indian agriculture for ceremonial practices, sustenance and trade.

Singletary said the group will be working with every tribe in Nevada, a couple in Utah, the Navajo and Hopi nations in Arizona and several small tribes in northern New Mexico.

“The foundation of the project is working with tribal communities through focus groups and tribal engagement about what their challenges are and what their ideas are for possible ways and strategies to use their water,” Singletary said.

Singletary said American Indian land tenures have presented challenges to tribes and impacted their ability to manage water and other natural resources well.

“Water is a precious natural resource and also has profound cultural and spiritual significance to tribal peoples,” John Phillips, executive director of FALCON, a professional association of 1994 land-grant administrators, faculty staff, said. “This program will help Native American communities in the Great Basin and southwest region carry on their historical role as strong environmental stewards for the Earth and its natural resources.”

“The Native Waters on Arid Lands program team will work directly with tribal members to identify challenges to agriculture from diverse and competing demands for water,” Maureen McCarthy, program director and director (interim) of the University of Nevada, Reno’s Academy for the Environment, said. “These issues are complex and transcend ecological and sociopolitical boundaries. Knowledge generated and shared through this program will build capacity among tribal and nontribal organizations to respond to a changing climate.”

Program elements include developing climate scenarios and water supply projections for tribal lands; testing the production efficiency of existing and future water systems; assessing the effects of Indian land tenure on water management and agriculture; considering the applicability of alternative water management policies; and integrating paleoecological data with tribal knowledge to understand the impacts of a changing climate.

Other senior members of the Native Waters integrated program team include Singletary, professor and interdisciplinary outreach liaison with University of Nevada Cooperative Extension, leading collaborative research and Extension outreach; Emm, associate professor and Extension educator with University of Nevada Cooperative Extension, leading outreach and coordinating the tribal advisory council and annual tribal summits; Michael Dettinger, senior hydrologist with the U.S. Geological Survey, leading climate research; Beverly Ramsey, executive director of Division of Earth and Ecosystem Sciences with Desert Research Institute, leading the traditional ecological knowledge research; Bonnie Colby, professor with the Department of Agriculture and Resource Economics with University of Arizona, leading water market economics research; Trent Teegerstrom, Arizona Federally Recognized Tribal Director and Extension specialist, coordinating tribal education and outreach in Arizona; Kynda Curtis, associate professor in the Department of Applied Economics at Utah State University, leading agricultural production economics research; Eric Edwards, assistant professor in the Department of Applied Economics at Utah State University, leading property rights economic research; Derek Kauneckis, associate professor with Ohio University’s Voinovich School of Leadership and Public Affairs and affiliate faculty member with the Desert Research Institute, leading water rights policy research.

Oil Train Safety Legislation Passes In Washington

Olympia — State lawmakers gave final approval Friday to a bill meant to increase oil train safety.

The bill was taken up in response to the uptick in oil train traffic in the region. It directs oil taxes to help pay for  oil-train spill response. It also imposes public disclosure requirements for railroad companies operating in Washington.

The bill was introduced by Gov. Jay Inslee and three dozen of his fellow Democrats in the House, where their party holds the majority. But by the time it was unanimously approved by the Republican-controlled Senate Friday evening, the bill had undergone many changes.

Funding and requirements for enhanced marine spill response, including an extra rescue tug to be stationed in the eastern part of the Strait of Juan de Fuca, were stripped from the bill.

“We got to ‘yes’ on the safety features in the bill and how we pay for them, but we’re going to have to come back and recommit to how we’re paying for the marine side and that is a real true critique of what we got to today,” said Rep. Jessyn Farrell, D-Kenmore, who sponsored of the bill.

Sen. Doug Ericksen, R-Ferndale, said it took compromise to industry-minded lawmakers, too.

“It might not be what everyone wants in every situation but it definitely is the higher majority of a very good idea that’s going to make the people of Washington safer when it comes to crude by rail,” Ericksen said on the Senate floor before the final vote.

Language was stripped from the bill that would have required additional train workers at the rear of oil trains more than 50 cars in length.

The version that passed Friday requires railroads to regularly notify state emergency responders as to the type and quantity of oil arriving by rail, as well as the route of the trains. Oil that arrives by pipeline will be subject to similar notification requirements.

The bill extends to oil hauled by rail the nickel-per-barrel tax currently levied on oil that arrives by ship in Puget Sound. It’s expected to generate roughly $4 million to pay for spill prevention, planning and response.

BNSF Railway transports most of the oil that’s moved along the rails in Washington. The company did not immediately offer a comment.

The Washington Environment Council issued a press release that said the oil industry was responsible for weakening the original legislation.

“While this bill contains some important steps forward in terms of transparency and public disclosure, it leaves huge holes in the safety net needed to protect our communities and waterways from risks we face today,” said Becky Kelley, president of Washington Environmental Council.

The Legislature heads into special session next week to work on the state’s two-year operating budget.

For Healthy Rivers, Farms, Communities in the Face of Climate Change

On the eve of Earth day, the White House recognized Puget Sound as a model for climate change adaptation, making it one of four places in the U.S. where increased cooperation will aid in preparation for the impacts of climate change –including sea level rise, drought, flooding and wildfires.

The Puget Sound region was showcased in the Resilient Lands and Waters Initiative for outstanding efforts in local, state, federal and tribal partnerships around Puget Sound recovery. The release highlights recent successes and builds momentum for efforts to restore floodplains, preserve farmland and reduce flood risk through the innovative Floodplains by Design program and Snohomish County’s Sustainable Land Strategy.

“We are living with the evidence of a changing climate,” said Mike Stevens, Washington State director for The Nature Conservancy. “Longer and more intense winter flooding, low river flows in the summer, and rising seas are affecting both cities and farmlands in the Puget Sound region. “

In Snohomish County, local leaders have developed the Snohomish Sustainable Lands Strategy which brings together Tulalip and Stillaguamish Tribes, government agencies, and local agriculture, and other interests to tackle these issues together.

“Thanks to Sustainable Lands Strategy partners, leadership by Snohomish County Surface Water Management, and the support of the Floodplains by Design program, the county has an assessment of risk and a plan to make the river valleys more resilient in the face of those risks, to the benefit of both people and nature,” Stevens said.

“We are trying to prepare for the future under changing climate conditions,” said Terry Williams of the Tulalip Tribes, a key partner in collaborative efforts underway in Snohomish County. “In the Snohomish River Delta we are getting 500-year-floods more frequently, early spring flooding, early drought. Eighty percent of the delta was diked 100 years ago, and we lost a lot of fish habitat. Mix that with land use that includes forestry, agriculture and urban development—all of that affects the landscape.”

“We’re figuring out how to address these landscapes, these changing conditions, and capitalize on them so we become stronger, rather than weaker,” he said.

“This designation speaks volumes about what we’ve accomplished,” said Tristan Klesick, of Klesick Family Farms. “It’s not easy work, but it’s valuable and important. We have to be stewards of the environment and the economy – we have to have a place for salmon and salamanders, corn, broccoli and milk, homes, schools and hospitals.“

“We look forward to engaging in this opportunity to build upon our efforts to bring government and our communities together to address the natural resource challenges we face,” said Snohomish County Council Chair Dave Somers.

The Nature Conservancy has contributed both science and leadership to this work.

The Blackfeet Tribe and National Congress of American Indians (NCAI) announced a campaign Wednesday to cancel the remaining oil and gas leases within the Badger-Two Medicine area.

The rock band Pearl Jam and member Jeff Ament, who originally is from Big Sandy, will be reaching out to their supporters to encourage them to join the campaign, it was announced during a news conference.

The 165,588-acre area is almost entirely within roads and features mountains, ridges, river valleys and wetlands along the Rocky Mountain Front.

The area has 47 oil and gas leases that the Blackfeet and NCAI contend were illegally granted more than 30 years ago without tribal consultation. Today, 18 leases remain. In 2013, Solonex LLC filed a lawsuit against the U.S. government to begin drilling in the area.

The Blackfeet announced a campaign to urge Congress, President Barack Obama and federal agencies to cancel all remaining leases in the Badger-Two Medicine, which is located at the intersection of the Blackfeet Indian Reservation, Glacier National Park and the Bob Marshall Wilderness.

Tyson Running Wolf, secretary of the Blackfeet Tribal Business Council, said drilling in the lands that are at the heart of the tribe’s creation story with so much cultural significance is not an option. The tribe will be putting the full weight of a growing alliance behind efforts to stop drilling, he said.

“The Badger-Two Medicine is a sacred place where the Blackfeet people gather food and medicine,” Running Wolf said.

The fight against the oil and gas leases was announced during a news conference conducted in Browning by Running Wolf; Blackfeet Chief Earl Old Person; John Murray, Blackfeet tribal historic preservation officer; Jacqueline Johnson Pata, executive director of the NCAI.

Old Person led the announcement with a prayer.

Tribal members have been struggling with the possibility of development in the Badger-Two Medicine for awhile, he said. Past leaders of the tribe said wars of the future would not only be with bows and arrows, he said.

Running Wolf said the Blackfeet Nation has been fighting to protect the area for more than 30 years. Under the Reagan administration, 47 oil and gas leases were illegally issued without consulting the tribe, he said. With the announcement, the full weight of the tribe and a growing alliance is behind the effort.

“We will never let this happen,” Running Wolf said.

Murray said the campaign will include billboards and a website, badger-twomedicine.org. There also is a petition on change.org asking Interior Secretary Sally Jewell and Agriculture Secretary Tom Vilsack to cancel the leases.

The tribe also is reaching out to faith and business communities and national environmental organizations to bring their voices to millions of people around the nation.

Ament, of Pearl Jam, will be helping out as well on social media.

“We’re going to be mobilizing his resources to get the message out about the Badger-Two Medicine,” he said.

Ament, bass player for Seattle-based Pearl Jam, issued a statement through the tribe.

“The Blackfeet Nation sits on the front range of the Rocky Mountains of Glacier National Park, one of the most spiritual and beautiful spots in Montana,” Ament said. “Drilling for oil and gas has no place in the Badger-Two Medicine. Clean water and clean air are precious resources that hold the key to the future of the Blackfeet people and all Montanans. Please cancel the leases in the Badger-Two Medicine.”

On its Facebook page, Pearl Jam urged its followers to join the Blackfeet Nation to protect Badger-Two Medicine region that included a picture of Ament and U.S.Sen Jon Tester, D-Mont.

Johnson Pata, executive director of the NCAI, said Indian access to sacred places is critical responsibility to federal agencies.

“NCAI has requested that the Department of the Interior consult with the tribe on the Badger-Two Medicine, and we are hopeful that the agency will move to cancel all remaining oil and gas leases that threaten the area’s preservation,” she said.

The Blackfeet also announced partnerships with 18 Montana, Idaho, Wyoming, and Canadian Native tribes and nations, The Wilderness Society, National Parks and Conservation Association, the Montana Wilderness Association and the Glacier-Two Medicine Alliance.
